An Ordinance Extending the Cable Television
Franchise Agreement of the City of McHenry
WHEREAS, the City of McHenry, McHenry County, Illinois, is currently in the
process of negotiating the renewal of the Cable Television Franchise Agreement (the
"Agreement") with TCI of Illinois, Inc. and said negotiations are proceeding according to
the informal process as found in the federal statue [47 U.S.C. 521 at 626(h)]; and
WHEREAS, the current Agreement expired on May 31, 1998, and it is necessary
to extend the current Agreement in order to provide the necessary time to complete the
negotiations.
NOW, THEREFORE, BE IT ORDAINED by the CITY COUNCIL of the CITY OF
MCHENRY, McHenry County, Illinois, as follows:
SECTION 1: That the Cable Television Franchise Agreement, attached hereto and
made a part hereof, of the City is hereby extended until such time as renewal
negotiations have been resolved to the satisfaction of the City of McHenry, but not later
than January 1, 1999.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision
of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid,
such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which
remainder shall remain and continue in full force and effect.
SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: This ordinance shall be in full force and effect upon its passage,
approval and publication in pamphlet form (which publication is hereby authorized) as
provided by law.
Voting Aye: BOLDER, GLAB, MURGATROYD, BAIRD.
Voting Nay: NONE.
Absent: Mr-TLIATCHEY .
Abstain: NONE.
