AN ORDINANCE PROVIDING FOR THE
ANNEXATION OF CERTAIN DESCRIBED
REAL ESTATE TO THE CITY OF MCHENRY, ILLINOIS
WHEREAS, McHenry State Bank, as Trustee under Trust No. 12977E is
the record owner of the real estate hereinafter described; and
WHEREAS, Frank Rodgers and Catherine Rodgers, husband and wife, are
the beneficial owners of the above Trust; and
WHEREAS, Two electors reside on the real estate hereinafter
described, which are the above beneficial owners; and
WHEREAS, said real estate is contiguous to the existing corporate
limits of the City of McHenry, Illinois, and is not located within any
other municipality; and the aforesaid record owner and beneficial
owners/electors desire annexation of said real estate and have petitioned
the corporate authorities of the City of McHenry, Illinois, in writing
an under oath, for annexation of said real estate; and
WHEREAS, the land to be annexed will not be disconnected from any
fire protection district nor public library district and therefore
statutory notice is not required to be given to those legal entities.
WHEREAS, notice was given to the McHenry Township Authorities as
required by Statute and the requisite Affidavit of Service is on file in
the McHenry City Clerk's Office.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
McHENRY, ILLINOIS, as follows:
SECTION 1. The following described real estate be and the same is
hereby annexed to and made a part of the corporate limits of the City of
McHenry, Illinois, including any and all portions of adjacent streets,
roads, or highways as required by law:
Lots 3 and 4 in Block 7 of the Original Plat of McHenry, on
the east side of Fox River, being a part of the Southeast
Quarter of Section 26, Township 45 North, Range 8 East of the
Third Principal Meridian, according to the Plat thereof
recorded in Book B of Deeds, page 160, in McHenry County,
Illinois,
commonly known as 3107 W. Lake Avenue, McHenry, IL 60050.
That a Plat of Survey of said territory is attached hereto as Exhibit
"A".
SECTION 2. The City Clerk is hereby directed to cause an accurate
map of the real estate described and annexed to be prepared or obtained,
and when satisfied as to the accuracy of said map, record the map and a
certified copy of this Ordinance in the Office of the

Recorder of Deeds, McHenry County, Illinois. Following the recordation
of this Ordinance and a map of the real estate above described and
annexed, a certified copy thereof shall be filed in the Office of the
Clerk of McHenry County, Illinois.
SECTION 3. This Ordinance shall be in full force and effect from
and after its passage, approval and publication according to law.
