DECEMBER 20, 1976 7:30 P.M.
Mayor Stanek called the Public Hearing to order at 7:30 p.m. The
following aldermen were present: Datz, Harker, Smith, Schaedel. Bolger
arrived at 7:351 Absent: Pepping, Hromec, Wegener. Also present:
City Attorney Bernard Narusis, City Clerk Barbara Gilpin, Supt. of Public
Works Fred Meyer, Petitioners Charles Miller, Sr. and Allen Miller and
their attorney, James Green.

answer any questions concerning their petition to annex 146 acres of land
to the city located at the southwest corner of Route 120 and Draper Road.
At the request of Attorney Green, Datz made a motion, seconded by
Smith, that the transcript of the proceedings of the Zoning Board of Appeals
hearing on the McHenry Sand & Gravel annexation proposal held Dec. 10, 1976
at 3 P.M. in city hall be placed on record as part of this Public Hearing.
Voting Aye: Datz, Harker, Smith, Bolger, Schaedel.
Voting Nay: None.
Absent: Pepping, Hromec, Wegener.
Motion carried.
Alderman Wegener arrived at 7:50 P.M.
Motion by Smith, seconded by Harker to accept and include the Plat
of Annexation as Exhibit # 1 in the Public Hearing records as presented
by Attorney Green.
Voting Aye: Bolger, Harker, Datz, Wegener, Smith, Schaedel.
Absent: Pepping, Hromec.
Voting Nay: None.
Motion Carried.
Smith made a motion, seconded by Bolger, that the remarks of City
Attorney Narusis be included in the record of this Public Hearing to wit:
all necessary procedures for the annexation had been complied with by the
petitioners, they have met all statuatory requirements and all documents
they submitted were correct.
Voting Aye: Bolger, Harker, Datz, Wegener, Smith, Schaedel.
Voting Nay: None
Absent: Pepping, Hromec.
Motion carried.
After the Millers answered several questions put to them by
Alderman Schaedel and Harker, Mayor Stanek adjourned the Public
Hearing.

REGULAR MEETING
MONDAY, DECEMBER 20, 1976 8:03 P.M.
The City Council met in regular meeting with Mayor Stanek presiding. At
roll call the following aldermen were present: Bolger, Harker, Datz, Wegener,
Smith, Schaedel . Absent: Pepping, Hromec.
Motion by Harker, seconded by Wegener, to approve the minutes of the Dec-
ember 6, 1976 meeting as read.
Voting Aye: Bolger, Harker, Datz, Wegener, Smtih, Schaedel .
Voting Nay: None.
Absent: Pepping, Hromec.
Motion carried.
Attorney James Green, representing McHenry Sand & Gravel , presented an
ordinance proposing annexation of 146 acres of land located at the southwest
corner of Route 120 and Draper Road, to the City of M-cHenry. City Attorney
Bernard Narusis reported he had examined both the proposed ordinance authorizing
execution of an Annexation Agreement and the Proposed Annexation Agreement. He
said all documents were in proper and correct form and all statuatory require-
ments had been met.
Motion by Harker, seconded by Bolger, to pass the ordinance approving the
of McHenry Sand & Gravel
proposed Annexation Agreement/and authorizing its execution.
Voting Aye: Bolger, Harker, Datz, Wegener, Smith, Schaedel , Stanek.
Voting Nay: None.
Absent: Pepping, Hromec.
(Mayor Stanek was required to cast his vote because the law states that a
two-thirds vote of all corporate elected officials is needed for approval of an
Annexation Agreement. )
Motion carried.
Mayor Stanek read the Zoning Board of Appeals recommendation that the
petition of McHenry Sand & Gravel be granted regarding the property in question.
Motion by Smith, seconded by Harker, to accept the Zoning Board of Appeals '
recommendation and to pass the combined ordinance annexing the property in ques-
tion to the city, classifying the property in question as "I-1" Heavy Industrial

and granting a Special Use Permit as requested.
Voting Aye: Bolger, Harker, Datz, Smith, Schaedel .
Voting Nay: None.
Absent: Pepping, Hromec.
Motion carried.
Motion by Wegener, seconded by Harker, to authorize the City Clerk to open
gasoline bids for the 1977 calendar year.
Voting Aye: Bolger, Harker, Datz, Smith , Schaedel .
Voting Nay: None.
Absent: Pepping, Hromec.
Motion carried.
One gasoline bid was submitted. Hester Oil Company, 4102 W. Waukegan Road,
McHenry, bid as follows: 94 octane leaded regular 51 .9per gal .

93 octane unleaded regular 52.9 per gal .
99 octane leaded premium 54.9 per gal .
Motion by Datz, seconded by Harker, to accept the bid of Hester Oil Company
to furnish gas for the city during the 1977 calendar year.
Voting Aye: Bolger, Harker, DAtz, Smith, Schaedel .
Voting Nay: None.
Absent: Pepping, Hromec.
Motion carried.
Motion by Smith, seconded by Wegener, to accept the Treasurer's Report for
November as read.
Voting Aye: Bolger, Harker, Datz, Smith, Schaedel .

Report as read.

Mayor Stanek instructed the Street and Sidewalk Committee to check into
the possibility of getting a No Left Turn sign at the corner of Green and Elm
Streets. A letter read by Mayor Stanek from the Illinois Department of Trans-
portation stated the portable sign now in use at that location can no longer be
utilized.
Motion by Bolger, seconded by Harker, to instruct Attorney Narusis to draw
up a resolution expressing the city's opposition to the county's potential invol-
vement in the City of McHenry's municipal subdivision platting and land develop-
ment plans.
Voting Aye: Bolger, Harker, Datz, Wegener, Smith, Schaedel .
Voting Nay: None.
Absent: Pepping, Hromec.
Motion carried.
After discussion regarding negotiations between McHenry Savings and Loan
Association, the Street and Sidewalk Committee and City Attorney Narusis , Smith
made a motion, seconded by Wegener, that the Committee and Narusis should pro-
ceed to draw up a contract with McHenry Savings and Loan as outlined by Street
and Sidewalk Committee Chairman George Harker, to be acted upon by the City
Council at a later date. Figures discussed were $7,000 down payment and $500
per month payments.
Voting Aye: Bolger, Harker, Datz, Wegener, Smith , Schaedel .
Voting Nay: None.
Absent: Pepping, Hromec.
Motion carried.
Motion by Harker, seconded by Smith, that the city accept easements from
the present Phesant Valley Planned Unit Development upon receipt of proper legal
descriptions and documents for 20-foot water easements and temporary working
easements.

Voting Nay: None.
Absent: Pepping, Hromec.
