AN ORDINANCE APPROVING AN EXPANSION TO A CONDITIONAL USE
PERMIT FOR A QUICK OIL CHANGE SERVICE FACILITY LOCATED AT 5200
WEST ELM STREET, CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, a petition has been filed by McHenry Lube Express, 5200
West Elm Street, requesting an expansion to a Conditional Use Permit originally
granted by Ordinance 90-537; and
WHEREAS, Chapter XIV.G of the City of McHenry Zoning Ordinance
provides that the City Council may approve an expansion to an existing
Conditional Use Permit; and
WHEREAS, the City Council finds that the approval of this expansion is
consistent with the objectives of the City of McHenry Zoning Ordinance to
improve and protect the public health, safety, morals and general welfare of its
residents.
NOW, THEREFORE, BE IT ORDAINED BY CITY COUNCIL OF THE
CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, as follows:
SECTION 1: That the property legally described below be granted an
expansion to the Conditional Use Permit originally granted by Ordinance 90-537
to allow the construction of an additional service bay as shown on the site plan
drawn by J. Michael De Lapp & Associates, dated 2/10/97, appended to and
made a part of this Ordinance as Exhibit A.
LEGAL DESCRIPTION:
Lots 13 and 14 in Block 1 in Lakeland Park, Unit No. 3, a subdivision of
part of the East Half of the East Half of Section 28, Township 45 North,
Range 8 East of the Third Principal Meridian, according to the Plat thereof
recorded September 8, 1953 as Document No. 269384 in Book 11 of
Plats, page 90, in McHenry County, Illinois.
SECTION 2: That the approval of this expansion is subject to the
following conditions:
1. The building addition and any site modifications shall be in substantial
conformance with the site plan appended to and made a part of this
Ordinance as Exhibit A; and
2. The building materials used on the exterior of the addition shall be the
same as the building materials used on the original building; and
3. The uses shall be limited to those authorized by the Conditional Use
Permit originally granted by Ordinance 90-537.
SECTION 3: This Ordinance shall be published in pamphlet form by and
under the authority of the corporate authorities of the City of McHenry, McHenry
County, Illinois.
SECTION 4: This Ordinance shall be in full force and effect from and after
its passage, approval and publication in pamphlet form as provided by law.
