HomeMy WebLinkAboutMinutes - 05/21/1979 - City Council REGULAR MEETING • MONDAY, MAY 21, 1979 8 P.M. The regular meeting of the City Council was held on Monday, May 21, 1979. The meeting was called to order by Mayor Stanek. At roll call the following aldermen were present: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Absent: None. Mayor Stanek awarded plaques to the winners and runner-ups for the Pitch, Hit and Run Contest co-sponsored by the City of McHenry and the National Baseball Association in cooperation with Burger King Restaurants. Nine, ten, eleven and twelve-year-olds were presented plaques and con- gratulated by the Council and their friends and relatives in the audience. Mayor Stanek introduced Rotary Club President Bob Adams, President Elect Ed Cepulis and Jaycees President John Lampe to the Council to thank their organizations for the donations that were made to the park program. The Rotary Club donated $7,000.00 toward the purchase of a 4- slide playground complex and the Jaycees donated a nine-station obstacle course, both of which are located in Petersen Park. The Mayor expressed thanks to them in behalf of the City of McHenry as well as from the surrounding area. Motion by Datz, seconded by Harker, to enter into a lease agreement for one year with the VFW for use of ball fields on its property for the 1979 season at a cost of $1,500.00. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: None. Motion carried. Mayor Stanek read a letter from the McHenry County Senior Citizens Club requesting a donation from the city in order to keep its Walk-In Center open in McHenry. The matter was. turned over to the Finance Committee for further action and recommendation. Monday, May 21, 1979 Page 2 Motion by Schooley, seconded by Adams, to accept the minutes of the May 7, 1979 Regular Meeting and of the May 14, 1979 RDG Public Hearing as read. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: None. Motion carried. A public hearing on the Morris-Evans Annexation was convened. Attorney Tom Henley addressed the Council along with petitioners Art Keevel and Dave Nelson regarding the annexation and zoning of the Morris-Evans property on Bull Valley Road. The Zoning Board of Appeals recommendation was read. Attorney Tom Nuelle, representing McHenry Hospital as objector, also addressed the Council. Motion by Wieser, seconded by Adams, to grant a B03 zoning classification to the Morris-Evans property in question with provisions in the annexation agreement relating to screening, time frame on storage of vehicles, cannibalization, site plan and used parts. Voting Aye: Meurer, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: Schooley. Absent: None. Motion carried. After further discussion, it was the consensus of opinion that Henley should proceed with the required steps for annexation, approval of an annexation agreement and zoning of the property. He was asked to draw up the appropriate ordinances and present them at the June 4, 1979 meeting. Tom Koleno of 1512 N. Richmond Road, McHenry, presented a letter to the Council regarding a question of exactly where his property line was in regard to street and curb construction at the corner of Richmond Road and Washington Street. He also requested that lot stakes which had been uprooted in street construction and several bushes that were dug up from his property be replaced by the City. If it was de- termined that the city sidewalk and curb were on his property, he would agree to sign an easement if it was stated that he would not be held responsible for any accidents or problems which might occur on that Monday, May 21, 1979 Page 3 easement. It was the consensus of opinion that the City should agree to his requests. Motion by Wieser, seconded by Harker, to instruct Land Surveyor 111 Charles Mionske of Island Lake, to make another survey of the Koleno at 1512 N. Richmond Rd. property4at the city's expense which was estimated to be $200.00. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: None. Motion carried. Motion by Harker, seconded by Schooley, to enter into an agree- ment with the State of Illinois Department of Transportation for installa- tion of traffic control signals at the intersection of Route 120 & Ringwood-Draper Road and to authorize the mayor and clerk to sign the agreement. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: None. Motion carried. Motion by Adams, seconded by Schooley, to pass a Resolution appropriating $4,200.00 from the Motor Fuel Tax Fund to pay the city's share of project costs for installation of traffic control signals at the intersection of Route 120 & Ringwood-Draper Road. