I, Pamela J. Althoff, City Clerk in and for the City of
McHenry, Illinois, and keeper of the official records, files, and
seal thereof, do hereby certify that the attached document is a
true and correct copy of Ordinance No. 0-98-862, Providing for the
Annexation of the Midwest Bank of McHenry County property located
on the south side of Bull Valley Road, just west of its
intersection with Crystal Lake Road, McHenry, Illinois, passed by
the City Council of the City of McHenry, Illinois, at a regular
meeting of said Council held on the 16th day of February, 1998, and
the same was signed and approved by the Mayor of said City on the
18th day of February, 1998.

ORDINANCE NO. 0-98-862
AN ORDINANCE PROVIDING FOR THE
ANNEXATION OF CERTAIN DESCRIBED REAL
ESTATE TO THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS
WHEREAS, MIDWEST TRUST SERVICES, INC. under Trust Agreement dated
February 4, 1993, Trust #93-6442, an Illinois Banking Corporation, is the record owner
of the real estate hereinafter described; and
WHEREAS, no electors reside on said real estate; and
WHEREAS, said real estate is contiguous to the existing corporate limits of the
City of McHenry, Illinois, and is not located within any other municipality and the
aforesaid record owner desires annexation of the said real estate and have petitioned the
corporate authorities of the City of McHenry, Illinois, in writing and under oath, for
annexation of said real estate; and
WHEREAS, said real estate is not a part of any public library district and will not
be disconnected from any fire protection district and therefore statutory notice is not
required to be given to those legal entities designated in the statutes; and
WHEREAS, the Corporate Authorities for and on behalf of the City of McHenry,
McHenry County, Illinois, have heretofore approved an Annexation Agreement, as
amended, bearing the date of a CUUrov 1998, between itself and
MIDWEST TRUST SERVICES, INC., under Trust Agreement dated February 4, 1993,
Trust #93-6442, an Illinois Banking corporation, which provides for the annexation of
said real estate to the existing corporate limits of the City of McHenry, McHenry County,
Illinois, for the classification of said real estate under the provisions of the City of
McHenry Zoning Ordinance;

WHEREAS, upon proper notice, public hearings were held pursuant to State
statute and the appropriate provisions of the Zoning Ordinance of the City of McHenry
relative to the Petitioners' request.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, as
follows:
SECTION 1: The following described real estate be and the same is hereby
annexed to and made part of the corporate limits of the City of McHenry, Illinois,
including any and all portions of adjacent streets, roads, or highways as required by law:
That part of the Northwest Quarter of the Southeast Quarter of Section 4, Township 44
North, Range 8, East of the Third Principal Meridian, described as follows: Commencing
at the Northwest corner of said Northwest Quarter of the Southeast Quarter; thence North
88 degrees 56 minutes 54 seconds assumed bearing, along the north line thereof, a
distance of 234.20 feet; thence South 10 degrees 17 minutes 25 seconds West, a distance
of 59.32 feet to a point for the place of beginning, said point also being on the south
right-of-way line of Bull Valley Road; thence South 10 degrees 17 minutes 25 seconds
West, a distance of 199.58 feet to a point; thence South 0 degrees 50 minutes 23 seconds
East, a distance of 378.86 feet to a point; thence North 88 degrees 56 minutes 54 seconds
East and parallel to said North line, a distance of 148.53 feet to a point; thence North 16
degrees 21 minutes 35 seconds East, a distance of 584.91 feet to a point on the south
right-of-way line of Bull Valley Road, said point being on a curve concave Southerly
having a radius of 1382.40 feet; thence Westerly on said curve, a distance of 156.42 feet
chord measurement and bearing North 87 degrees 28 minutes 38 seconds West to a
point; thence North 88 degrees 02 minutes 04 seconds West on said south right-of-way
line, a distance of 126.97 feet to the place of beginning, in McHenry County, Illinois.

That a Plat of Annexation of said real estate is attached hereto and made a part
hereof as Exhibit "A".
SECTION 2: The City Clerk is hereby directed to cause a certified copy of this
Ordinance, together with said Plat of Annexation to be recorded in the Office of the
Recorder of Deeds, McHenry County, Illinois. Following the recordation of this

Ordinance and said Plat of Annexation of the real estate above described and annexed, a
copy thereof shall be filed in the Office of the Clerk of McHenry County, Illinois.
SECTION 3: All Ordinances, or parts thereof, in conflict with the terms and
provisions hereof, be and the same are hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under
the authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its
passage, approval and publication as provided by law.
