Mayor Stanek reconvened the recessed Public Hearing of May 3, 1979, on Monday, May 14, 1979, at 7:30 P.M. to consider the proposed Annexation Agreement of Residential Development Group re- garding the Backhaus Farm annexation. At roll call the following aldermen were present: Meurer, Schooley, Adams, Wieser, Datz, Harker, Nolan, Pepping. Absent: None. Also in attendance were City Attorney Bernard Narusis; Sup't Fred Meyer, City Clerk Gilpin, James Berg and Don Gersted of RDG and their attorney, Richard Heimberg; Objectors Vernon Schiller, Mr. and Mrs. Gerald Schiller and their attorney, Jeffrey Ladd; the Court Reporter and other interested spectators. A letter written to Mayor Stanek and the City Council by Donald Gersted of RDG was read into the record. The letter was dated May 10, 1979 and contained two proposals dealing with Park Land donations and a proposal regarding the completion of Dartmoor Drive extending west to Curran Road. It was the concensus of opinion that the Council would prefer Park Land Proposal "B" as presented by RDG with the follow- ing specifications: Deed 13 acres of land north of Dartmoor Drive immediately and put 27 acres into escrow immediately; parcels deeded over a 6 year period should be contiguous to prior deeded land. It was also the Council 's opinion that it would require that Dartmoor Drive be extended west to Curran Road and completed with one overlayment within 15 months of the signing of the final plat of any parcel of land west of the creek with a maximum time IIIlimit of 7 years after date of signing annexation agreement. Mayor Stanek recessed the hearing at 9:07 P.M. and re- convened it at 9:21 P.M. with everyone still in attendance. Motion by Wieser, seconded by Schooley, to instruct Attorney Heimberg to redraft the proposed annexation agreement and incorporate all the changes suggested over the past several Monday, May 14,. 1979 page 2 meetings and submit it to Attorney Narusis for review before re- submitting it to the City Council . Voting aye: Nolan, Meurer, Adams, Wieser, Datz, Harker, Pepping , Schooley. Voting nay: None. III Absent: None. Motion carried. Motion by Harker, seconded by Wieser, to set the next public hearing date for Wednesday, June 6, 1979 at 7:30 P.M. Voting aye: Nolan, Meurer, Adams, Wieser, Datz, Harker, Pepping, Schooley.