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: None. Motion carried. Motion by Adams, seconded by Schooley, to pass an Ordinance prohibiting parking adjacent to and on the approaches lying within the city limits of the proposed improvement at the intersection of Route 120 &• Ringwood-Draper Road. Motion by Nolan, seconded by Datz, to authorize the mayor and clerk to sign the Plan Approval for the installation of traffic control signals at the intersection of Route 120 & Ringwood-Draper Road as submitted by the State of Illinois Transportation Department. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: None. Motion carried. Motion by Nolan, seconded by Pepping, to amend our present Developer Donation Ordinance No. 0-77-125 by adopting MC-79-151 which would allow the City to require cash, land or a combination instead of just cash and would allow the city to require Developer Donations from land within the city's mile and one-half jurisdiction. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: None. Motion carried. Motion by Pepping, seconded by Nolan, to publish the amended Developer Donation Ordinance in pamphlet form. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. A written request by David Sundby, of the McHenry 12" and 16" Softball Leagues, to allow them to install lights at the southeast ball diamond in Petersen Park was turned over to the Park Committee for recommendation. Motion by Nolan, seconded by Meurer, to allow the McHenry 12" Softball League to run a concession stand in Petersen Park on Sunday, July 1, 1979 for their annual All Star Game and family picnic. Alderman Wieser, chairman of the License Committee, reported that his committee recommends that a Class "A" liquor license be issued to Carl Thonn at 3311 W. Elm Street with the following stipulations: That the law suit Mr. and Mrs Richard Jager, Sr. have filed against the city be withdrawn and that at the time of the real estate closing for the tavern at 3311 W. Elm Street and before actual physical issuance of the license to Thonn that $700.00 be paid to the city by Jager which represents the one year license fee which Jager did not pay while the tavern was still in operation during litigation of the law suit. Mayor Stanek reported • that Mrs. Jager hand delivered to him a stipulation to dismiss and an agreement signed by Mr. and Mrs. Jager and by their attorney Richard Kelly stating they would dismiss the law suit if we issue a license to the Thonn's and that they would pay the city $700.00 on the closing of the property. The License Committee also recommended that a Class "G" liquor license be issued to Windhill Pancake House at 3307 W. Elm Street. Motion by Harker, seconded by Adams, to increase the Class "A" and Class "G" liquor licenses available in the city by one each which means there will be 18 Class "A" and 3 Class "G" now in effect. Voting Aye: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Voting Nay: None. Absent: None. Motion carried. Motion by Wieser, seconded by Meurer, to authorize the mayor to enter into an agreement with the Jagers and to authorize the mayor and city attorney to sign the agreement and stipulation as presented. Mayor Stanek, as Liquor Commissioner stated he will issue the licenses when all requirements are met. Motion by Schooley, seconded by Adams, to pass an ordinance amend- ing Chapter 7 of the Municipal Code, by adding Section 7-19 which requires that the first floor of R-4, R-4A, R-4B, and R-5 Zoning Districts be faced with Brick masonry veneers, natural or cast stone veneers or precast stone facing. Voting Aye: Schooley, Adams, Wieser, Datz, Harker Pepping. Voting Nay: Meurer, Nolan. Absent: None. Motion carried. • Motion by Harker, seconded by Pepping, to pay Craftsman Painting Co. $23,250.00 for payment estimate No. 1 as recommended by Baxter & Woodman for painting of the water tower. Voting Aye: Schooley, Adams, Wieser, Datz, Harker, Pepping, Meurer, Nolan. Voting Nay: None. Absent: None. Motion carried. Motion by Meurer, seconded by Schooley, to grant permission for a block party on the corner of Brittany and Shore Drive on May 27, 1979 from 11 A.M. to midnight. Voting Aye: Schooley, Adams, Wieser, Datz, Harker, Pepping, Meurer, Nolan. Voting Nay: None. Absent: None. Motion carried. Motion by Adams, seconded by Wieser, to authorize the expenditure of the balance in the Regional Communication Grant Fund for police supplies. Motion by Harker, seconded by Pepping, to pass an ordinance pro- hibiting the planting of trees on the public right-of-way. Voting Aye: Schooley, Adams, Harker, Pepping, Meurer, Nolan. Voting Nay: Wieser, Datz. Absent: None. Motion carried. Motion by Nolan, seconded by Pepping, to authorize the clerk to notify the renters in the apartment building at 3705 W. James Street of the upcoming zoning hearing in regard to a request by Peter Tutera, owner of the building to convert the apartment building to condominium units. Voting Aye: Schooley, Adams, Harker, Pepping, Meurer, Nolan. Wieser, Datz. Voting Nay: None. Absent: None. Motion carried.
