The Public Hearing on the 1978-79 Proposed Appropriation Ordinance was called to order by Mayor Stanek. At roll call, the following aldermen were present: Nolan, Harker, Datz, Schooley, Rogers. Absent: Bolger, Smith, Adams. Mayor Stanek asked if anyone in the audience wished to address the Council on the appropriation ordinance. There were no replies from the three persons in attendance. Motion by Datz, seconded by Rogers, to approve the 1978-79 Proposed Appropriation Ordinance as presented which has been on file for Public Inspection for over two weeks in the City Clerk's office. Voting Aye: Nolan, Harker, Datz, Schooley, Rogers. Voting Nay: None. Absent: Bolger, Smith, Adams. (NOTE: Formal action to pass the 1978-79 Appropriation Ordinance will be taken at the Regular Council Meeting of July 17, 1978.) Alderman Adams arrived at 8:48 P.M. Motion by Harker, seconded by Schooley to adjourn the Public Hearing. Voting Aye: Nolan, Harker, Datz, Schooley, Rogers, Adams. Voting Nay: None. Absent: Bolger, Smith. Motion carried. The Public Hearing adjourned at 8:49 P.M. .944.. 41,11141,640 i Clerk Mayor REGULAR MEETING MONDAY, JULY 3, 1978 8 P.M. The regular meeting of the City Council was held on Monday, July 3, 1978. The meeting was called to order by Mayor Stanek. At roll call the following aldermen were present: Nolan, Harker, Datz, Adams, Schooley, Rogers. Absent: Smith, Bolger. Motion by Rogers, seconded by Schooley, to accept the minutes of the Regular Meeting June 19, 1978 and of the Special Meet- ing June 28, 1978, as read. Voting Aye: Nolan, Harker, Datz, Adams, Schooley, Rogers. Voting Nay: None. Absent: Smith, Bolger. Motion carried. Motion by Nolan, seconded by Harker, to recess the Public Hearing on the Towne-Orleans Preannexation Agreement to Monday, July 17, 1978 at 8 P.M. Voting Aye: Nolan, Harker, Datz, Adams, Schooley, Rogers, Voting Nay: None. Absent: Smith, Bolger. Motion carried. Motion by Schooley, seconded by Harker, to pass an Ordinance annexing unconditionally the property described .in a petition presented by McHenry Country Club for .46 acres and to waive the deposit of money required by MC-126. Voting Aye: Harker, Adams, Schooley, Rogers, Mayor Stanek. Voting Nay: Datz. Pass: Nolan. Absent: Smith, Bolger. Motion carried. Mayor Stanek stated that as Liquor Commissioner, he would go on record as agreeing to allow the McHenry Country Club to sell alcoholic beverages on the property annexed in the above ordinance, when requested to do so. Motion by Rogers, seconded by Nolan, to grant a variation Monday, July 3, 1978 Page 2 on the Fence Ordinance to allow Tom Krause to construct a fence at the corner of Green Street and Fairway Drive. Voting Aye: Nolan, Schooley, Rogers. Voting Nay: Harker, Datz, Adams. Absent: Bolger, Smith. There being a tie vote, Mayor Stanek cast a "NAY" vote and declared the motion did not carry. Motion by Harker, seconded by Schooley, to call a Joint Conference on Wednesday, August 16, 1978, at 8 P.M. for the purpose of discussing a proposed Planned Unit Development annexation by Falcon Development Company for 117 acres east of Route 31 north of the city. Voting Aye: Nolan, Harker, Datz, Adams, Schooley. Voting Nay: Rogers. Absent: Bolger, Smith. Motion carried. Voting Aye: Nolan, Harker, Datz, Adams, Schooley, Rogers. Voting Nay: None. Absent: Smith, Bolger. Motion carried. Motion by Schooley, seconded by Harker, to authorize International Decorators, Inc. to paint the ceiling, bars and steel decks of the new addition to the Public Works maintenance building at a cost not to exceed $2,500.00. Voting Aye: Nolan, Harker, Datz, Adams, Schooley, Rogers. Voting Nay: None. Absent: Smith, Bolger. Motion carried. Motion by Harker, seconded by Nolan, to inform Northern Illinois Special Recreation Association of Crystal Lake--Bev Thomas, director--that the City Council would not participate in financing their association activities. Voting Aye: Nolan, Harker, Datz, Adams, Schooley, Rogers. Voting Nay: None. Absent: Smith, Bolger. Motion carried. Alderman Datz left the meeting at 9:40 P.M. Motion by Rogers, seconded by Adams, to enter into Execu- tive Session at 10:14 P.M. for the purpose of discussing pending' litigation. 11/ Voting Aye: Nolan, Harker, Adams, Schooley, Rogers. Voting Nay: None. Absent: Smith, Bolger, Datz. Motion carried. At 10:22 P.M. Mayor Stanek called the Executive Session to order.
