HomeMy WebLinkAboutMinutes - 09/20/1977 - City Council REGULAR MEETING TUESDAY, SEPTEMBER 20, 1977 8 P.M. The City Council met in regular meeting with Mayor Stanek presiding. The regular meeting was postponed from Monday, September 19 to Tuesday, September 20 at the request of Mayor Stanek with the approval of the Council. At roll call, the following aldermen were present: Bolger, Nolan, Harker, Datz, Smith, Adams, Schaedel, Schooley. Absent: None. Motion by Harker, seconded by Schooley, to accept the minutes of the Special Meeting held September 12, 1977, as read. Voting Aye: Bolger, Nolan, Harker, Datz, Smith, Adams, Schaedel, Schooley. Voting Nay: None. Absent: None. Motion carried. Mayor Stanek announced that the Public Hearing for Lancer Cor- poration had been changed from Monday, October 10 to Wednesday, October 5, 1977. Mayor Stanek signed a Proclamation setting Sunday, October 1 as mar Fish Day and proclaiming the week of October 2 through 8 as Fish Organ- ization Week. County Highway Supt. James Rakow and Plan Commission Chairman Jack Pepping made a presentation to the Council on a proposed Route 31 By- Pass Corridor which would run west of the city of McHenry, starting at Route 72 in Kane County to the Wisconsin state line through McHenry County. Rakow presented a drawing which was his concept of a By-Pass but before it could become a reality, the State of Illinois would have to make a feasibility study. This study would take 4 to 5 years to complete and would cost about one million dollars. Motion by Harker, seconded by Bolger, to pass a resolution urging the State of Illinois to make a feasibility study on a proposed Route 31 By-Pass Corridor. Rakow also reported that construction of the Pearl Street Bridge is proceeding on schedule and should be open late this Fall. A Public Hearing was held during the meeting regarding annex- ation of seven lots in Block 9, West Shore Beach subdivision on the east side of Ringwood road adjacent to Brittany Park. The property in question is owned by the McLake Company and was represented by Attorney Leroy Welter. Motion by Schooley, seconded by Datz, to pass an ordinance approving the annexation agreement of the McLake property and authorizing the execution of that agreement by the mayor and clerk. Voting Aye: Bolger, Nolan, Harker, Datz, Smith, Adams, Schooley, Schaedel. Voting Nay: None. Absent: None. Motion carried. Attorney Donald Truckenbrod presented a petition for vacating a portion of Shore Hill Drive in Lakeland Park Unit 3. He represented James and Helen Oeffling and Cary and Hope Conrad whose property is on either side of the street in question. Motion by Harker, seconded by Adams to pass an ordinance vacating a portion of Shore Hill Drive contingent upon clarification of easement rights with authorization to the mayor and clerk to sign the Ordinance when the changes are completed. Voting Aye: Bolger, Nolan, Harker, Datz, Smith, Adams, Schooley, Schaedel. Voting Nay: None. Absent: None. Motion carried. Tuesday, September 20, 1977 Page 3 Willis Martin of the Plan Commission presented a proposed mapping program for updating and consolidating information of city zoning, water mains, sewer lines, soil classification, etc. Motion by Schooley, seconded by Nolan to adopt the proposed mapping program as presented at an estimated cost of $2,770, to pay Willis Martin a fee of $500 for his services and to authorize him to proceed immediately with the program. Voting Aye: Bolger, Nolan, Harker, Datz, Smith, Adams, Schooley, Schaedel. Voting Nay: None. Absent: None. Motion carried. Motion by Harker, seconded by Schooley, to accept the August Treasurer's report as read. Voting Aye: Bolger, Nolan, Harker, Datz, Smith, Adams, Schooley, Schaedel. Voting Nay: None. Absent: None. Motion carried. Motion by Datz, seconded by Adams, to accept the August Clerk's report as read. Voting Aye: Bolger, Nolan, Harker, Datz, Smith, Adams, Schooley, Schaedel. Voting Nay: None. Absent: None. Motion carried. Motion by Harker,to adopt a fencing program for Petersen Park as presented at a cost of $4,005. After discussion, Harker withdrew his motion. Tuesday, September 20, 1977 Page 4 At the direction of the Council, the City Clerk was authorized to shut off water service to residents who submit checks which are re- turned for insufficient funds. Motion by Nolan, seconded by Harker, to authorize the City Clerk to hire a part time employee for her office. Voting Aye: Bolger, Nolan, Harker, Datz, Smith, Adams, Schooley, Schaedel. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Adams to submit payment estimate No. 9 for the Pearl Street Bridge project in the amount of $5,562.50 to the McHenry County Highway Department. Voting Aye: Bolger, Nolan, Harker, Datz, Smith, Adams, Schooley, Schaedel. --N Voting Nay: None. Absent: None. Motion carried. Motion by Datz, seconded by Schooley, to pay Kent Corporation $14,729 for a general liability insurance policy and $5,265 for a super umbrella liability policy. Voting Aye: Bolger, Nolan, Harker, Datz, Smith, Adams, Schooley, Schaedel. Voting Nay: None. Absent: None. Motion carried. Motion by Smith, seconded by Schooley, to approve a street re- pair program for matting Maple Avenue from Route 31 West to the Creek Bridge and matting Millstream drive from Maple Avenue south to the Boone Creek Bridge at an approximate cost of $10,760. Tuesday, September 20, 1977 Page 7 A letter was presented from Northern Illinois Utilities which rejected the offer made by the city for the Lakeland Park Water Company. Mayor Stanek received Council approval to contact the Utility Company and arrange another meeting for further negotiations. �-- Attorney Regina Narusis reported that the Concerned Citizens, Inc. lawsuit regarding a temporary injunction against the city not to issue a building permit to Buss Motor Sales was heard in court Sept. 13. The judge granted the injunction and set a $50,000 bond which the Concerned Citizens must come up with by Sept. 23. The trial on the case has been set for Oct. 24, 1977. Motion by Smith, seconded by Harker, to transfer $15,000 from the Public Benefit Fund to the Lakeland Park Special Assessment Fund.
