HomeMy WebLinkAboutOrdinances - O-95-714.A - 07/26/1995 - GRANT RECLASS INLAND BUSINESS PARKORDINANCE NO. 0-95-714, A An Ordinance Providing for a Map Amendment of the Zoning Ordinance of the City of McHenry, McHenry County, Illinois WHEREAS, Petitioner, AMERICAN NATIONAL BANK AND TRUST COMPANY OF CHICAGO, as Trustee under Trust Agreement dated the 27th day of September, 1993 and known as Trust No. 117509-08, has filed a Petition with the Zoning Board of Appeals of the City of McHenry, Illinois requesting an amendment to the Zoning Ordinance of the City of McHenry, Illinois, which would affect the following described property: Parcel 1: That part of the South half of the Southwest Quarter of Section 3, Township 44 North, Range 8 East of the Third Principal Meridian, lying East of the Chicago and Northwestern Railroad Company; also the Southeast Quarter of said Section 3 (excepting the North 100.0 feet thereof and also excepting the East 2251.31 feet thereof), in McHenry County, Illinois. Also Parcel 2: That part of the Southeast Quarter of the Southwest Quarter of Section 4, Township 44 North, Range 8 East of the Third Principal Meridian, lying Southeasterly of the center line of Crystal Lake Road (excepting the South 100.0 feet thereof); also the Southwest Quarter of the Southeast Quarter of said Section 4 (excepting the South 100.0 feet thereof); also the Southeast Quarter of the Southeast Quarter of said Section 4; also that part of the Northwest Quarter of the Southeast Quarter of said Section 4lying Southeasterly of the center line of Crystal Lake Road and Southwesterly of the Southwesterly right of way line of Bull Valley Road; also that part of the South half of the Southwest Quarter of Section 3, Township 44 North, Range 8 East of the Third Principal Meridian, lying West of the Westerly right of way line of the Chicago and Northwestern Railroad Company, in McHenry County, Illinois. WHEREAS, pursuant to notice, a public hearing was held before the Zoning Board of Appeals of the City of McHenry, Illinois, on March 20, 1995 in regard to the contents of the Petition, where evidence was introduced by the Petitioner in support of its petition; and WHEREAS, an affirmative recommendation was made by the Zoning Board of Appeals in that all the approval criteria as set forth in Table 33 of the City of McHenry Zoning Ordinance were met; and WHEREAS, the City Council of the City of McHenry, Illinois, has fully considered the merits of the Petition and the evidence presented to the Zoning Board of Appeals of the City of McHenry, including all exhibits containing plans and specifications for the proposed use. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS, AS FOLLOWS: 1. The City Council expressly finds that Petitioners' request for a zoning map amendment has met the approval criteria contained in Table 33 of the Zoning Ordinance and set forth in Exhibit "A" attached hereto and made a part hereof. 2. That the foregoing described real estate, upon annexation to the City of McHenry, is hereby classified "BP" Business Park District as defined in the Zoning Ordinance of the City of McHenry. 3. The following additional permitted uses on those lots designated as Lots 187 through 198 on the preliminary plat prepared by Cemcon, Ltd. (Job. No: 588.002) as revised May 16, 1995 (the "Preliminary Plat"), inclusive, all of which additional uses are to be church owned and operated: cemeteries, churches and religious institutions, community center/multi-purpose buildings, child and adult day care centers, gymnasium/health clubs, retreat facilities, schools and educational institutions, and rectory -convents, and also providing a conditional use for church owned and operated convalescent/retirement homes on Lots 187 through 198. 4. That the foregoing described real estate, upon annexation to the City of McHenry, is hereby classified as "Business Park" on the City of McHenry Official Map and Comprehensive Plan. 5. All Ordinances in conflict herewith are repealed to the extent of such conflict. 6. This Ordinance shall be in full force and effect from and after its passage and approval as provided by law. EXHIBIT "A" 1. That the proposed use or the uses permitted under the proposed zoning classification are compatible with existing uses or existing zoning of property in the environs. Premises is adjacent to the McHenry Corporate Center which is a large business park type development in the City of McHenry. Also Premises is adjacent to the Northern Illinois Medical Center. 2. That the trend of development in the general area since the original zoning of the affected property was established supports the proposed use or zoning classifications. Upon annexation, Premises will be adjacent to "I-1" -Industrial Zoning District and "0- 2" -Office Zoning District for which "BP" -Business Park Zoning will be compatible. 3. That the proposed use or zoning classification is in harmony with the objectives of the Comprehensive Plan of the City as viewed in light of any changed conditions since the adoption of the Plan. The existing Official Map shows a portion of Premises to be designated as Business Park. The proposed "BP" -Business Park Zoning on the Premises would be consistent with the related zoning districts set forth in the Development Plan of the Comprehensive Plan. 4. That the proposed use or zoning classification promotes the public interest and not solely the interest of the Petitioner. The City of McHenry will benefit from the types of uses provided in a business park -type development without burdening the school districts.
