HomeMy WebLinkAboutMinutes - 06/18/1979 - City Council REGULAR MEETING AND RDG PUBLIC HEARING MONDAY , JUNE 18, 1979 8 P.M. The regular meeting of the City Council was held on Monday, June 18, 1979. The meeting was called to order by Mayor Stanek. At roll call the following aldermen were present: Wieser, Adams, Schooley, Meurer, Pepping, Nolan, Harker, Datz. Absent: None. Motion by Schooley, seconded by Adams , to accept the mi- nutes as read of the June 4, 1979 Regular Meeting , of the June 6, 1979 Public Hearing on the RDG-Backhaus annexation and of the June 13, 1979 Special Meeting with the RTA. Voting aye: Wieser, Adams , Schooley, Meurer, Pepping, Nolan, Harker, Datz. Voting nay: None. Absent: None. Motion carried. James Berg, Vice President of Residential Development Group, asked the Council to recess the Public Hearing which was scheduled for tonight, June 18, 1979, because all the papers they were to present were not put together as yet. Motion by Datz, seconded by Nolan, to recess the RDG- Backhaus Public Hearing to the next Regular Meeting of the City Council on Monday, July 2, 1979 at 8 P.M. for the purpose of possible action on the proposed annexation agreement. Voting aye: Wieser, Adams, Schooley, Meurer, Pepping, Nolan, Harker, Datz. Voting nay: None. Absent: None. 111 Motion carried. Dr. Hal Sundin of Baxter & Woodman reported on the bid opening for the Sewage Treatment Plant Addition which was held June 12, 1979. Two bids were received: Keno & Sons Construction Company in the amount of $1,328,500 with 550 days to complete and Wm. Zeigler & Son in the amount of $1,366.666 with 540 days to Monday, June 18, 1979 page 2 complete. Estimated construciton cost by Baxter & Woodman was $1,100,000. It was Dr. Sundin 's recommendation that since only two bids were re- ceived and both exceeded the estimated construction cost adjusted for recent cost increases, that it would be in the best interests of the City to reject all bids and set another bid date. Motion by Harker, seconded by Datz, to reject the two bids submitted and re-advertise for bids which would be due by August 1, 1979 at 2 P.M. at City Hall . Voting aye: Wieser, Adams , Schooley, Meurer, Pepping, Nolan, Harker, Datz. Voting nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Schooley, to return the bond money submitted with the bids from Keno and Zeigler for the sewage plant addition. Voting aye: Wieser, Adams , Schooley, Meurer, Pepping, Nolan, Harker, Datz. Voting nay: None. Absent: None. Motion carried. Motion by Adams, seconded by Meurer, to pass an ordinance approving the annexation agreement concerning 9.25 acres of land on the north side of Bull Valley Road as proposed by Morris-Evans and to authorize the Mayor and Clerk to sign the agreement. Voting aye: Wieser, Adams , Meurer, Pepping, Nolan, Harker, Datz. Voting nay: Schooley. Absent: None. Motion carried. Tom Henley, attorney for Morris-Evans, asked to be placed on the July 2, 1979 agenda when he will present an Annexation Or- dinance and a Zoning Ordinance for approval . His request was granted. Motion by Schooley, seconded by Adams, to approve the Mayor's Monday, June 18, 1979 page 3 nomination of Peter J. Merkel as Director of Recreation for the City of McHenry to be hired as a regular salaried employee at a sal- ary of $15,500 and begin employment with the City on August 13, 1979. Voting aye: Adams , Datz, Meurer, Pepping, Wieser, Schooley, Nolan, Harker. Voting nay: None. Absent: None. Motion carried. Discussion was held on Cable Television regarding its right to use Illinois Bell and Commonwealth Edison easements to install its equipment. Attorney Narusis pointed out that Cable- vision's franchise with the city only entitles them to use city easements such as streets, alleys , sewer and water easement. Cable- vision has to enter separate agreements with the other utility companies for use of their easements. Motion by Nolan, seconded by Pepping, to approve the re- quest of Clark Bierman for use of 3 ball diamonds at Petersen 11 Park on July 14 & 15 for a Women's Softball Tournament and to grant permission to the Lion's Club for operation of a concession stand for those two days. Voting aye: Wieser, Adams, Schooley, Meurer, Pepping, Nolan, Harker, Datz. Voting nay: None. Absent: None. Motion carried. Motion by Harker, seconded by Schooley, to enter into an agreement with the State of Illinois regarding installation of traffic signals at the corner of Illinois 120 and Crystal Lake Road and to authorize the Mayor and Clerk to sign the agreement. Voting aye: Wieser, Adams, Schooley, Meurer, Pepping , Nolan, Harker, Datz. Voting nay: None. Absent: None. Motion carried. ANIMMEIMIE Monday, June 18, 1979 page 4 Motion by Harker, seconded by Datz, to pass an Ordinance