III III Mayor Stanek called to order a Special Meeting of the City Council for the purpose of considering a Zoning Board of Appeals recommendation on a petition by Barbara Gerasch and for reconvening a Joint Conference concerning a pre-annexation proposal by Residential Development Group for the Backhaus property. The meeting was called to order on Monday, November 13, 1978 at 7:30 P.M. At roll call, the following aldermen were present: Rogers, Schooley, Datz, Smith, Harker, Nolan, Bolger. Absent: Adams. Also present were Attorney Bernard Narusis, Supt. Fred Meyer and Clerk Gilpin. The Zoning Board recommendation on the Gerasch petition was acted upon first. Attorney Tim McKay was present to represent Miss Gerasch and Attorney Paul E. Thompson was present to represent the objectors. Each attorney addressed the Council. Each alderman informed the Mayor they had received a copy of the proposed Ordinance presented by Attorney McKay for amendment of the City of McHenry Zoning Ordinance with the Revised Zoning Board of Appeals recommendation attached. Attorney Narusis advised that the proposed Ordinance was in order. Motion by Nolan, seconded by Harker, to accept the Zoning Board of Appeals recommendation and pass an ordinance granting a Special Use Zoning Classification within the R-3 Single Family District to grant a permit for use and operation of a telephone answering service subject to 3 (three) conditions at 1605 N. Park Street as stated in the ordinance. Voting Aye: Rogers, Schooley, Datz, Smith, Harker, Nolan, Bolger. Voting Nay: None. Absent: Adams. Motion carried. III Mayor Stanek then reconvened the fourth RDG Joint Conference. James Berg, Vice President of RDG, addressed the Council regarding their proposed development. Robert Duchek of Harland Bartholomew & Associates reviewed the Fiscal and Traffic Impact Study prepared by that firm. Monday, November 13, 1978 Page 2 At 9:26 P.M. Mayor Stanek declared a five minute recess. The III meeting was reconvened at 9:33 P.M. At roll call, the following aldermen were present: Rogers, Schooley, Datz, Smith, Harker, Nolan, Bolger. Absent: Adams. Attorney for the objectors, Jeffrey Ladd, spoke on behalf of the approximately 95 objectors in the audience. Others who made comments were: Hugo Manfreddy, Irene Commerick, Jim Bitterman, Lynne Donarski, Mrs. Wm. Forbes and Mrs. James Ericksen. Mayor Stanek requested that Dr. Hal Sundin of Baxter & Woodman, prepare a comprehensive Flood Plain Study of the Boone Creek network in the area of the proposed new development and Whispering Oaks. Attorney Narusis advised that after conclusion of the preliminary joint conference hearings, the Council would ask the Plan Commission to make a report and recommendation for the proposed PUD and then it would go to the Zoning Board of Appeals for report and recommendation. After theIII Council receives both recommendations and reports, negotations concerning the terms of the pre-annexation agreement would be continued between the Council and the developers. Motion by Smith, seconded by Schooley, to adjourn the Joint Conferences and submit the RDG-Backhaus Planned Unit Development to the Plan Commission for its report and recommendation. Voting Aye: Rogers, Schooley, Datz, Smith, Harker, Nolan, Bolger. Voting Nay: None. Absent: Adams. Motion carried. Motion by Rogers, seconded by Harker, to adjourn.
