ORDINANCE
NO. 0-95- 713
An Ordinance Annexing Certain
Property owned by American
National Bank and Trust as Trustee
under trust Agreement dated
September 27, 1993 and known as
Trust No. 117509-08
WHEREAS, AMERICAN NATIONAL BANK OF CHICAGO, as Trustee under trust
Agreement dated September 27, 1993 and known as Trust No. 117509-08, is the record title
holder of the real estate hereinafter described; and
WHEREAS, no electors reside on said real estate; and
WHEREAS, said real estate is contiguous to the existing corporate limits of the City of
McHenry, Illinois and is not located within any other municipality and the aforesaid record
title owner desires annexation of said real estate and has petitioned the corporate authorities
of the City of McHenry, Illinois, in writing and under oath, for annexation of the real estate;
and
WHEREAS, the Corporate Authorities for and on behalf of the City of McHenry,
McHenry County, Illinois, have heretofore approved an Annexation Agreement bearing the
date of ✓VLy_ -126, , 1995, between itself, AMERICAN NATIONAL BANK OF
CHICAGO, as Trustee under Trust Agreement dated September 27, 1993 and known as Trust
No. 117509-08, and INLAND CAPITAL FUND, L.P., beneficiary, which provides in part for
the annexation of said real estate to the existing corporate limits of the City of McHenry,
McHenry County, Illinois, and for the classification of said real estate under the provisions of
the City of McHenry Zoning Ordinance; and
WHEREAS, upon proper notice, public hearings were held pursuant to State statute and
the appropriate provisions of the Zoning Ordinance of the City of McHenry relative to the
Petitioner's request.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS, as follows:
SECTION 1: That the following described property is hereby annexed to the
City of McHenry, McHenry County, Illinois:
Parcel 1:
That part of the South half of the Southwest Quarter of Section 3, Township 44 North, Range
8 East of the Third Principal Meridian, lying East of the Chicago and Northwestern Railroad
Company; also the Southeast Quarter of said Section 3 (excepting the North 100.0 feet thereof
and also excepting the East 2251.31 feet thereof), in McHenry County, Illinois. Also

Parcel 2:
That part of the Southeast Quarter of the Southwest Quarter of Section 4, Township 44 North,
Range 8 East of the Third Principal Meridian, lying Southeasterly of the center line of Crystal
Lake Road (excepting the South 100.0 feet thereof); also the Southwest Quarter of the Southeast
Quarter of said Section 4 (excepting the South 100.0 feet thereof); also the Southeast Quarter
of the Southeast Quarter of said Section 4; also that part of the Northwest Quarter of the
Southeast Quarter of said Section 41ying Southeasterly of the center line of Crystal Lake Road
and Southwesterly of the Southwesterly right of way line of Bull Valley Road; also that part
of the South half of the Southwest Quarter of Section 3, Township 44 North, Range 8 East of
the Third Principal Meridian, lying West of the Westerly right of way line of the Chicago and
Northwestern Railroad Company, in McHenry County, Illinois.
Said property, depicted on an accurate map which is appended and made a part of this
Ordinance, consists of 200 acres, more or less, and is contiguous to the City of McHenry.
SECTION 2: That the Clerk of the City of McHenry is hereby directed to record in
the Office of the Recorder and to file in the Office of the County Clerk of McHenry County,
Illinois, within 30 days of the effective date of this Ordinance a certified copy of this
Ordinance, together with an accurate map of the property hereby annexed, said map being
attached hereto, made a part thereof and identified as Exhibit A.
SECTION 3: This Ordinance shall be in full force and effect immediately' after its
passage and approval.
SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of this
Ordinance shall be judged by any Court of competent jurisdiction to be invalid, such judgment
shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall
remain and continue in full force and effect.
SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 6: This Ordinance shall be in full force and effect upon its passage, approval
and publication in pamphlet form (which publication is hereby authorized) as provided by law.
