HomeMy WebLinkAboutOrdinances - O-98-893 - 11/04/1998 - ANNEX ADAMS PROPERTY SW CORNER RTE 120 AND CHAPELORDINANCE NO. 0-98-893 AN ORDINANCE ANNEXING PROPERTY ON THE SOUTE SIDE OF STATE ROUTE 120 AT CHAPEL HILL ROAD TO THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS WHEREAS, a written petition signed under oath by Richard A. Adams and Rita A. Adams, the legal owners of record of the real estate hereinafter described, has been filed with the Clerk of the City of McHenry, Illinois, requesting that said real estate be annexed to the City of McHenry; and WHEREAS, no electors reside on said real estate, said real estate is contiguous to the corporate limits of the City of McHenry, Illinois, and is not located within any other municipality; and WHEREAS, said real estate in not part of any public library district, will not be disconnected from any fire protection district, and does not include any right-of-way not currently under the jurisdiction of the City of McHenry, therefore notice is not required to be given to those legal entities as designated in the statutes; and WHEREAS, upon annexation, said real estate will receive a zoning classification of E, Estate District, pursuant to Article III, Section D, of the Zoning Ordinance of the City of McHenry; and WHEREAS, the City of McHenry has determined that the annexation of said real estate is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: The real estate legally described on "Exhibit A", a complete and accurate plat of said real estate attached to this Ordinance and incorporated herein by reference, be and the same is hereby annexed to and made a part of the corporate limits of the City of McHenry, Illinois, including any and all portions of adjacent streets, roads or highways as required by law. SECTION 2: The City Clerk is hereby directed to cause a certified copy of this Ordinance, together with said Exhibit A, to be recorded in the Office of the Recorder of Deeds, McHenry County, Illinois. Following the recordation of this Ordinance and Exhibit A, a copy thereof shall be filed in the Office of the Clerk of McHenry County, Illinois. SECTION 3: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 4: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED THIS 4TH DAY OF NOVEMBER , 1998.
