AN ORDINANCE PROVIDING FOR A MAP AMENDMENT UNDER
THE PROVISIONS OF THE ZONING ORDINANCE OF
THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, Petitioners, Healthbridge Corporation, an Illinois not -for -profit corporation,
Northern Illinois Medical Center, an Illinois not -for -profit corporation, and NIMED Corp., an
Illinois not -for -profit corporation, filed a petition with the Zoning Board of Appeals of the City
of McHenry, requesting a map amendment under the provisions of the Zoning Ordinance of the
City of McHenry in regard to the approximately 106 acres of real property located at the
southwest corner of Bull Valley Road and State Route 31 in the City of McHenry, and
commonly known as the Northern Illinois Medical Center Campus, to the City's Health Care
("HC") Zoning District; and
WHEREAS, Northern Illinois Medical Center owns the approximately 12 acre parcel
attached hereto and incorporated herein as Exhibit A and hereinafter identified as the "NIMC
Parcel," which is currently designated in the 0-2 Zoning District on the map; and
WHEREAS, NIMED Corp. owns the approximately 87 acre parcel attached hereto and
incorporated herein as Exhibit B and hereinafter identified as the "NIMED Parcel," which is
currently designated 0-2 Zoning District on the map; and
WHEREAS, Healthbridge Corporation owns the approximately 7 acre parcel attached
hereto and incorporated herein as Exhibit C and hereinafter identified as the "Healthbridge
Parcel," which is currently designated in the C-5 Zoning District on the map; and
WHEREAS, pursuant to notice, a public hearing was held before the Zoning Board of
Appeals in regard to the contents of the Petition, and evidence was introduced by the Petitioners
at such hearing in support of their Petition; and
WHEREAS, the Zoning Board of Appeals voted 5 to 1 against approval of the requested
map amendment under the provisions of Table 33 of the City Zoning Ordinance; and
WHEREAS, the City Council, upon hearing the Petition, remanded the cause to the
Zoning Board of Appeals for that Board to review and comment upon the land uses proposed for
the NIMC, NIMED and Healthbridge Properties and the Land Use and Circulation plan proposed
by Petitioners; and
WHEREAS, on remand, the Zoning Board of Appeals voted unanimously in favor of the
land uses proposed by Petitioners and the Land Use and Circulation plan as revised by
Petitioners, subject to certain comments thereon by such Board; and
WHEREAS, the City Council has fully considered the merits of the Petition and the
evidence presented to the Zoning Board of Appeals, including all exhibits for the proposed map
amendment; and
WHEREAS, the City Council of the City of McHenry makes the following findings of
fact relative to the Petitioners' request for a map amendment for the Premises:
1. The proposed use(s) or the uses permitted under the proposed zoning
classification are compatible with existing uses or existing zoning of property in
the environs.
2. The trend of development in the general area since the original zoning of the
affected property was established supports the proposed use or zoning
classification.
3. The proposed use or zoning classification is in harmony with the objectives of the
Comprehensive Plan of the City as viewed in light of any changed conditions
since the adoption of the Plan.
4. The proposed use or zoning classification promotes the public interest and not
solely the interest of the applicant.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
Section 1: That a map amendment under the provisions of the Zoning Ordinance of
the City of McHenry and meeting the Approval Criteria of Table 33 is hereby granted to allow
(1) the reclassification of the NIMC Parcel from the 0-2 Zoning District to the HC Zoning
District; (2) the reclassification of the NIMED Parcel from the 0-2 Zoning District to the HC
Zoning District ; and (3) the reclassification of the Healthbridge Parcel from the C-5 Zoning
District to the HC Zoning District.
Section 2: The Circulation and Land Use Plan set forth as a requirement in the HC
Zoning District is attached hereto as Exhibit D and hereby approved.
Section All ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.
Section 4: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
Section This ordinance shall be in full force and effect from and after its passage
as provided by law.

In addition to the restrictions on location identified on the Circulation and Land Use
Plan, the classification of Primary, Secondary, Retail, and Conditional Uses and
Accessory Structures shall further control the establishment of these uses.
Primary Uses
Primary Uses are intended to be the main permitted uses in the Health Care District.

Secondary Uses
Secondary Uses are intended to support the Primary Uses and make certain services
available on the health care campus for the necessity and convenience of the
employees, patrons and residents of the campus. The Secondary Uses recognize that
certain types of institutional residential uses are desirable on a health care campus. A
Secondary Use, which may be attached to or detached from a Primary Use, is
permitted, but only if and to the extent that such Secondary Use is appropriate for and
related to the health care campus. The Zoning Administrator shall determine if a
proposed use is a permitted Secondary Use, subject to an appeal as provided in
Section XXVIII of the Zoning Ordinance.

Accessory Structures
Accessory Structures as defined herein, which are accessory to the permitted uses
hereunder, shall not exceed five percent (5%) of the floor area then occupied by the
Primary Uses and Secondary uses and for which building permits have been issued.
The floor area of any single Accessory Structure shall be no greater than 5,000 square
feet.

III. Landscaping Requirements
A landscape buffer consisting of a staggered row of Austrian Pines shall be installed
between the Health Care District Property and the Irish Prairie Condominiums within
one year of the approval of the Circulation and Land Use Plan. The design of the
landscape buffer shall be subject to the prior approval of the City.

IV. Minor Adjustments to Circulation and Land Use Plan
Where the boundary of a land use group is a roadway shown on the Plan,
movement of the roadway within the range permitted thereon shall adjust the
boundaries of the adjacent land use groups.
2. Upon the replacement of existing streets with new streets, the City shall vacate
those portions of the right-of-way necessary to effect the Circulation Plan.

