MONDAY, MAY 7, 1979 8 P.M.
The regular meeting of the City Council was held on
Monday, May 7, 1979. The meeting was called to order by Mayor
Stanek. At roll call the following aldermen were present: Datz,
Nolan, Harker, Wieser, Adams, Meurer, Pepping, Schooley. Absent:
None.
Motion by Adams, seconded by Nolan, to accept the min-
utes of the April 30, 1979 Regular Meeting, of the May 2, 1979
Public Hearing on the Bauer property and the May 3, 1979 Public
Hearing on the RDG-Backhaus Farm property as read.
Voting aye: Nolan, Harker, Wieser, Adams, Meurer, Datz,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Harker, seconded by Adams, to pass an ordi-
nance approving the proposed annexation agreement for 40 acres
of land by Bernard Bauer and Boone Valley Development Co. and
to authorize the mayor and clerk to sign the agreement.
Voting aye: Nolan, Harker, Wieser, Adams, Meurer, Datz,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Datz, seconded by Schooley, to pass an ordi-
nance annexing 40 acres of Bernard Bauer property contiguous to
Country Club Estates subdivision.
Voting aye: Nolan, Harker, Wieser, Adams, Meurer, Datz,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.

Motion by Wieser, seconded by Nolan, to pass an ordinance
granting an R-1 Zoning classification to Parcel 1 which is the Bauer
homestead and granting R-3 zoning classification to Parcel 2 which
is the remainder of the 40 acre parcel .
Voting aye: Nolan, Harker, Datz, Wieser, Adams , Meurer,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Schooley, seconded by Harker, to grant a fence
variation as requested by Jack Cuevas of 1800 N. Flower Street.
Voting aye: Nolan, Harker, Datz, Wieser, Adams , Meurer,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Wieser, seconded by Harker, to approve the final
plat of Schneider Estates as presented which is inside the mile and
one-half jurisdiction of the City of McHenry and to authorize the
mayor and clerk to sign the plat upon payment of developer donation
fees as required in City Ordinance 77-0-125.
Voting aye: Nolan, Harker, Datz, Wieser, Adams, Meurer,
Pepping, Schooley.

Motion carried.
William Caldwell , attorney for Mr. and Mrs. Eugene Eppel ,
addressed the Council to get a consensus of opinion on whether the
city would be interested in annexing 50 acres of land which is sur-
rounded on three sides by Woodcreek and Glacier Ridge Subdivisions.
They would request R-1 zoning if annexed. It was the consensus of
opinion that the Eppels should proceed with the necessary steps re-
quired in our annexation procedure.

Motion by Schooley, seconded by Meurer, to pass a Reso-
lution allocating 25% of the costs of the proposed Intermittent Re-
paving Project to be paid by the City of McHenry and 75% to be
paid by FAU funds-estimated cost $106,350.00, with all construc-
tion engineering costs to be paid by the city.
Voting aye: Nolan, Harker, Datz, Wieser, Adams, Meurer,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Mayor Stanek announced that two liquor license applica-
tions have been submitted to him as liquor commissioner - one from
Carl and Marie Thonn for a Class A license to operate at 3311 W.
Elm Street (formerly Jake's Dead End Lounge) and one from Donald
L. Schramm for a Class G. Service Bar only license for Windhill
Pancake House at 3307 W. Elm Street. The matter was turned over
to the License Committee for further action and recommendation.
Aldermen Jack Pepping and Ronald Meurer verbally pre-
sented their resignations from the Planning Commission to the
Council . The Mayor announced that Tom Davis had also resigned
from the Planning Commission along with Robert Blake of the Zoning
Board of Appeals.
Motion by Harker, seconded by Nolan, to accept the a-
bove resignations with regret and express deep appreciation to
them for their dedicated service.
Voting aye: Nolan, Harker, Datz, Wieser, Adams, Meurer,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Mayor Stanek submitted the following appointments to
fill the unexpired terms on the Plan Commission and Zoning Board
of Appeals: Kay Halverson, Carl W. Smith and Lynn Donarski to the
Plan Commission and Robert Jessup to the Zoning Board of Appeals .

Motion by Pepping, seconded by Nolan, to accept the mayor's
appointment of Kay Halverson to fill the unexpired term of Tom Davis
on the Plan Commission, term to expire 4-30-80.
Voting aye: Nolan, Harker, Datz, Wieser, Adams, Meurer,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Meurer, seconded by Schooley, to accept the mayor's
appointment of Carl W. Smith to fill the unexpired term of Ron Meurer
on the Plan Commission, term to expire 4-30-83.
Voting aye: Nolan, Harker, Datz, Wieser, Adams, Meurer,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Adams , seconded by Wieser, to accept the mayor's
appointment of Lynn Donarski to fill the unexpired term of Jack
Pepping on the Plan Commission, term to expire 4-30-82.
Voting aye: Nolan, Harker, Datz, Wieser, Adams, Meurer,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Nolan, seconded by Pepping to accept the mayor's
appointment of Robert Jessup to fill the unexpired term of Robert
Blake on the Zoning Board of Appeals, term to expire 4-30-82.
Voting aye: Pepping, Nolan, Schooley, Meurer.
Voting nay: Harker, Datz, Adams, Wieser.
Absent: None.
There being a tie vote, Mayor Stanek cast an aye vote and declared
the motion carried.

Motion by Wieser, seconded by Datz, to pass a Resolution
permitting the use of alcoholic beverages at St. Patrick's Catholic
Church's fund raising event June 15, 16, 22, & 23.

Pepping, Schooley.

Absent: None.
Motion carried.
Motion by Harker, seconded by Schooley, to authorize and
approve payment of $989.67 to Thomas F. Bolger, Collector of Spe-
cial Assessments, as his 1% collector fee for fiscal year 1978-79.
Voting aye: Nolan, Harker, Datz, Wieser, Adams, Meurer,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Harker, seconded by Nolan, to pass a Resolution
authorizing the mayor and clerk to file an application for permit
with the Division of Water Resources Management of IDOT for construc-
tion of an outfall head wall for discharging sewerage treatment ef-
fluent into the Fox River.
Voting aye: Nolan, Harker, Datz, Wieser, Adams, Meurer,
Pepping, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Schooley, seconded by Datz, to authorize the
clerk to open the bids for two 1978 22 ton dump trucks.

Motion by Schooley, seconded by Harker, to purchase two
22 ton dump trucks for a total price as quoted of $31 ,148.00
($22,500.00 minus $440.00, plus $5,888.00 for 2 dump bodies with-
out PTO and pump plus $3,200.00 for 2 fanbelt hydraulics) .
Voting aye: Nolan, Harker, Datz, Wieser, Adams, Meurer,
Pepping , Schooley.

Motion by Adams, seconded by Nolan, to commend Sergeant
Daniel Kinnerk for his alert action as outlined in Chief Pasenelli 's
letter presented to the Council and that the letter be made a part
of Kinnerk's permanent record.

Pepping, Schooley.

Motion by Datz, seconded by Nolan, to authorize and ap-
prove payment of $455.00 to Northeastern Illinois Planning Commis-
sion (NIPC) for 1979-80 fiscal year dues.

tion setting the first Monday morning of each month as a regularly
scheduled pickup time for branches and shrubbery.

Mayor Stanek appointed Datz and Nolan to serve as a com-
mittee for planning and construction of a booth for next year's
Chamber of Commerce Trade Fair.
