MONDAY, JANUARY 29, 1979 8 P.M.
The regular meeting of the City Council was held on
Monday, January 29, 1979. The meeting was called to order by
Mayor Stanek. At roll call the following aldermen were present:
Bolger, Nolan, Harker, Datz, Smith, Adams, Schooley. Absent:
Rogers. (Rogers arrived at 9:11 P.M. )
Motion by Nolan, seconded by Harker, to accept the mi-
nutes of the January 15, 1979 meeting as read.
Voting aye: Bolger, Nolan, Harker, Datz, Smith, Adams,
Schooley.
Voting nay: None.
Absent: Rogers.
Motion carried.
Claudia George and John Cook addressed the Council re-
garding the annexation of their property at 5010 W. Shore Drive,
Lakeland Park. After discussion, motion by Bolger, seconded by
Adams, to refer the matter to the Building and Zoning Committee
for further study and it should return to the Council with a re-
commendation.
Voting aye: Bolger, Nolan, Harker, Datz, Smith, Adams,
Schooley.
Voting nay: None.
Absent: Rogers.
Motion carried.
Mayor Stanek called for a recess at 8:23 P.M. while Al-
derman Smith, chairman of the Building and Zoning Committee, was
given information by Mr. Cook.
The meeting was reconvened at 8:27 P.M. At roll call the
following aldermen were present: Bolger, Nolan, Harker, Datz,
Smith, Adams, Schooley. Absent: Rogers.
Attorney Tom Nuelle appeared on behalf of Derby Acres
subdivision to seek final plat approval of that property.

Motion by Smith, seconded by Harker, that the City Coun-
cil had reviewed the proposed "Plan of Restrictions" submitted by
the developer of Derby Acres and the Council does not feel it should
become involved in any way with enforcement of these restrictions
and declines to take any action concerning the restrictions. Also
that other advisory boards of the city should be instructed not to
affix their signatures to any such documents.
Voting aye: Bolger, Nolan, Harker, Datz, Smith, Adams,
Schooley.
Voting nay: None.
Absent: Rogers.
Motion carried.
Motion by Harker, seconded by Adams, to approve the final
plat of Derby Acres conditioned upon the receipt of a letter of cre-
dit for $315,000.00 being submitted to the city as recommended by
Baxter and Woodman.
Voting aye: Bolger, Nolan, Harker, Datz, Smith, Adams,
Schooley.
Voting nay: None.
Absent: Rogers.
Motion carried.
Attorney Tom Roush of Joslyn and Green addressed the Coun-
cil to request a reduction in their letter of credit for Woodcreek
Subdivision Unit 1.
Motion by Adams, seconded by Schooley, to reduce the let-
ter of Credit for Woodcreek Subdivision Unit 1 as recommended by
Baxter & Woodman in their letter of January 9, 1979 from $300,384.75
to $39,000.00.
Voting aye: Bolger, Nolan, Harker, Datz, Smith, Adams,
Schooley.
Voting nay: None.
Absent: Rogers.
Motion carried.
Motion by Harker, seconded by Datz, to refund the balance
remaining in the Woodcreek Developer Donation Fund after all outstanding

retained personnel costs have been paid from that account.
Voting aye: Bolger, Nolan, Harker, Datz, Smith, Adams,
Schooley.
Voting nay: None.
Absent: Rogers.
Motion carried.
Motion by Adams , seconded by Schooley to authorize the
clerk to contact people to serve as judges of election for the
April 17, 1979 Aldermanic Election based on Ward Aldermen 's sug-
gestions.
Voting aye: Bolger, Nolan, Harker, Datz, Smith, Adams ,
Schooley.
Voting nay: None.
Absent: Rogers.
Motion carried.
Sup't Meyer reported he had contacted McHenry Oil Co.
and Freund Oil Co. requesting prices on Regular and No Lead gaso-
line. McHenry Oil Co. was the only one to respond.
Motion by Smith, seconded by Adams , to accept the price
of McHenry Oil Co. to furnish gasoline to the city garage at the
following prices which are subject to change according to the mar-
ket: Regular-Base price 49.75 plus 72 cents state tax = 57.25 and
No Lead-Base price 52.75 plus 72 cents state tax = 60.25.
Voting aye: Bolger, Nolan, Harker, Datz, Smith, Adams,
Schooley.
Voting nay: None.
Absent: Rogers.
Motion carried.
Alderman Rogers arrived at 9:11 P.M.
Motion by Nolan, seconded by Harker, to accept the re-
commendation of the Purchasing Committee to purchase a 1976 3/4
ton pickup truck for the Public Works Department at a price of
$5,300.00 and to purchase a snow plow for that truck at a cost
of $1,092.00.

Motion carried.
Quotations on two payloaders were obtained by Mayor Stanek
Hough Manufacturing quoted a price of $43,500.00 with a deliver date
of one day and Clark Michigan Co. submitted a bid of $43,850.00 with
a delivery date of four days.
Motion by Nolan,seconded by Smith, to purchase a 1979 In-
ternational Payloader from Hough Mfg. at a price of $43,500.00 with
a 22 yard bucket with $12,000.00 of the purchase price to be paid
from the Water/Sewer Fund.
Voting aye: Bolger, Nolan, Harker, Smith, Adams, Rogers,
Schooley.
Voting nay: Datz.
Absent: None.
Motion carried.
Motion by Rogers, seconded by Schooley, to pass a resolu-
tion expressing the City of McHenry's dissatisfaction with the man-
ner and timing with which Federal Disaster Assistance Administration
funds were granted during the major snow storm of January 13, 1979.
Voting aye: Bolger, Nolan, Harker, Smith, Datz, Adams,
Schooley, Rogers.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Schooley, seconded by Adams, to pay Dunkin
Donuts $47.08 for food used during the snow emergency of January
24, 1979.
Voting aye: Bolger, Nolan, Harker, Smith, Datz, Adams,
Schooley, Rogers.
Voting nay: None.
Absent: None.

Motion by Rogers, seconded by Adams, to purchase a new
IBM electric typewriter for the Police Department.
Voting aye: Bolger, Nolan, Harker, Datz, Smith, Adams ,
Schooley, Rogers.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Smith, seconded by Nolan, to set Monday, Feb-
ruary 20, 1979, at 7:30 P.M. in city hall for the purpose of con-
ducting a Proposed Use Hearing for Revenue Sharing Funds for the
1979-80 fiscal year.
Voting aye: Bolger, Nolan, Harker, Datz, Smith, Adams,
Schooley, Rogers.
Voting nay: None.
Absent: None.
Motion carried.
Motion by Smith, seconded by Adams, to adjourn.