prohibiting parking adjacent to and on the approaches of the pro- posed improvement at the intersection of Crystal Lake Road and Route 120. Voting aye: Wieser, Adams , Schooley, Meurer, Pepping, Nolan, Harker, Datz. Voting nay: None. Absent: None. Motion carried. Motion by Schooley, seconded by Adams , to pass a Reso- lution appropriating $12,188.00 from the Motor Fuel Tax Fund to pay the City's share of project costs for installation of traffic signals at the intersection of Route 120 and Crystal Lake Road. Voting aye: 'Wieser, Adams, Schooley, Meurer, Pepping, Nolan, Harker, Datz. Voting nay: None. 11/ Absent: None. Motion carried. Motion by Pepping, seconded by Nolan, to authorize the Mayor and Clerk to sign the Plan Approval for the installation of traffic control signals at the intersection of Route 120 and Crystal Lake Road as submitted by the Illinois Department of Transportation. Motion by Schooley, seconded by Wieser to authorize the expenditure of $5,100.00 for resurfacing of the four tennis courts at Freund Field. Mayor Stanek ask that the Special Committee he appointed with Datz as Chairman and Schooley & Harker as members , submit a report on islands of land that are surrounded by the city as to the possiblity of annexing that property. Mayor Stanek called for a Committee Meeting of the Whole to meet Tuesday, June 26, 1979 at 7:30 P.M. to discuss a possible grant application and development of recreation facilities in the city. Motion by Wieser, seconded by Schooley, to pass a Reso- lution in honor of Father Eugene C. Baumhofer of St. Mary's Catholic Church, who is retiring after serving many years in the City of McHenry. Voting aye: Wieser, Adams, Schooley, Meurer, Pepping, Nolan, Harker, Datz. Voting nay: None. Absent: None. Motion carried. Monday, June 18, 1979 page 10 Motion by Adams, seconded by Pepping, to commend Officers Stahlman, Fitzgerald and Beyer on their excellent handling of police duties as outlined in letters written to the City Council by Chief Pasenelli , and that the letters be made a part of their personnel files. Voting aye: Wieser, Adams, Schooley, Meurer, Pepping, Nolan, Harker, Datz. Voting nay: None. Absent: None. Motion carried. Motion by Adams, seconded by Nolan, to grant permission to Chief Pasenelli to attend the International Association of Chiefs of Police in Dallas, Texas,September 15-20, 1979. The meet- ing was reconvened at 11:16 with all aldermen in attendance. Motion by Pepping, seconded by Harker, to revise Section 2-81 of Ordinance MC-110 which authorizes the city to purchase the initial uniform of Police Department employees coindicent with their appointment but employees shall be responsible to reimburse the city for the actual costs of said uniform not to exceed $350 in the event that service as a uniformed employee is discontinued within the first year. Voting aye: Wieser, Adams , Schooley, Meurer, Pepping, III Nolan, Harker, Datz. Voting nay: None. Absent: None. Motion carried. Monday, June 18, 1979 page 11 Pepping, as Chairman of the Finance Committee, reported that his committee had made a study on longevity pay as requested by the Police Department. Pepping asked that the Public Works and Clerk's Departments make an estimate as to what the costs would be for employees in those two departments should longevity pay be instituted. Motion by Pepping, seconded by Adams , to grant the reβ€” quest of the Senior Citizens Group for a $2,000.00 donation for the purpose of keeping the McHenry Walk-in Center in operation for the coming year, the money to be taken from the General Administra- tion Contingency Fund. Voting aye: Wieser, Adams , Meurer, Pepping, Nolan, Harker, Datz. Voting nay: None. Pass: Schooley. Absent: None. Motion carried. Motion by Schooley, seconded by Datz, to renew the Public Officials Liability Insurance Policy for one-year with Forum Insurance Company for two million dollar liability coverage at a premium of $4,138.00 which was the same as last year's premium. Voting aye: Wieser, Adams , Meurer, Pepping, Nolan, Schooley, Harker, Datz. Voting nay: None. Absent: None. Motion carried. Motion by Harker, seconded by Schooley, to pass an Ordinance amending Section 26-45 of the Minicipal Code providing for installation of outside readers for water meters. Monday, June 18, 1979 page 12 Motion by Harker, seconded by Meurer, to pass an Ordinance amending Section 26-50 and 26-166 of the Municipal Code providing for additional penalties to consistently late payers of city water and sewer service. Voting aye: Meurer, Wieser, Adams, Schooley, Pepping, III Nolan, Harker, Datz. Voting nay: None. Absent: None. Motion carried. Motion by Schooley, seconded by Meurer, to install a street light at the east end of Spruce Lane, one block south of Willow Lane.
