HomeMy WebLinkAboutOrdinances - O-95-725 - 10/04/1995 - VACATE PORTION UTILITY EASEMENT SOUTH STREET LOGA0-95-725 AN ORDINANCE VACATING A PORTION OF A UTILITY EASEMENT WHEREAS, the street previously known as South Street between the southwesterly line of Mill Street and the northeasterly line of Logan Street in the City of McHenry, Illinois, was vacated by Ordinance No. 0-77-66 on October 21, 1974. Said Ordinance also established and reserved a sixty (60) foot utility easement within said vacated street for the maintenance, operation, repair or replacement of any utility or surface water drainage structure of the City or of any licensee or holder of a franchise from the City; and WHEREAS, the Corporate Authorities of the City of McHenry have determined that the westerly ten (10) feet of the sixty (60) foot utility easement in said vacated street contains no utilities or surface water drainage structures and that the public interest will be served by vacating said ten (10) feet for the purpose of allowing the owners of 910 W. Logan to construct a portion of their garage within said ten (10) feet. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, as follows: SECTION 1. That the westerly ten (10) feet of a sixty (60) foot utility easement established in Ordinance No. 0-77-66 in the vacated street previously known as South Street between the southwesterly line of Mill Street and the northeasterly line of Logan Street in the City of McHenry, Illinois be vacated to permit the owners of 910 W. Logan to construct a portion of their garage within said ten (10) feet as shown on the diagram attached hereto as Exhibit "A". SECTION 3. All ordinances or parts thereof in conflict with the terms and provisions hereof are hereby repealed to the extent of such conflict. SECTION 4. This ordinance shall be published in pamphlet form by and under the authority of the Corporate Authorities of the City of McHenry, Illinois. SECTION 5. This ordinance shall be in full force and effect immediately from and after its passage, approval and publication, as provided by law. PASSED this 4th day of October, 1995.
