Mayor Stanek called to order the Public Hearing on the proposed Annexation Agreement of Residential Development Group (RDG) regarding the Backhaus Farm annexation. At roll call , the follow- ing aldermen were present: Harker, Datz, Smith, Schooley, Rogers. "' Bolger arrived at 7:37 P.M. Absent: Nolan and Adams. Also in attendance were Jim Berg and Attorney Richard Heimberg of RDG; City Attorney Narusis, Sup't of Public Works Meyer, City Clerk Gilpin and objectors, Vernon Schiller and Mr. and Mrs. Gerald Schiller. Each item in the proposed Annexation Agreement was re- viewed by the Council . Motion by Harker, seconded by Datz, to accept Area "C" as delineated on Exhibit "C" for R-4 Multi-Family District with no more than 160 multiple family units. Voting aye: Harker, Datz, Smith, Schooley, Bolger. Voting nay: Rogers. Absent: Nolan, Adams. Motion carried. Motion by Smith, seconded by Harker, to accept Area "D" as delineated on Exhibit "C" for R-5 Condominium District with no more than 192 dwelling units. Voting aye: Harker, Datz, Smith. Voting nay: Bolger, Rogers , Schooley. Absent: Nolan, Adams. There being a tie vote, the Mayor cast an aye vote and declared 111 the motion carried. Motion by Datz, seconded by Harker, to accept Area "E" as delineated on Exhibit "C" for R-5 Condominium District with no more than 176 dwelling units. Voting aye: Harker, Datz, Smith, Schooley. Voting nay: Bolger, Rogers. Absent: Nolan, Adams. Motion carried. Wednesday, March 21, 1979 page 2 It was the concensus of opinion that the Council would accept Area "F" as delineated on Exhibit "C" for B-1 Commercial Retail District with the conditions that it would be developed with all residential uses excluded and that the total floor area on the first floor of all buildings in Area "F", be at all times at least 75 percent sales tax revenue generating. Discussion was also held pertaining to Areas "G", "H" and "I". Motion by Smith, seconded by Datz, to pass a Resolution and send it to the Illinois Department of Transportation requesting Federal Aid participation for engineering on the Washington Street SOS Project. Voting aye: Harker, Datz, Smith, Schooley, Rogers, Bolger. Voting nay: None. Absent: Nolan, Adams. Motion carried. Motion by Smith, seconded by Rogers , to recess this Public Hearing to Wednesday, April 4, 1979 at 7:30 P.M. Voting aye: Harker, Datz, Smith, Schooley, Rogers , Bolger. Voting nay: None.
