HomeMy WebLinkAboutOrdinances - O-95-727 - 11/01/1995 - ANNEX SPENGEL PROPERTY 2808 W RTE 120ORDINANCE NO. 0-95-•727 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN DESCRIBED REAL ESTATE TO THE CITY OF McHENRY, ILLINOIS WHEREAS, Dr. Scott J. Spengel and Diana K. Spengel, are the owners of the real estate hereinafter described; and WHEREAS, There are two electors residing on said real estate which are the above -named owners; and WHEREAS, said real estate is contiguous to the existing corporate limits of the City of McHenry, Illinois, and is not located within any other municipality; and the aforesaid record owners and electors desire annexation of said real estate and have petitioned the corporate authorities of the City of McHenry, Illinois, in writing and under oath, for annexation of said real estate; and WHEREAS, the land to be annexed will not be disconnected from any fire protection district nor public library district; the land does not front on a township road and therefore statutory notice is not required to be given to those legal entities. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, ILLINOIS, as follows: SECTION 1. The following described real estate be and the same is hereby annexed to and made a part of the corporate limits of the City of McHenry, Illinois, including any and all portions of adjacent streets, roads, or highways as required by law: That part of the Southeast Quarter of the Southwest Quarter of Section 25, and of that part of the Northeast Quarter of the Northwest Quarter of Section 36, Township 45 North, Range 8 East of the Third Principal Meridian, described as follows: Commencing at the intersection of the west line of the Northeast Quarter of the Northwest Quarter of said Section 36 with the center line of Illinois Route 120; thence southeasterly along said center line 102.75 feet; thence northeasterly at right angles to the last described line, 220.0 feet; thence northwesterly at right angles to the last described line, 160.52 feet to the west line of the Southeast Quarter of the Southwest Quarter of said Section 25; thence south along the west line of the Southeast Quarter of the Southwest Quarter of said Section 25 and the west line of the Northeast Quarter of the Northwest Quarter of said Section 36, to the point of beginning, in McHenry County, Illinois, Excepting therefrom That part of the Southeast Quarter of the Southwest Quarter of Section 25 and part of the Northeast Quarter of the Northwest �'Ee © �_-o I-,- n I k - 3 --9 .S- 1:V�Q s K-bq 9 / S3- Quarter of Section 36, Township 45 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois, described as follows: Beginning at the northwest corner of the Northeast Quarter of the Northwest Quarter of Section 36, thence on an assumed bearing of South 0 degrees 20 minutes 44 seconds west along the west line thereof 37.8 feet to a point on the center line of Illinois Route 120; thence south 75 degrees 11 minutes 55 seconds east along said center line 102.94 (102.75 feet recorded) to the southeast corner of the lands of the grantor; thence north 14 degrees 48 minutes 05 seconds east along the east line of the lands of the grantor 50.00 feet; thence north 75 degrees 11 minutes 55 seconds west along a line parallel with the center line of Illinois Route 120 a distance of 115.92 feet to a point on the west line of the Southeast Quarter of the Southwest Quarter of Section 25; thence south 0 degrees 00 minutes 45 seconds west along the west line thereof 14.57 feet to the point of beginning, commonly known as 2808 W. IL Route 120, McHenry, IL. That a Plat of Survey of said territory is attached hereto as Exhibit "All SECTION 2. The City Clerk is hereby directed to cause an accurate map of the real estate described and annexed to be prepared or obtained, and when satisfied as to the accuracy of said map, record the map and a certified copy of this Ordinance in the Office of the Recorder of Deeds, McHenry County, Illinois. Following the recordation of this Ordinance and a map of the real estate above described and annexed, a certified copy thereof shall be filed in the Office of the Clerk of McHenry County, Illinois. SECTION 3. This Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED this 1st day of November , 1995.
