HomeMy WebLinkAboutOrdinances - O-98-883 - 08/12/1998 - GRANT ZONING MAP AMENDMENT ADAMS COMMERCIAL CENTERORDINANCE NO. 0-98-883 AN ORDINANCE PROVIDING FOR THE ZONING MAP AMENDMENT OF CERTAIN REAL ESTATE IN THE CITY OF McHENRY, ILLINOIS WHEREAS, your Petitioners, RICHARD A. ADAMS and RITA A. ADAMS, the record title holders, have filed a Petition with the Zoning Board of Appeals of the City of McHenry requesting an amendment of the Zoning Ordinance and Zoning Map of McHenry County, and of such Ordinance and Map as amended, in regard to certain real estate legally described hereinafter (the "Premises"). WHEREAS, Premises is located on the north side of Illinois State Route 120, at the intersection of Adams Road in City of McHenry, McHenry County, Illinois. WHEREAS, the Petition requests a zoning map amendment upon annexation of Premises to "C- 5" - Highway Commercial District and "BP" - Business park District under the terms of the City of McHenry Zoning Ordinance; WHEREAS, a public hearing on said Petition was held before the Zoning Board of Appeals of the City of McHenry in the manner and in the form as prescribed by Ordinance and Statute; WHEREAS, as a result of said hearing, the taking of evidence, and the viewing of exhibits advanced thereat, the Zoning Board of Appeals of the City of McHenry did unanimously recommend the granting of the requested zoning classification; WHEREAS, the Mayor and City Council of the City of McHenry have considered the recommendations as submitted by the Zoning Board of Appeals of the City of McHenry; and WHEREAS, the Mayor and City Council of the City of McHenry have determined that the standards for reclassification set forth in the McHenry Zoning Ordinance and the Illinois Compiled Statutes have been met. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of McHenry, McHenry County, Illinois as follows: SECTION 1: That the Zoning Ordinance and the Zoning Maps of the City of McHenry, Illinois, be and the same are hereby amended to reclassify the zoning district of Premises as follows: To the "C5" - Highway Commercial District: PARCELI: That part of the Southeast Quarter of the Southwest Quarter of Section 25, Township 45 North, Range 8, East of the Third Principal Meridian, described as follows: Commencing at the Southeast corner of said Quarter Quarter Section; thence North 0° 49' 46" West, 345.87 feet along the East line of said Quarter Quarter Section; thence South 88" 32' 18" West, 327.12 feet to the West right-of-way line of Adams Drive for the Point of beginning; thence continuing South 88' 32' 18" West 534.63 feet to a point of curvature; thence Northwesterly along a curve to the right having a radius of 180.00 feet, for an arc distance of 100.20 feet, (said curve having a chord bearing of North 75' 30' 52" West, and a chord distance of 98.91 feet); thence North 00 49' 45" West, 42.03 feet; thence Northeasterly, along a non -tangential curve having a radius of 50.00 feet, said curve being convexed to the South for an arc distance of 8.47 feet, (said curve having a chord bearing of North 790 26' 07" East, and a chord distance of 8.46 feet) to a point of reverse curvature; thence continuing Northeasterly, along a curve to the left having a radius of 750.00 feet, for an arc distance of 209.37 feet, (said curve having a chord bearing of North 760 17" 23" East, and a chord distance of 208.69 feet) to a point of tangency; thence North 680 17' 33" East, 160.48 feet to a point of curvature; thence Northeasterly, along a curve to the right having a radius of 700.00 feet, for an arc distance of 248.66 feet, (said curve having a chord bearing of North 78° 28' 09" East, and a chord distance of 247.36 feet) to a point of compound curvature; thence Southeasterly along a curve to the right having a radius of 25.00 feet, for an arc distance of 39.50 feet, (said curve having a chord bearing of South 46°05' 30" East, and a chord distance of 35.52 feet) to a point of tangency; thence South 0° 49' 45" East, 188.33 feet along said West right-of- way line of Adams Drive to the Point of Beginning. All containing 2.1281 acres, more or less, in the