AN ORDINANCE PROVIDING FOR THE ANNEXATION OF
A PORTION OF THE HICKORY CREEK FARM PROPERTY
TO THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS,
WHEREAS, the City of McHenry is the owner of record of the real estate
hereinafter described on Exhibit A, attached hereto and made a part hereof; and
WHEREAS, said real estate is approximately 8 acres in area, and is located on
the south side of McCullom Lake Road, approximately 1,500 feet north of Peterson Park
Road, in McHenry Township, McHenry County, Illinois; and
WHEREAS, said real estate is not located within any other municipality, is
uninhabited, and contiguous to the existing corporate limits of the City of McHenry; and
WHEREAS, said real estate in not part of any public library district and will not be
disconnected from any fire protection district and therefore notice is not required to be
given to those legal entities as designated in the statutes; and
WHEREAS, notice regarding the annexation of said real estate was sent by
certified mail to the McHenry Township Highway Commissioner, Supervisor, and Board
of Trustees; and
WHEREAS, it is in the best interests of the City of McHenry that said real estate
be annexed pursuant to 65 ILCS 517-1-9.
WHEREAS, upon annexation, said real estate will received a zoning classification
of E, Estate District, pursuant to Article III, Section D, of the Zoning Ordinance of the
City of McHenry.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: The real estate depicted on Exhibit A, attached hereto and made a
part hereof, be and the same is hereby annexed to, and made a part of the corporate
limits of the City of McHenry, McHenry County, Illinois, including all adjoining roads or
highways as required by law.
Section 2: The City Clerk is hereby directed to cause a certified copy of this
Ordinance, together with said Exhibit A, to be recorded in the Office of the Recorder of
Deeds, McHenry County, Illinois. Following the recordation of this Ordinance and
Exhibit A, a certified copy thereof shall be filed in the Office of the County Clerk of
McHenry County, Illinois.
Section 3: This Ordinance shall be published in pamphlet form by and under
the authority of the corporate authorities of the City of McHenry, McHenry County,
Illinois.
Section 4: This Ordinance shall be in full force and effect from and after its
passage, approval, and publication in pamphlet form as provided by law.
