AN ORDINANCE PROVIDING FOR THE ANNEXATION
OF CERTAIN TERRITORY TO THE CITY OF McHENRY
(BEING PROPERTY SOUTH OF ILLINOIS STATE ROUTE 120
AND EAST OF RIVER ROAD)
WHEREAS, Richard A. Adams and Rita A. Adams are the owners of
record of certain property, depicted on the Plat of Annexation prepared
by Conway Surveying, Inc., P.C., attached hereto as Exhibit "A",
hereinafter referred to as "Subject Property"; and
WHEREAS, the Subject Property is contiguous to the current
corporate limits of the City of McHenry and is not located within the
corporate limits of any other municipality; and
WHEREAS, the aforesaid record owners desire annexation of said real
estate and have petitioned the corporate authorities of the City of
McHenry, Illinois, in writing and under oath, for annexation of the
Subject Property.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the
City of McHenry, McHenry County, Illinois, as follows:
SECTION 1: That the following Subject Property is hereby annexed
to the City of McHenry:
All that part of Lots 40, 41 and 42 in Sunnyside Subdivision,
according to the Plat thereof recorded in the Recorder's
Office of McHenry County, Illinois as Document No. 13880, and
that part of Block 1 in Edgewater Subdivision, according to
the Plat thereof recorded in said Recorder's Office as
Document No. 48334, described as follows: Beginning at the
most southerly corner of Lot 1 in Block 1 of said Edgewater
Subdivision and running thence northeasterly on the
southeasterly line thereof for a distance of 105 feet to a
point on a line drawn 20 feet southwesterly of and parallel to
the northeasterly lines of Lots 1 and 2 of Block 1 of said
Edgewater Subdivision; thence northwesterly on the last
described parallel line for a distance of 72.63 feet to a
point; thence northeasterly on a line forming an angle of 90
degrees 44 minutes and 20 seconds to the right with a
prolongation of the last described line, at the last describe
point, for a distance of 50 feet to a point; thence
northwesterly parallel to the northeasterly lines of Lots 1
and 2 of Block 1 of said Edgewater Subdivision for a distance
of 10 feet to a point; thence northeasterly for a distance of
151.40 feet to a point on the south line of the north 100 feet
of Lot 42 of said Sunnyside Subdivision, said point being
175.62 feet of, as measured on the last described line, the
east line of said Lot 42, thence east on the south line of the
north 100 feet of said Lot 42 for a distance of 65.62 feet to
a point on the west line of the east 110 feet of said Lot 42;
thence north on the last described line for a distance of 100
feet to a point on the north line of said Lot 42; thence west
on the north line of said Lot 42 for a distance of 350 feet to

a point, said point being 51.5 feet east of the northwest
corner of said Lot 42; thence south parallel to the west line
of said Lot 42 for a distance of 152.85 feet to a point;
thence west parallel to the north lines of Lots 42, 41 and 40
of said Sunnyside Subdivision for a distance of 124.5 feet to
the northeasterly line of Fox River Road, being also the
southwesterly line of said Lot 40; thence southeasterly for a
distance of 10.7 feet along the northeasterly line of said Fox
River Road to an angle point therein; thence southeasterly on
the southwesterly line of said Lot 41 and on the southwesterly
line of Block 1 of said Edgewater Subdivision, being also on
the northeasterly line of said Fox River Road, for a distance
of 344.80 feet, more or less, to the place of beginning, all
situated in part of the Northeast Quarter of Section 35 and
part of the West Half of the Northwest Fractional Quarter of
Section 36, all in township 45 North, Range 8, East of the
Third Principal Meridian (except that part thereof falling in
Lots 1 and 2 in said Edgewater Subdivision), in McHenry
County, Illinois.
Also excepting therefrom:
The south 15 feet of the north 100 feet of the west 65.62 feet
of the east 175.62 feet of Lot 42 in Sunnyside, a Subdivision
of all that part of the Northeast Quarter of the Northeast
Quarter of Section 35, and that west half of the Northwest
Quarter of Section 36, lying on the northeasterly side of Fox
River, and a piece in the Southeast Quarter of the Northwest
Quarter of said Section 36, all in Township 45 North, Range 8
East of the Third Principal Meridian according to the Plat
thereof recorded September 17, 1909 as Document No. 13880, in
Book 3 of Plats, page 34, in McHenry County, Illinois.
Also excepting therefrom:
That part of Lot 42 in Sunnyside Subdivision, according to the
Plat thereof recorded in the Recorder's Office of McHenry
County, Illinois, as Document No. 13880, and that part of
Block 1, in Edgewater Subdivision, according to the Plat
thereof recorded in said Recorder's Office as Document No.
38334, described as follows: beginning at the most southerly
corner of Lot 1 in Block 1 of said Edgewater Subdivision and
running thence northeasterly on the southeasterly line thereof
for a distance of 105 feet to a point on a line drawn 20 feet
southwesterly of and parallel to the northeasterly :lines of
Lots 1 and 2 of said Block 1; thence northwesterly on the last
described parallel line for a distance of 72.63 feet to a
point; thence northeasterly on a line forming an angle of 90
degrees 44 minutes and 20 seconds to the right with a
prolongation of the last described line, at the last described
point for a distance of 50.00 feet; thence northwesterly
parallel to the northeasterly line of Lots 1 and 2 in Block 1
of said Edgewater Subdivision for a distance of 10 feet to a

point; thence northeasterly, a distance of 9.89 feet; thence
northwesterly parallel with the south line of said Block 1, a
distance of 102.84 feet; thence southwesterly, a distance of
168.94 feet to a point on the south line of said Block 1, at
a point 183.83 feet northwesterly, as measured along said
south line of said Block 1, from the point of beginning;
thence southeasterly along said south line of said Block 1 a
distance of 183.83 feet to the point of beginning, (excepting
therefrom that part thereof falling in Lots 1 and 2 .in said
Edgewater Subdivision), in McHenry County, Illinois.

SECTION 2: The City Clerk of the City of McHenry is hereby
directed to record in the Office of the Recorder of Deeds and to file in
the Office of the County Clerk of McHenry County, Illinois, and the Post
Office serving the territory, within 30 days of the effective date of
this Ordinance, a certified copy of this Ordinance.
SECTION 3: If any section, paragraph, subdivision, clause,
sentence of provision of this Ordinance shall be adjudged by any Court
of competent jurisdiction to be invalid, such judgment shall not affect,
impair, invalidate or nullify the remainder thereof, which remainder
shall remain and continue in full force and effect.
SECTION 4: The recitals set forth in this Ordinance are
incorporated herein by reference.
SECTION 5: All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 6: The Mayor and City Council hereby find that exigent
circumstances exist warranting the immediate effectiveness of this
Ordinance.
SECTION 7: This Ordinance shall be published in pamphlet form as
provided by law.
