Alth ff, City C r .. ,� of the City of McHenry, I 1 nois it 98-58-1660 AN ORDINANCE PROVIDING FOR THE REZONING AND ISSUANCE OF A CONDITIONAL USE PERMIT FOR CERTAIN DESCRIBED REAL ESTATE IN THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS WHEREAS, petitioners, MIDWEST TRUST SERVICES, INC. under Trust Agreement dated February 4, 1993, Trust #93-6442, an Illinois Banking Corporation, record title owner, filed a Petition, as amended, with the Zoning Board of Appeals of the City of McHenry, Illinois, requesting an amendment to the Zoning Ordinance of the city of McHenry and issuance of a conditional use permit allowing a drive -through banking facility in regard to the real property more fully described in Exhibit "A", attached hereto and made a part hereof (said real property hereinafter referred to as "Parcel'); and WHEREAS, pursuant to notice, a public hearing was held before the Zoning Board of Appeals of the City of McHenry, Illinois, in regard to the contents of the Petition, as amended, and evidence was introduced by the Petitioners at such hearing in support of their position; and WHEREAS, the City Council of the City of McHenry, Illinois, has fully considered the merits of the Petition, as amended, and the evidence presented to the Zoning Board of Appeals of the City of McHenry, including all exhibits containing plans and specifications for the proposed use. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: That the Zoning Ordinance of the City of McHenry, McHenry County, Illinois, and such Ordinance as amended, be and is hereby amended so that the 98-58-1661 Parcel is classified as C-2 Neighborhood Commercial District and the issuance of a conditional use permit allowing the property to be developed with a drive -through banking facility subject to the following conditions: A. Only one access point shall be permitted, and it shall be located at the east property line. B. Permitted ground sign for the site shall be located near the east property line. C. The circulation pattern for the drive -through shall direct traffic at the site away from the residential property to the north. D. The required landscaping and berming along the north property line shall be installed in accordance with City ordinances. E. The building shall be set back a minimum of 120 feet from the front property line. SECTION 2: The requirements of Table 33 of the McHenry Zoning Ordinance have been met in that: A. The requested zoning is compatible with the uses and zoning of the environs. B. The requested zoning is supported by the trend of development. C. The requested zoning is consistent with the City of McHenry Comprehensive Plan objectives. D. The requested zoning furthers the public interest. SECTION 3: The requirements of Table 31 of the McHenry Zoning Ordinance having been met in that: A. No adverse impact of types or lines of traffic flow are otherwise typical of the zoning district will occur. B. No adverse affects of noise, glare, odor, dust, waste disposal, blockage of light or air or other adverse problems or affects of the type and degree not characteristic of permitted uses of the zoning district will occur. C. The proposed use will fit harmoniously with the existing natural and man- made character of the surroundings of the permitted uses of the zoning district in general. These will not have any undue negative effect on the area, environmental quality, property values or neighborhood character since it is consistent with the permitted uses in the district. D. The proposed use will not require the existing community facilities or services to a degree disproportionate to that normally expected permitted 98-58-1662 uses in this district, nor will it generate a disproportionate demand for new services or facilities. E. The proposed conditional use will not be detrimental to the safety or health of the employees, patrons, or visitors associated with the use for the general public. F. The proposed use is in -harmony with all other elements pertinent in the conditional use of this particular location. SECTION 4: All ordinances, or parts thereof, in conflict with the terms and provisions hereof, be and the same are hereby repealed to the extent of such conflict. SECTION 5: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 6: This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. PASSED THIS 18th DAY OF February , 1998.