City of McHenry, in McHenry County, Illinois; and PARCEL 2: That part of the South Half of Section 25, Township 45 North, Range 8, East of the Third Principal Meridian, described as follows: commencing at a point on the West line of Eastwood Manor Unit #4, according to the Plat thereof recorded October 19, 1960, as Document #376558 in Book 14 of Plats, page 63, in McHenry County, Illinois, where it intersects the North line of the Southwest Quarter of the Southeast Quarter of said Section 25; thence South 0° 49' 45" East, 178.90 feet along the West line of said Eastwood Manor Unit #4 to the Point of Beginning; thence continuing South 0° 49' 45" East, 410.94 feet along said West line; thence South 890 10' 15" West, 348.27 feet; thence Southwesterly, along a non -tangential curve having a radius of 180.00 feet, as said curve is convexed to the Southeast for an arc distance of 77.13 feet, (said curve having a chord bearing of South 590 55' 12" West, and a chord distance of 76.54 feet) to a point of reverse curvature; thence continuing Southwesterly along a curve to the left having a radius of 120.00 feet, for an arc distance of 150.77 feet, (said curve having a chord bearing of South 360 12' 09" West, and a chord distance of 141.05 feet) to a point; thence Northeasterly along a non - tangential curve having a radius of 184.00 feet, as said curve is convexed to the Northwest for an arc distance of 176.10 feet; (said curve having a chord bearing of North 260 35' 15" East, and a chord distance of 169.45 feet) to a point of reverse curvature; thence continuing Northeasterly along a curve to the left having a radius of 300 feet, for an arc distance of 287.12 feet, (said curve having a chord bearing of North 26035' 20" East, and a chord distance of 276.29 feet) to a point of tangency; thence North 00 49' 45" West, 165.27 feet; thence North 89' 10' 15" East, 294.75 feet to the Point of Beginning. All containing 3.0818 acres, more or less, in the City of McHenry, in McHenry County, Illinois. To the "BP" - Business Park District: PARCEL 3: That part of the Southeast Quarter of the Southwest Quarter of Section 25, Township 45 North, Range 8, East of the Third Principal Meridian, described as follows: Commencing at the Southeast corner of said Quarter Quarter Section; thence North 01' 49' 46" West, 345.87 feet along the East line of said Quarter Quarter Section; thence South 88' 32' 18" West, 861.75 feet to a point of curvature; thence Northwesterly along a curve to the right having a radius of 180.00 feet for an arc distance of 100.20 feet, (said curve having a chord bearing of North 75°30"52" West, and a chord distance of 98.91 feet) to the Point of Beginning; thence South 0° 49' 45" East, 282.22 feet; thence North 76' 30" 50" West, 231.26 feet; thence North 39° 07' 53" East, 314.34 feet; thence Southeasterly, along a non -tangential curve having a radius of 180.00 feet, as said curve is convexed to the Southwest for an are distance of 27.33 feet, (said curve having a chord bearing of South 550 13' 04" East, and a chord distance of 27.30 feet) to the Point of Beginning. All containing 0.8239 acres, more or less, in the City of McHenry, in McHenry County, Illinois. The zoning districts herein referred to are depicted in Exhibit "A", attached hereto and made a part hereof. SECTION 2: In granting said Zoning Map Amendment, the City Council finds that the requirements of Table 33 of the Zoning Ordinance have been met in that: 1. The requested zoning classification is compatible with the existing uses and zoning of property in the environs; 2. The requested zoning classification is supported by the trend of development in the general area; 3. The requested zoning classification is consistent with the objectives of the City of McHenry Comprehensive Plan; and 4. The requested classification promotes the public interest. SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions hereof are hereby repealed to the extent of such conflict. SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 5: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law. PASSED this 12th day of August , 1998.
