The meeting was called to order by Mayor Stanek. At roll call the following aldermen were present: Rogers, Schooley, Adams, Smith, Datz, Harker, Nolan, Bolger. Absent: None. Notion by Harker, seconded by Adams, to approve the minutes of the Regular Meeting of July 17, 1978 with one cor- rection and the minutes of the Special Meeting July 25, 1978 as read. Voting Aye: Rogers, Schooley, Adams, Smith, Datz, Harker, Nolan, Bolger. Voting Nay: None. Absent: None. Notion carried. Frank Fabbri, executive vice president of Baxter & Woodman, city engineers, reported to the Council on water system improvements needed at Wells No. 5 and No. 6. Notion by Smith, seconded by Harker, to authorize Baxter & Woodman to complete all the water system improvements required on Wells No. 5 & 6 as outlined in their recommendation in their letters dated July 20 and July 31, 1978, at a cost of $9,715.00. Voting Aye: Rogers, Schooley, Adams, Smith, Datz, Harker, Nolan, Bolger. Voting Nay: None. Absent: None. Notion carried. Notion by Harker, seconded by Datz, to permit Residential Development Group to post a 2-year Maintenance Bond on the 60 homes with Class 50 Ductile Pipe in Boone Valley Units No. 12 & 13. Monday, July 31, 1978 Page 2 Voting Aye: Rogers, Schooley, Adams, Smith, Datz, Harker, Nolan, Bolger. • Voting Nay: None. Absent: None. Motion carried. Jack Pepping, Chairman of the Plan Commission, sug- gested various revisions in the Subdivision Control Ordinance. It was decided that a special meeting should be held to discuss these proposed changes. The date of the Special Meeting was set for Monday, August 28, 1978 at 8:45 P.M. Motion by Smith, seconded by Datz, to approve the final plat of Woodcreek Unit 1 as presented by Attorney James Green. Green presented a letter of Irrevocable Credit from the McHenry State Bank for Kildan III, an Illinois Limited Partnership, in the amount of $320,000.00. Voting Aye: Rogers, Schooley, Adams, Smith, Datz, 11/ Harker, Nolan, Bolger. Voting Nay: None. Absent: None. Motion carried. Motion by Harker, seconded by Nolan, to approve the Preliminary Plat of Boone Valley Unit 14 as presented by James Berg of Residential Development Group. Voting Aye: Rogers, Schooley, Adams, Smith, Datz, Harker, Nolan, Bolger. Voting Nay: None. Absent: None. Motion carried. Motion by Harker, seconded by Smith, to approve the final plat of Whispering Point Commercial Center subject to engineering of the on-site project, subject to an agreement on cost sharing for storm sewer out-fall and subject to the addition of a certificate on the plat relating to the drainage of surface water. Mayor Stanek called a 5-minute recess at 10:20 P.M. The meeting was reconvened at 10:25. At roll call, the following aldermen were present: Rogers, Schooley, Adams, Smith, Datz, Harker, Bolger. Nolan arrived at 10:26 P.M. Motion by Bolger, seconded by Rogers, to pass an ordinance reclassifying the Leibsohn property known as Kingston Venture subdivision to R-3 and granting a variation as recom- mended by the Zoning Board of Appeals. Voting Aye: Rogers, Schooley, Harker, Nolan, Bolger. III Voting Nay: Adams, Smith, Datz. Absent: None. Motion carried. Notion by Harker, seconded by Datz, to reconvene the Public Hearing and Joint Conference on the RDG-Backhaus Annexa- tion Proposal to Monday, August 14, 1978 at 8 P.M. at the McHenry High School West Campus Au1itorium with rental costs to be paid from the deposit made by RDG. Voting Aye: Rogers, Schooley, Adams, Smith, Datz, Harker, Nolan, Bolger. Voting Nay: None. Absent: None. III Motion carried. Notion by Harker, seconded by Rogers, to reduce the bonds for Boone Valley Units as recommended by Baxter & Woodman as follows: Boone Valley Unit 7 to $40,000.00 Bond; Boone Valley Unit 8 to $12,000.00 and Boone Valley Unit 9 to $37,000.00. Motion by Bolger, seconded by Schooley, to grant permission to McHenry Township Fire Protection District to revamp the road bank on the west side of the firehouse at 3610 West Elm Street on Freund Avenue under the supervision of the Sup't of Public Works. Voting Aye: Rogers, Schooley, Adams, Smith, Datz, Harker, Nolan, Bolger. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Nolan, to reconvene the Public Hearing on the Rae Motors Corporation pre-annexation agree- ment to Monday, August 28, 1978 at 8 P.M. Voting Aye: Rogers, Schooley, Adams, Smith, Datz, Harker, Nolan, Bolger. Voting Nay: None. Absent: None. Motion carried. Mayor Stanek announced that he was calling a Special Meeting at 8:45 P.M. on August 28, 1978, for the purpose of dis- cussing changes in the Subdivision Control and Zoning Ordinances. Mayor Stanek appointed Alderman Smith as chairman of a 11/ committee to consider changes in Ward Boundry lines. Rogers and Datz will also serve on the committee. Motion by Harker, seconded by Schooley, to pay William Tonyan & Sons the final payment on the addition to the public works maintenance building in the ctuunt of $41,567.00, to be paid fran the Water/Sewer account.
