ANNEXATION OF CERTAIN DESCRIBED REAL
ESTATE TO THE CITY OF MCHENRY, MCHENRY
COUNTY, ILLINOIS.
WHEREAS, RICHARD A. ADAMS and RITA A. ADAMS, are the record owners of the
real estate hereinafter described; and
WHEREAS, no electors reside on said real estate; and
WHEREAS, said real estate is contiguous to the existing corporate limits of the City of
McHenry, Illinois, and is not located within any other municipality and the aforesaid record owners
desire annexation of said real estate and have petitioned the corporate authorities of the City of
McHenry, Illinois, in writing and under oath, for annexation of said real estate; and
WHEREAS, said real estate is not a part of any public library district and will not be
disconnected from any fire protection district and therefore statutory notice is not required to be
given to those legal entities designated in the statutes; and
WHEREAS, said real estate abuts on a township road, namely Lincoln Road, and notice has
been provided to the McHenry Township officials pursuant to statute; and
WHEREAS, the Corporate Authorities for and on behalf of the City of McHenry, McHenry
County, Illinois, have heretofore approved an Annexation Agreement, bearing the date of
August 12 , 1998, between itself and RICHARD A. ADAMS and RITA A. ADAMS,
which provides for the annexation of said real estate to the existing corporate limits of the City of
McHenry, McHenry County, Illinois, and for the classification of said real estate under the
provisions of the City of McHenry Zoning Ordinance;
WHEREAS, upon proper notice, public hearings were held pursuant to State statute and the
appropriate provisions of the Zoning Ordinance of the City of McHenry relative to the Petitioners'
request.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF MC HENRY, MC HENRY COUNTY, ILLINOIS, as follows:
SECTION 1: The following described real estate be and the same is hereby annexed to
and made a part of the corporate limits of the City of McHenry, Illinois, including any and all
portions of adjacent streets, roads, or highways as required by law:
The Northeast Quarter of the Southwest Quarter of Section 25, Township 45 North, Range
8 East of the Third Principal Meridian (excepting therefrom that part of the North 801.33 feet
thereof which lies west of a line 747.75 feet west of and parallel with the East line of the
Northeast Quarter of the Southwest Quarter of said Section 25 and Except the East 357.77
feet of the North 435.60 feet thereof and except the South 660 feet of the North 1095.60 feet
of the East 421.08 feet thereof and except the West 230.00 feet of the East 747.75 feet of the
North 238.70 feet thereof) in McHenry County, Illinois.
Also, the West 3 chains and 62 links (238.92 feet) of the Northwest Quarter of the Southeast
Quarter (except the North 1095.60 feet thereof) of Section 25, Township 45 North, Range
8 East of the Third Principal Meridian, in McHenry County, Illinois.
Also, that part of the Southeast Quarter of the Northwest Quarter of Section 25, Township
45 North, Range 8 East of the Third Principal Meridian, being the right of way of Lincoln
Road lying North of and adjacent to the above described property, in McHenry County,
Illinois.
Hereinafter referred to as "Premises".
That a Plat of Annexation of said real estate is attached hereto and made a part hereof as
Exhibit "A".
SECTION 2: The City Clerk is hereby directed to cause a certified copy of this
Ordinance together with said Plat of Annexation to be recorded in the Office of the Recorder of
Deeds, McHenry County, Illinois. Following the recordation of this Ordinance and said Plat of
Annexation of the real estate above described and annexed, a copy thereof shall be filed in the Office
of the Clerk of McHenry County, Illinois.
SECTION 3: All Ordinances, or parts thereof, in conflict with the terms and
provisions hereof, be and the same are hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its
passage, approval and publication as provided by law.
