HomeMy WebLinkAboutOrdinances - O-96-810 - 12/04/1996 - ANNEX GLAVIANO PROPERTYORDINANCE NO. 0-96-810 An Ordinance Annexing Certain Property owned by NICKOLS GLAVIANO WHEREAS, NICKOLS GLAVIANO is the record title holder and sole elector of the real estate hereinafter described; and WHEREAS, no other electors reside on said real estate; and WHEREAS, ROSEMARY SWIERK is the contract purchaser of the real estate! hereinafter described; and WHEREAS, said real estate is contiguous to the existing corporate limits of the City of McHenry, Illinois and is not located within any other municipality and the aforesaid record title owner desires annexation of said real estate and had petitioned the corporate authorities of the City of McHenry, Illinois, in writing and under oath, for annexation of the real estate; and WHEREAS, the Corporate Authorities for and on behalf of the City of McHenry, McHenry County, Illinois, have heretofore approved an Annexation Agreement bearing the date of December 4 , 199 6 , between itself, NICKOLS GLAVIANO and ROSEMARY SWIERK, which provides in part for the annexation of said real estate to the existing corporate limits of the City of McHenry, McHenry County, Illinois, and for the classification of said real estate under the provisions of the City of McHenry Zoning Ordinance, a copy of which is attached hereto and incorporated herin as "Exhibit A'; and WHEREAS, upon proper notice, public hearings were held pursuant to State statute and the appropriate provisions of the Zoning Ordinance of the City of McHenry relative! to the Petitioners request. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, as follows: SECTION 1: That the following described property i§ hereby annexed to the City of McHenry, McHenry County, Illinois: THAT PART OF THE WEST HALF OF GOVERNMENT LOT #1 OF THE NORTHWEST QUARTER OF SECTION 2 TOWNSHIP 44 NORTH, RANGE 8 EAST OF THE: THIRD PRINCIPAL MERIDIAN DESCRIBED AS FOLLOWS: COMMENCING AT A POINT AT THE SOUTHEAST CORNER OF SAID WEST HALF OF GOVERNMENT LOT #1; THENCE NORTH 0 DEGREES 56' 00" EAST ALONG THE EAST LINE OF SAID WEST HALF OF GOVERNMENT LOT #1, 567.62 FEET TO THE POINT OF BEGINNING; THENCE NORTH 90 DEGREES 00'00" WEST ALONG A LINE PARALLEL WITH THE SOUTHERLY LINE OF SAID WEST HALF OF GOVERNMENT LOT #1, 440.06 FEET TO A POINT IN THE EAST RIGHT-OF-WAY LINE OF STATE ROUTE #31; THENCE NORTHERLY ALONG SAID EAST RIGHT-OF-WAY LINE (BEING ALONG A CURVE WITH A RADIUS OF 3859.83 FEET AS SAID CURVE IS CONVEXED TO THE EAST),4 CHORD DISTANCE: OF 38.32 FEET TO THE POINT OF TANGENCY; THENCE NORTH 0 DEGREES 38'00" WEST ALONG SAID EAST RIGHT-OF-WAY LINE 61.68 FEET; THENCE NORTH 90 DEGREES 00'00", 442.74 FEET TO THE EAST LINE OF THE WEST HALF OF SAID GOVERNMENT LOT #1; THENCE SOUTH 0 DEGREES 56'00" WEST ALONG SAID EAST LINE '100.00 FEET TO THE POINT OF BEGINNING. ALL CONTAINING 1.0132 ACRES, MORE OR LESS, IN McHENRY COUNTY, ILLINOIS. and commonly known as 414 South Route 31, McHenry County, McHenry, Illinois Said property, depicted on an accurate map which is appended and made a part of this Ordinance, consists of one (1) acre, more or less, and is contiguous to the City of McHenry. SECTION 2: That the Clerk of the City of McHenry is hereby directed to record in the Office of the Recorder and to file in the Office of the County Clerk of McHenry County, Illinois, within 30 days of the effective date of this Ordinance, a certified copy of this Ordinance, together with an accurate map of the property hereby annexed, said map is being attached hereto, made a part thereof and identified as Exhibit B. SECTION 3: This Ordinance shall be in full force and effect immediately after its passage and approval. SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be ajudged by any Court of competent juriisdication to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 5: All ordinance or parts of ordinance in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: This Ordinance shall be in full force and effect upon its passage, approval and publication as provided by law.
