HomeMy WebLinkAboutOrdinances - O-95-730 - 11/29/1995 - RECLASS MCH STATE BK TR 1313 PROPERTY DIPAK PATELORDINANCE NO. 0-95-730 IN THE MATTER OF THE APPLICATION OF ) THE McHENRY STATE BANK, AS TRUSTEE ) UNDER THE PROVISIONS OF A TRUST ) AGREEMENT DATED SEPTEMBER 2, 1977, ) AND KNOWN AS TRUST NO. 1313, FOR AN ) AMENDMENT OF THE ZONING ORDINANCE OF ) THE CITY OF McHENRY, McHENRY COUNTY, ) ILLINOIS. ) ZONING ORDINANCE WHEREAS, your Petitioner filed a Petition with the Zoning Board of Appeals of the City of McHenry requesting a reclassification of the property to "0-2" Office Park District in regard to the following described real estate: Part of the Northwest Quarter of Section 2, Township 44 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the Northwest Corner of said Section 2; thence East along the North line of the Northwest Quarter of said Section 2, a distance of 817.54 feet to the Easterly right of way line of State Route 31 for the place of beginning; thence Southerly along said Easterly right of way line, a distance of 320.0 feet; thence Easterly at right angles to the last described course, a distance of 200.00 feet; thence Northerly parallel with the Easterly right of way line of State Route 31 a distance of 319.01 feet to the North line of the Northwest Quarter of said Section 2; thence West along said North line, a distance of 200.0 feet to the place of beginning, in McHenry County, Illinois. Permanent Index No. 14-02-100-005. WHEREAS, the property consists of approximately 1.467 acres, more or less, and is located on the East side of Route 31, approximately 4/10ths of a mile North of the intersection of Route 31 and Bull Valley Road and approximately 300 feet North of the Knox Drive entrance to Knox Park; and WHEREAS, the property is unimproved and has approximately 320 feet of road frontage along U.S. Route 31; and WHEREAS, the property is presently zoned "RS-3" Medium -High Density Single Family Residential District pursuant to the City of McHenry Zoning Ordinance; and 1 WHEREAS, a Petition was filed with the City of McHenry requesting a hearing before the Zoning Board of Appeals on the matters raised in the Petition; and WHEREAS, a hearing was held before the Zoning Board of Appeals in the manner and form as prescribed by Ordinance and statues; and WHEREAS, as a result of said hearing; a Motion to approve the reclassification set forth in the Petition was approved by a vote of five (5) ayes; two (2) absent and zero (0) nays in favor of granting of the reclassification of the property to "0-2" Office Park District; and WHEREAS, the City Council has fully reviewed the report of the hearing before the Zoning Board of Appeals; and WHEREAS, the City Council in reviewing the evidence presented before the Zoning Board of Appeals regarding the reclassification of the property does make specific findings of fact that: (a) The proposed reclassification is compatible with existing uses or existing zoning of property in the environs. (b) The trend of development in the general area since the original zoning of the effected property and since passage of the McHenry Zoning Ordinance supports the proposed reclassification. (c) The proposed reclassification is in harmony with the objectives of the Comprehensive Plan of the City as viewed in light of any changed conditions since the adoption of the Plan and since the adoption of the Zoning Ordinance itself; (d) The proposed reclassification promotes the public interest and not solely the interest of the Petitioner. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, McHenry County, Illinois, as follows: SECTION 1: That the above recitals are incorporated into this Ordinance. SECTION 2: That the subject property is hereby reclassified to "0-2" Office Park District. SECTION 3: This Ordinance shall be in full force and effect from and after its passage as provided by law.
