HomeMy WebLinkAboutOrdinances - O-97-846 - 10/29/1997 - ANNEX BYKOWSKI PROPERTY ON HI POINT RDORDINANCE NO. 0-97-846 AN ORDINANCE ANNEXING CERTAIN DESCRIBED REAL ESTATE TO THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS WHEREAS, a written petition, signed under oath by all of the legal owners of record all land within the real estate hereinafter described, has been filed with the City Clerk of the City of McHenry, Illinois, requesting that said real estate be annexed to the City of McHenry; and WHEREAS, no electors reside on said real estate; and WHEREAS, said real estate is contiguous to the corporate limits of the City of McHenry, Illinois, and is not located within any other municipality; and WHEREAS, said real estate in not part of any public library district and will not be disconnected from any fire protection district and therefore notice is not required to be given to those legal entities as designated in the statutes; and WHEREAS, notice regarding the annexation of said real estate was sent by certified mail to the Nunda Township Highway Commissioner, Supervisor, and Board of Trustees; and WHEREAS, McHenry State Bank, as Trustee under Trust Agreement dated April 1, 1971, Trust No. 468, and Ronald M. Bykowski, as sole beneficiary of said Trust No. 468, have entered into a binding and valid Annexation Agreement relating to said real estate; and WHEREAS, it is in the best interests of the City of McHenry that said real estate be annexed. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: The following described real estate be and the same is hereby annexed to and made a part of the corporate limits of the City of McHenry, Illinois, including any and all portions of adjacent streets, roads or highways as required by law: Lot 3 in Hi -Point 31, being a subdivision of part of the North Half of the Southeast Quarter of Section 10, Township 44 North, Range 8 East of the Third Principal Meridian, according to the plat thereof recorded August 13, 1969 as Document No. 513184, in McHenry County, Illinois. PIN: 14-10-401-002 And That part of Hi -Point Road lying adjacent to Lot 3 in Hi -Point 31, described as follows: Beginning at the southeast corner of said Lot 3; thence westerly along the southerly line of said Lot 3, a distance of 80.13 feet, to a point of curve in the southerly lot line of said Lot 3; thence northwesterly along the southerly curved line of said Lot 3, being a curve to the right, having a radius of 35.0 feet, for an arc distance of 33.95 feet, to a point of reverse curve; thence northwesterly along a curve to the left, having a radius of 80.00 feet, for an arc distance of 77.61 feet to the southwest corner of said Lot 3; thence southerly along a radial line, a distance of 80.00 feet to the center of radius; thence southeasterly along a radial line to the curving southerly right of way line of said Hi -Point Road; thence northeasterly along the curving southerly line said Hi -Point Road, being a curve to the right having a radius of 35.00 feet to a point of tangency in said southerly right of way line; thence easterly along said southerly right of way line, to the intersection with the easterly line of said Lot 3, extended southerly; thence northerly along said extended easterly line, a distance of 60 feet to the point of beginning, said subdivision being a part of the north half of the southeast Quarter of Section 10, Township 44 North, Range 8 East of the Third Principal Meridian, according to the plat thereof recorded August 13, 1969 as Document No. 513184, in McHenry County, Illinois. A complete and accurate map of said real estate is attached to this Ordinance 'and incorporated herein by reference as EXHIBIT A. SECTION 2: The City Clerk of the City of McHenry is hereby directed to cause a certified copy of this Ordinance together with said map to be recorded in the Office of the Recorder of Deeds, McHenry County, Illinois. Following the recordation of this Ordinance and said map of the real estate above described and annexed, a copy thereof shall be filed in the Office of the Clerk of McHenry County, Illinois. SECTION 3: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, McHenry County, Illinois. SECTION 4: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED THIS 29TH DAY OF OCTOBER , 1997.
