AN ORDINANCE. PROVIDING FOR THE
ANNEXATION OF CERTAIN DESCRIBED REAL
ESTATE TO THE CITY OF MC HENRY, MC HENRY
COUNTY, ILLINOIS.
WHEREAS, KEVIN G. WEGRZYN and BEVERLY S. WEGRZYN are the record owners
of the real estate hereinafter described; and
WHEREAS, no electors reside on said real estate; and
WHEREAS, said real estate is contiguous to the existing corporate limits of the City of
McHenry, Illinois, and is not located within any other municipality and the aforesaid record owners
and contract purchaser desire annexation of said real estate and have petitioned the corporate
authorities of the City of McHenry, Illinois, in writing and under oath, for annexation of said real
estate; and
WHEREAS, said real estate is not a part of any public library district and will not be
disconnected from any fire protection district and therefore statutory notice is not required to be
given to those legal entities designated in the statutes; and
WHEREAS, the Corporate Authorities for and on behalf of the City of McHenry, McHenry
County, Illinois, have heretofore approved an Annexation Agreement, as amended, bearing the date
of November 6, 1997, between itself and KEVIN G. WEGRZYN and BEVERLY S. WEGRZYN,
which provides for the annexation of said real estate to the existing corporate limits of the City of
McHenry, McHenry County, Illinois, for the classification of said real estate under the provisions of
the City of McHenry Zoning Ordinance;
WHEREAS, upon proper notice, public hearings were held pursuant to State statute and the
appropriate provisions of the Zoning Ordinance of the City of McHenry relative to the Petitioners'
request.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF MC HENRY, MC HENRY COUNTY, ILLINOIS, as follows:
SECTION 1: The following described real estate be and the same is hereby annexed to
and made a part of the corporate limits of the City of McHenry, Illinois, including any and all
portions of adjacent streets, roads, or highways as required by law:
Lot 30 in Kelter Estate Subdivision Unit No. 1, being a Subdivision of part of Section 34,
Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat
thereof recorded March 14, 1949 as Document No. 218953, in Book 10 of Plats, Page 112,
in McHenry County, Illinois.
Permanent Parcel Index Number: 09-34-327-002. Hereinafter referred to as "Premises".
That a Plat of Annexation of said real estate is attached hereto and made a part hereof as
Exhibit "A".
SECTION 2: The City Clerk is hereby directed to cause a certified copy of this
Ordinance together with said Plat of Annexation to be recorded in the Office of the Recorder of
Deeds, McHenry County, Illinois. Following the recordation of this Ordinance and said Plat of
Annexation of the real estate above described and annexed, a copy thereof shall be filed in the Office
of the Clerk of McHenry County, Illinois.
SECTION 3: All Ordinances, or parts thereof, in conflict with the terms and
provisions hereof, be and the same are hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the city of McHenry, Illinois.
SECTION 5: This Ordinance shall be in full force and effect from and after its
passage, approval and publication as provided by law.
