HomeMy WebLinkAboutOrdinances - O-96-805 - 10/02/1996 - GRANT ZONING EDNA MAE JOHNSON PROPERTYORDINANCE NO. 0-96-•805 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF McHENRY, ILLINOIS WHEREAS, a written Petition signed by the City of McHenry has been filed with the City Clerk of the city of McHenry, Illinois requesting the following zoning changes: 1. Parcel A, a part of the former Edna Mae Johnson Property comprised of .56 acres, reclassified to RS2 Medium Density Single Family Residential District; 2. Parcel B, a part of the former Edna Mae Johnson Property comprised of .364 acres reclassified to RM1 Low Density Multi - Family Residential District; and 3. Parcel C, the remaining property of former Edna Mae Johnson Property comprised of 19.998 acres reclassified E-Estate Residential District, under the provisions of the Zoning Ordinance of the City of McHenry, as amended, for the property legally described on Exhibit A attached hereto; and, WHEREAS, a hearing was held before the City of McHenry Zoning Board of Appeals on September 9, 1996, at which time the Zoning Board. did take evidence and view exhibits presented thereat by the Petitioner; and, WHEREAS, based on evidence heard, the Zoning Board found that there was no overriding reason for not granting the reclassifications as requested; and, WHEREAS, the Zoning Board found, and the City Council concurs in that finding, that it would serve the interests of the City if said reclassifications were granted for the subject properties. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, Illinois, as follows: SECTION 1: That the following amendments to the City of McHenry Zoning Ordinance are hereby granted on the property commonly known as the former Edna Mae Johnson property, and legally described in Exhibit "A": A. Reclassification of Parcel A, a part of the former Edna Mae Johnson Property comprised of .56 acres, to RS2 Medium Density Single Family Residential District; B. Reclassification of Parcel B, a part of the former Edna Mae Johnson Property comprised of .365 acres, to RM1 Low Density Multi -Family Residential District; and City of McHenry -Busch -Knox Zoning Ordinance, Page 1 C. Reclassification of Parcel C, the remainder of the former Edna Mae Johnson Property comprised of 19.996 acres to E-Estate Residential District. SECTION 2: That the City Council finds in granting the reclassifications, the following findings have been proved: A. The proposed use or the uses permitted under the proposed zoning classifications are compatible with existing uses or existing zoning or property in the environs. B. The trend of development in the general area since the original zoning of the affected property was established supports the proposed use or zoning classification. C. The proposed use or zoning classifications are in harmony with the objectives of the Comprehensive Plan of the City as viewed in light of any changed conditions since the adoption of the Plan. D. The proposed use or zoning classifications promote the public interest and not solely the interest of the applicant. SECTION 3: All ordinances, or parts thereof, in conflict with the terms and provisions hereof, are hereby repealed to the extent of such conflict. SECTION 4: This Ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. SECTION 5: This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. PASSED this 2nd day of October, 1996. EQUAL AREA EAST OF MF1 (KNOX-BUSCH) That part of Section 2, Township 44 North, Range 8 East of the Third Principal Meridian, described as follows: commencing at the Northwest Corner of the Northeast Quarter of said Section 2 and running thence South 01 degrees 00 minutes 48 seconds East (bearing assumed), a distance of 1312.78 feet; thence North 89 degrees 49 minutes 04 seconds East, a distance of 1762.85 feet; thence South 01 degrees 29 minutes 22 seconds West, a distance of 672.10 feet, for the point of beginning; thence continuing South 01 degrees 29 minutes 22 seconds West, a distance of 210.00 feet; thence South 89 degrees 51 minutes 29 seconds East, a distance of 75.00 feet; thence North 01 degrees 29 minutes 22 seconds East, a distance of 210.00 feet; thence North 89 degrees 51 minutes 29 seconds West, a distance of 75.00 feet to the point of beginning, in McHenry County, Illinois. PARCEL C. That part of the East Half of Lot 1 of the Northeast Quarter of Section 2, Township 44 North, Range 8 East of the Third Principal Meridian, described as follows: beginning at the Northeast Corner of said Lot 1 of the Northeast Quarter and running thence South on the East line thereof for a distance of 987.36 feet to the Northeast Corner of a certain deed recorded in the Recorder's Office of McHenry County, Illinois, in Book 204 of Deeds, page 307; thence West on the North line of said Deed, so recorded, for a distance of 132.00 feet to the Northwest Corner thereof; thence South on the West line of said Deed for a distance of 53.20 feet to a point 281.08 feet North of the Southwest corner thereof; thence West parallel with the South line of the East Half of said Lot 1 for a distance of 260.00 feet to a point; thence South parallel with the East line of said East Half of Lot 1 for a distance of 281.08 feet to a point on the South line thereof; thence West on said South line for a distance of 170.50 feet to a point 740.00 feet East of the Southwest Corner thereof; thence North parallel with the West line of said East Half of Lot 1 for a distance of 330.00 feet to a point; thence West parallel with the South Line thereof for a distance of 291.05 feet to a point on a line drawn 448.95 feet East of and parallel with the West line thereof; thence North on the last mentioned parallel line for a distance of 982.09 feet to a point on the North line of Lot 1 of said Northeast Quarter of Section 2,; thence East 864.90 feet to the place of beginning, (excepting therefrom the North 16.50 feet thereof), in McHenry County, Illinois.
