HomeMy WebLinkAboutOrdinances - O-95-718 - 07/26/1995 - GRANT RECLASS INLAND MCCULOM LAKE RD PROPERTYJuly 26, 1995 ORDINANCE NO. 0-95-718 AN ORDINANCE ZONING CERTAIN TERRITORY KNOWN AS THE INLAND MCCULLOM LAKE PROPERTY IN THE CITY OF MCHENRY WHEREAS, THE CITY OF McHENRY has been requested by a petition signed by The American National Bank and Trust Company of Chicago, not individually, but as Trustee under a Trust Agreement dated April 15, 1991, known as Trust No. 113739-0 and Inland Appreciation Fund II, L. P. , a Delaware Limited Partnership, to annex and zone 56 ± acres located on the South side of McCullom Lake Road, North of Prestwick Street, and East of Petersen Park; and WHEREAS, A PUBLIC HEARING was held by the McHenry Zoning Board of Appeals, after due notice in the manner provided by law; and WHEREAS, THE ZONING BOARD OF APPEALS, after deliberation, has made a report to the City Council; and WHEREAS, THE CITY COUNCIL has considered the reports and recommendations of the Zoning Board and Planning Commission and evidence presented at the public hearings. NOW, THEREFORE, BE IT ORDAINED by the City Council of the CITY OF McHENRY, McHenry County, Illinois as follows: SECTION 1: As outlined in the annexation agreement between the City and Petitioners previously approved by the City Council, the petition for "RS-2" Medium Density Single Family Residential District, for the following property shall be granted: PARCEL 1: That part of the Southwest Quarter of the Southwest Quarter of Section 23, Township 45 North, Range 8 East of the Third Principal Meridian, lying Southwesterly of the Southwesterly right-of-way line of McCullom Lake Road, in McHenry County, Illinois. PARCEL 2: That part of the Northwest Quarter of the Northwest Quarter of Section 26, Township 45 North, Range 8 East of the Third Principal Meridian, lying Southwesterly of the Southwesterly right-of-way line of McCullom Lake Road, in McHenry County, Illinois. PARCEL 3: The East 40.04 feet of the Northeast Quarter of the Northeast Quarter of Section 27, Township 45 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois. PARCEL 4: The East 40.04 feet of Lot 8 in McHenry Plat No. 6 of Section 22, Township 45 North, Range 8 East of the Third Principal Meridian, as recorded May 6, 1902 as Document No. 14082 in Book 2 of Plats, page 34, in McHenry County, Illinois. SECTION 2: That all requirements set forth in the Zoning Ordinance of the City of McHenry, as would be required by any owner of property zoned in the same manner as the property described above, shall be complied with. SECTION 3: The findings and recommendations of the Zoning Board of Appeals on the question of granting the rezoning for the subject property are hereby accepted. SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 5 : All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extend of such conflict. SECTION 6: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
