MONDAY , MARCH 19, 1979 8 P.M.
The regular meeting of the City Council was held on
Monday, March 19, 1979. The meeting was called to order by Mayor
Stanek. At roll call the following aldermen were present: Datz,
Bolger, Nolan, Harker, Smith, Adams, Schooley, Rogers. Absent:
None.
Motion by Adams, seconded by Nolan, to accept the mi-
nutes of the March 5, 1979 Regular Meeting and the March 12, 1979
Informal Conference minutes as read.
Voting aye: Datz, Bolger, Nolan, Harker, Smith, Adams,
Schooley, Rogers.
Voting nay: None.
Absent: None.
Motion carried.
Mayor Stanek read the Zoning Board Recommendation re-
"' garding a petition presented by the McHenry County Association
for the Retarded to rezone land for Special Use for a home for
the retarded on Kane Avenue. The Zoning Board recommended by a
vote of 6-0 to deny the request. Prior to Council vote, Attorney
for the petitioners, James Militello, addressed the Council and
asked to present three witnesses regarding the matter at hand.
They were Robert Lambourn, Executive Director of the McHenry
County Association for the Retarded; Bill Ewald, architect of the
proposed facility; and Thomas Peters, a real estate appraiser.
Objectors' Attorney Joseph Congdon who was also present, objected
to any additional proceedings being presented at this time because
full testimony had already been presented at the Zoning Board Hear-
ings. Mayor Stanek overruled his objection and the three witnesses
for the-petitioner addressed the Council .
Following over an hour of statements by witnesses, ques-
tions by the Council and closing remarks by both attorneys, the
Mayor called for a motion.

Motion by Bolger, seconded by Nolan, to uphold the Zoning
Board's recommendation to deny the zoning request of the McHenry
County Association for the Retarded.
Voting aye: Bolger, Nolan, Harker, Smith, Adams , Rogers.
Voting nay: Datz, Schooley.
Absent: None.
Motion carried.
Jack Pepping, Chairman of the Plan Commission, appeared
before the Council with Robert Grossman of Associated Planners , Inc.
to urge the Council to enter into a contract with Grossman 's firm
for updating the city's Comprehensive Plan.
Motion by Datz, seconded by Schooley, to authorize the
mayor and clerk to enter into a contract with Associated Planners,
Inc. for updating the City of McHenry's 1970 Comprehensive Plan
at a price not to exceed $15,600.
Voting aye: Bolger, Nolan, Harker, Smith, Adams, Rogers,
Datz, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
McHenry County Board Members Edward Buss and Clint Claypool
appeared at the meeting to report on the present status of FAP 420
and to urge the Council to work with the County in attempting to
get FAP 420 into the active area transportation plan.
Motion by Harker, seconded by Rogers , to accept the agree-
ment with McHenry Lakes Estates (Towne-Orleans) relating to connec-
tion to the Lakeland Park Pumping Station and authorizing the mayor
and clerk to sign the agreement.
Voting aye: Bolger, Nolan, Harker, Smith, Adams, Rogers,
Datz, Schooley.
Voting nay: None.
Absent: None.

Motion by Datz, seconded by Smith, to accept the final
plat of McHenry Lakes Estates (Towne-Orleans) conditioned upon the
delivery of a satisfactory letter of credit.
Voting aye: Bolger, Nolan, Harker, Smith, Adams , Rogers,
Datz, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Harker, seconded by Datz, to accept the Plat
of Dedication of the right-of-way in the Industrial portion of the
McHenry Lakes Estates (Towne-Orleans) property.
Voting aye: Bolger, Nolan, Harker, Smith, Adams , Rogers ,
Datz, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Adams, seconded by Smith, to accept the final
plat of Martin Woods Unit 1 and Plat of Dedication of Martin Road
conditioned upon receipt of an irrevocable letter of credit and
the delivery of an executed plat of Dedication.
Voting aye: Bolger, Nolan, Harker, Smith, Adams , Rogers,
Datz, Schooley.
Voting nay: None.
Absent: None.
Motion carried.
RTA (Regional Transportation Authority) representatives
presented a 30-minute film relating to mini-bus and dial-a-ride
service proposed for the City of McHenry with Council approval .
Following discussion, the mayor was authorized to work with the
RTA in setting up a program similar to the two described in the
film presentation.
Motion by Harker, seconded by Smith, to approve the final
plat of Golfview Estates on Chapel Hill and Woodlawn Roads north

and east of the city within the one and one-half mile planning
jurisdiction of the city.

Motion by Harker, seconded by Nolan, to authorize Sup't
Meyer to obtain prices on extending the 6-inch water line from
Washington Street 450 feet to Richmond Road and report back to
the Council .
Voting aye: Datz, Bolger, Nolan, Harker, Smith, Adams,
Schooley, Rogers.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Datz, seconded by Adams , to commend Officer
Anthony Militano of the McHenry Police Department for his appre-
hension of a wanted felon and to make this commendation a permanent
part of Officer Militano's personnel file.
Voting aye: Datz, Bolger, Nolan, Harker, Smith, Adams ,
Schooley, Rogers.
Voting nay: None

Motion carried.
Motion by Harker, seconded by Nolan, to hire Lester-Witte
Co. as the auditing firm for the City of McHenry during the 1979-1980
fiscal year at a contract price not to exceed $7,500.00.
Voting aye: Datz, Bolger, Nolan, Harker, Smith, Adams,
Schooley, Rogers.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Rogers, seconded by Adams , to purchase 36 tires
for the police squad cars and 4 tires for the Sup't of Public Works
car at a price of $29.27 per regular tire and $30.04 per snow tire
from the Firestone Co.

executive session at 12:26 A.M. for the purpose of discussing

session at 12:40 A.M. •