V. Definitions
Assisted Living Facility. A residential facility within which residents with or without
minor physical disabilities live, cook, dine, and recreate, and are provided with
medical and other services or facilities.
2. Community or Recreation Center for Residents. An indoor facility used for and
providing social, cultural, and/or recreation programs designed to serve an
identified group of residents of a hospital, nursing home, specialized hospital
facility or similar facility.
3. Congregate Housing. Housing for senior citizens, the terminally or seriously ill or
disabled, and others with special needs, which provides a living arrangement of
self-contained units (each including a full kitchen and bath) that may integrate
shelter, food service, and other services for independent adults who do not require
24-hour oversight. Services may include meals, laundry, transportation,
housekeeping and medical services. Congregate Housing does not require a
state license.
4. Day Care Center, Adult. A facility which provides personal care, supervision,
protection, and programs to meet the needs of the adults serviced, who desire or
need shelter and care during a portion of a 24-hour period.
5. Group Home. A halfway house or similar non -hospital residential facility for senior
citizens, the terminally or seriously ill or disabled, and others with special needs,
housing more than three persons not related by blood, marriage, or adoption to
the owner who need psychological rehabilitation and who are provided 24-hour
professional supervision while on the premises.
6. Heliport. Heliport shall include helipads and helistops and shall mean an area on
land or upon a structure set aside and used for the landing and takeoff of rotary
wing aircraft, including hanger and refueling facilities.
7. Hospice. A facility which provides care for terminally ill patients.
8. Hospital. An institutional facility, public or private, for profit, or not, providing acute
care and overnight accommodations of short or longer duration for persons
suffering from illness, disease, injury, deformity, or other abnormal physical or
mental conditions; a "general' hospital treats a wide variety of such conditions and
may also include outpatient facilities, administrative office, physicians offices,
laboratories, training facilities and other uses accessory to that principal use; a
"specialized" hospital treats one or a few such conditions and may also include
uses accessory to the principal use.
9. Independent Living Facility. A facility which is designed as individual living units

with kitchens for self-sufficient elderly persons, but contains no provisions for
medical services or medical facilities.
10. Immediate or Long -Term Care Facility. A facility which is equipped to provide
medical care and programs to meet the needs of persons who are disabled,
infirmed, or of advanced age, in a residential setting, for as long as necessary.
11. Laboratory. A facility equipped for testing, analysis, scientific experimentation, or
observation of medical or biological nature.
12. Offices, Corporate Health Care. A building or place used by a corporation which
has oversight of a hospital or medical facility located within the same health care
campus.
13. Office, Medical, Dental and Optometry. A medical facility used for offices of one
or more physicians, dentists, optometrists, clinical psychologists, nurse -
practitioners, and similar medical professionals, for the examination and treatment
of patients, in which one or more medical professionals may be associated
together or practicing independently of each other. Medical offices may include
dental and medical laboratories, and/or x-ray facilities, but shall not include
inpatient facilities devoted primarily to major surgical procedures; nor shall they
provide beds or other accommodations for the overnight stay of patients.
14. Offices, Medical Support Services. A building or place used by businesses
providing support services to hospitals and medical personnel including, but not
limited to, home care services, hospital suppliers, health insurers and other uses.
15. Offices Non -Profit Organizations. A building or place used for offices of the non-
profit organization which provide medical services or medical support services.
16. Outpatient Diagnostic and Surgical Facilities. A building or place dedicated
primarily to medical diagnosis and treatments not requiring patients to remain in
the facility for an extended period of time.
17. Overnight Facilities. Sleep -in accommodations for relatives or guardians of
patients who require medical treatment in an associated general hospital for more
than 24 hours.
18. Parks and Recreation Facilities for Residents. A parcel or parcels of land
designed for outdoor activities in conjunction with a building, place or area which
is designed for indoor or outdoor activities such as organized sports, physical
exercise, games, relaxation, social interaction, and similar leisure pursuits,
designated primarily for use by residents of a hospital, nursing home, specialized
hospital facility, or residential area.

19. Park or Conservation Area. A parcel or parcels of land designed for outdoor
activities and maintained in a naturalistic state, or designated for planned
management to prevent exploitation, destruction, or neglect of the natural
resources contained therein.
20. Psychiatric Alcoholic and Narcotic Treatment Facility. A facility having programs
specifically designed to treat alcoholism, narcotic abuse and/or psychiatric
disorders.
21. Retirement Home. An establishment providing living accommodations and
services principally to non -transient residents who are retried from full-time work.
Accommodations provided may consist of dwelling units of any type or rooming
units, with common dining facilities.
22. Skilled Care Facility. An institution (or designated part of an institution) which
provides licensed, skilled nursing care and related services for senior citizens, the
terminally or seriously ill or disabled and others with special needs, who require
medical, nursing or rehabilitation services.
23. Specialized Hospital Facility. A building or place providing one or several isolated
types of medical treatment or care, but which does not provide the full range of
types of medical treatment or care available to a patient through the profession of
medicine. Specialized hospital facilities may be equipped for obstetric, surgical,
orthopedic, psychiatric, or skilled nursing care, or other types of medical
treatment.
24. Sports Medicine Facility. A building or place where the branch of medicine
dealing with injuries, ailments, or abnormal physical conditions caused by
participation in organized sports or similar physical activity is practiced.
