AN ORDINANCE PROVIDING FOR THE ZONING
CLASSIFICATION UPON ANNEXATION
OF CERTAIN REAL ESTATE IN THE CITY OF McHENRY, ILLINOIS
WHEREAS, your Petitioners, RICHARD A. ADAMS and RITA A. ADAMS, the record title
holders, have filed a Petition with the Zoning Board of Appeals of the City of McHenry requesting an
amendment of the Zoning Ordinance and Zoning Map of McHenry County, and of such Ordinance and
Map as amended, in regard to the real estate legally described as follows:
The Northeast Quarter of the Southwest Quarter of Section 25, Township 45 North, Range
8 East of the Third Principal Meridian (excepting therefrom that part of the North 801.33 feet
thereof which lies west of a line 747.75 feet west of and parallel with the East line of the
Northeast Quarter of the Southwest Quarter of said Section 25 and Except the East 357.77 feet
of the North 435.60 feet thereof and except the South 660 feet of the North 1095.60 feet of
the East 421.08 feet thereof and except the West 230.00 feet of the East 747.75 feet of the
North 238.70 feet thereof) in McHenry County, Illinois.
Also, the West 3 chains and 62 links (238.92 feet) of the Northwest Quarter of the Southeast
Quarter (except the North 1095.60 feet thereof) of Section 25, Township 45 North, Range 8
East of the Third Principal Meridian, in McHenry County, Illinois.
Also, that part of the Southeast Quarter of the Northwest Quarter of Section 25, Township 45
North, Range 8 East of the Third Principal Meridian, being the right of way of Lincoln Road
lying North of and adjacent to the above described property, in McHenry County, Illinois.
Hereinafter referred to as "Premises".
WHEREAS, Premises is located on the north side of Illinois State Route 120, and south of
Lincoln Road in McHenry Township, McHenry County, Illinois.
WHEREAS, the Petition requests a zoning map amendment upon annexation of Premises to
"BP" - Business Park District and "E" - Estate District under the terms of the City of McHenry Zoning
Ordinance;
WHEREAS, a public hearing on said Petition was held before the Zoning Board of Appeals of
the City of McHenry in the manner and in the form as prescribed by Ordinance and Statute;
WHEREAS, as a result of said hearing, the taking of evidence, and the viewing of exhibits
advanced thereat, the Zoning Board of Appeals of the City of McHenry did unanimously recommend the
granting of the requested zoning classification;
WHEREAS, the Mayor and City Council of the City of McHenry have considered the
recommendations as submitted by the Zoning Board of Appeals of the City of McHenry; and
WHEREAS, the Mayor and City Council of the City of McHenry have determined that the
standards for reclassification set forth in the McHenry Zoning Ordinance and the Illinois Compiled
Statutes have been met.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of
McHenry, McHenry County, Illinois as follows:
SECTION 1: That the Zoning Ordinance and the Zoning Maps of the City of McHenry, Illinois, be and
the same are hereby amended to reclassify the zoning district of Premises as follows:
To the "B" - Estate District:
THE NORTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 25,
TOWNSHIP 45 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN
(EXCEPTING THEREFROM THAT PART OF THE NORTH 801.33 FEET THEREOF WHICH
LIES WEST OF A LINE 747.75 FEET WEST OF AND PARALLEL WITH THE EAST LINE
OF THE NORTHEAST QUARTER OF THE SOUTHWEST QUARTER OF SAID SECTION
25 AND EXCEPT THE EAST 357.77 FEET OF THE NORTH 435.60 FEET THEREOF AND
EXCEPT THE SOUTH 660 FEET OF THE NORTH 1095.60 FEET OF THE EAST 421.08
FEET THEREOF AND EXCEPT THE WEST 230.00 FEET OF THE EAST 747.75 FEET OF
THE NORTH 238.70 FEET THEREOF AND EXCEPT THAT PART OF SAID NORTHEAST
QUARTER OF THE SOUTHWEST QUARTER OF SECTION 25 DESCRIBED AS
FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF SAID NORTHEAST
QUARTER OF THE SOUTHWEST QUARTER; THENCE SOUTH 88° 32' 18" WEST ALONG
THE SOUTH LINE OF SAID NORTHEAST QUARTER OF THE SOUTHWEST QUARTER,
579.05 FEET; THENCE NORTH 11* 59' 39" EAST, 238.55 FEET; THENCE NORTH 88143'
21" EAST, 526.08 FEET TO A POINT ON THE EAST LINE OF SAID NORTHEAST
QUARTER OF THE SOUTHWEST QUARTER; THENCE SOUTH 0° 49' 45" E. EAST
ALONG SAID EAST LINE, 229.67 FEET TO THE PLACE OF BEGINNING). ALL
CONTAINING 15.7216 ACRES, MORE OR LESS, IN McHENRY COUNTY, ILLINOIS.
To the `BP" - Business Park District:
THE WEST 3 CHAINS AND 62 LINKS (238.92 FEET) OF THE NORTHWEST QUARTER
OF THE SOUTHEAST QUARTER (EXCEPT THE NORTH 1095.60 FEET THEREOF) OF
SECTION 25, TOWNSHIP 45 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL
MERIDIAN, IN McHENRY COUNTY, ILLINOIS, ALSO: THAT PART OF THE
SOUTHEAST QUARTER OF THE NORTHWEST QUARTER OF SECTION 25, TOWNSHIP
45 NORTH, RANGE 8 EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS
FOLLOWS: BEGINNING AT THE SOUTHEAST CORNER OF SAID NORTHEAST
QUARTER OF THE SOUTHWEST QUARTER; THENCE SOUTH 880 32' 18" WEST ALONG
THE SOUTH LINE OF SAID NORTHEAST QUARTER OF THE SOUTHWEST QUARTER,
579.05 FEET; THENCE NORTH 11 ° 59' 39" EAST, 238.55 FEET; THENCE NORTH 88" 43'
21" EAST, 526.08 FEET TO A POINT ON THE EAST LINE OF SAID NORTHEAST

CONTAINING 4.1943 ACRES, MORE OR LESS, IN McHENRY COUNTY, ILLINOIS
The zoning districts herein referred to are depicted on Exhibit "A", attached hereto and made a part
hereof.
SECTION 2: In granting said Zoning Map Amendment, the City Council finds that the
requirements of Table 33 of the Zoning Ordinance have been met in that:
1. The requested zoning classification is compatible with the existing uses and zoning of
property in the environs;
2. The requested zoning classification is supported by the trend of development in the
general area;
3. The requested zoning classification is consistent with the objectives of the City of
McHenry Comprehensive Plan; and
4. The requested classification promotes the public interest.
SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions hereof
are hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority
of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its passage,
approval, and publication in pamphlet form as provided by law.
