I, Pamela J. Althoff, City Clerk in and for the City of
McHenry, Illinois, and keeper of the official records, files, and
seal thereof, do hereby certify that the attached document is a
true and correct copy of Ordinance No. 0-98-863, providing for the
amendment to the Zoning Ordinance of the City of McHenry by
granting a reclassifcation to C-2 Neighborhood Commercial District
and granting a Conditional Use Permit for a drive -through banking
facility for the Midwest Bank of McHenry County property located
along Bull Valley Road, just west of its intersection with Crystal
Lake Road, McHenry, Illinois, passed by the City Council of the
City of McHenry, Illinois, at a regular meeting of said Council
held on the 18th day of February, 1998, and the same was signed and
approved by the Mayor of said City on the 18th day of February,
1998.

AN ORDINANCE PROVIDING FOR THE REZONING AND ISSUANCE
OF A CONDITIONAL USE PERMIT FOR CERTAIN DESCRIBED
REAL ESTATE IN THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS
WHEREAS, petitioners, MIDWEST TRUST SERVICES, INC. under Trust
Agreement dated February 4, 1993, Trust #93-6442, an Illinois Banking Corporation,
record title owner, filed a Petition, as amended, with the Zoning Board of Appeals of the
City of McHenry, Illinois, requesting an amendment to the Zoning Ordinance of the city
of McHenry and issuance of a conditional use permit allowing a drive -through banking
facility in regard to the real property more fully described in Exhibit "A", attached hereto
and made a part hereof (said real property hereinafter referred to as "Parcel'); and
WHEREAS, pursuant to notice, a public hearing was held before the Zoning
Board of Appeals of the City of McHenry, Illinois, in regard to the contents of the
Petition, as amended, and evidence was introduced by the Petitioners at such hearing in
support of their position; and
WHEREAS, the City Council of the City of McHenry, Illinois, has fully
considered the merits of the Petition, as amended, and the evidence presented to the
Zoning Board of Appeals of the City of McHenry, including all exhibits containing plans
and specifications for the proposed use.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS
FOLLOWS:
SECTION 1: That the Zoning Ordinance of the City of McHenry, McHenry
County, Illinois, and such Ordinance as amended, be and is hereby amended so that the

Parcel is classified as C-2 Neighborhood Commercial District and the issuance of a
conditional use permit allowing the property to be developed with a drive -through
banking facility subject to the following conditions:
A. Only one access point shall be permitted, and it shall be located at the east
property line.
B. Permitted ground sign for the site shall be located near the east property
line.
C. The circulation pattern for the drive -through shall direct traffic at the site
away from the residential property to the north.
D. The required landscaping and berming along the north property line shall
be installed in accordance with City ordinances.
E. The building shall be set back a minimum of 120 feet from the front
property line.
SECTION 2: The requirements of Table 33 of the McHenry Zoning Ordinance
have been met in that:
A. The requested zoning is compatible with the uses and zoning of the
environs.
B. The requested zoning is supported by the trend of development.
C. The requested zoning is consistent with the City of McHenry
Comprehensive Plan objectives.
D. The requested zoning furthers the public interest.
SECTION 3: The requirements of Table 31 of the McHenry Zoning Ordinance
having been met in that:
A. No adverse impact of types or lines of traffic flow are otherwise typical of
the zoning district will occur.
B. No adverse affects of noise, glare, odor, dust, waste disposal, blockage of
light or air or other adverse problems or affects of the type and degree not
characteristic of permitted uses of the zoning district will occur.
C. The proposed use will fit harmoniously with the existing natural and man-
made character of the surroundings of the permitted uses of the zoning
district in general. These will not have any undue negative effect on the
area, environmental quality, property values or neighborhood character
since it is consistent with the permitted uses in the district.
D. The proposed use will not require the existing community facilities or
services to a degree disproportionate to that normally expected permitted

uses in this district, nor will it generate a disproportionate demand for new
services or facilities.
E. The proposed conditional use will not be detrimental to the safety or
health of the employees, patrons, or visitors associated with the use for the
general public.
F. The proposed use is in -harmony with all other elements pertinent in the
conditional use of this particular location.
SECTION 4: All ordinances, or parts thereof, in conflict with the terms and
provisions hereof, be and the same are hereby repealed to the extent of such conflict.
SECTION 5: This Ordinance shall be published in pamphlet form by and under
the authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 6: This Ordinance shall be in full force and effect from and after its
passage, approval and publication as provided by law.

That part of the Northwest Quarter of the Southeast Quarter of Section 4, Township 44
North, Range 8, East of the Third Principal Meridian, described as follows: Commencing
at the Northwest corner of said Northwest Quarter of the Southeast Quarter; thence North
88 degrees 56 minutes 54 seconds assumed bearing, along the north line thereof, a
distance of 234.20 feet; thence South 10 degrees 17 minutes 25 seconds West, a distance
of 59.32 feet to a point for the place of beginning, said point also being on the south
right-of-way line of Bull Valley Road; thence South 10 degrees 17 minutes 25 seconds
West, a distance of 199.58 feet to a point; thence South 0 degrees 50 minutes 23 seconds
East, a distance of 378.86 feet to a point; thence North 88 degrees 56 minutes 54 seconds
East and parallel to said North line, a distance of 148.53 feet to a point; thence North 16
degrees 21 minutes 35 seconds East, a distance of 584.91 feet to a point on the south
right-of-way line of Bull Valley Road, said point being on a curve concave Southerly
having a radius of 1382.40 feet; thence Westerly on said curve, a distance of 156.42 feet
chord measurement and bearing North 87 degrees 28 minutes 38 seconds West to a
point; thence North 88 degrees 02 minutes 04 seconds West on said south right-of-way
line, a distance of 126.97 feet to the place of beginning, in McHenry County, Illinois.
