HomeMy WebLinkAboutOrdinances - O-95-693 - 01/11/1995 - ANNEX FAP 420 ED AND ETHEL BLAKE PROPERTYORDINANCE NO. 0-95- 693 An Ordinance Annexing Certain Property Dedicated for Highway Purposes Under the Jurisdiction of the Department Of Transportation of the State of Illinois, to the City of McHenry BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS, as follows: SECTION 1: That, pursuant to 65 ILCS 5/7-1-10, the following described property, dedicated for highway purposes under the jurisdiction of the Department of Transportation of the State of Illinois, is hereby annexed to the City of McHenry, McHenry County, Illinois: FA ROUTE 201 (FAP 420) TAKEN BY CONDEMNATION IN CASE NO. 73-3756 KNOWN AS PARCEL #0042 Part "A" (ED & ETHEL BLAKE PROPERTY WEST OF ROUTE 31) That part of Lot 3 of County Clerk's Plat of the Southwest Quarter of Section 23, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded May 6, 1092 as Document 14082, in Book 2 of Plats, page 34, in McHenry County, Illinois, described as follows: Beginning at the Northeast corner of the East Half of the Southwest Quarter of Section 23, which is 298.57 feet Northeasterly of Station 618+41.25 on the centerline of F.A. Route 201, recorded in Document 413547, as measured normal thereto, thence Southerly along the East line of the Southwest Quarter of Section 23, said East line being the centerline of the public highway known as F.A. Route 54 (Illinois Route 31), a distance of 1,262.86 feet to the point of intersection of the said East line with the Easterly extension of the North line of that part of said Lot 3 conveyed by Document 556595; thence Westerly along the said North line and the Easterly extension thereof, which makes an angle of 90 Degrees, 00 Minutes, 00 Seconds to the right of the prolongation of the last described course at the last described point a distance of 123.75 feet to a point; thence Northwesterly along a line which makes an angle of 84 Degrees, 28 Minutes, 21 Seconds to the right to the prolongation of the last described course at the last described point a distance of 356.55 feet to a point; thence Northwesterly along a line which makes an angle of 15 Degrees, 06 Minutes, 40 Seconds to the left of the prolongation of the last described course at the last described point a distance of 88.37 feet to a point which is 520.00 feet Southwesterly of Station 620+60 on the centerline of F. A. Route 201, as measured normal thereto; thence Northwesterly along a line which makes an angle of 34 Degrees, 43 Minutes, 44 Seconds to the left of the prolongation of the last described course at the last described point a distance of 216.45 feet to a point which is 495.00 feet Southwesterly of Station 618+45 on the centerline of F.A. Route 201, as measured normal thereto; thence Northwesterly along a line which makes an angle of 29 Degrees, 34 Minutes, 37 Seconds to the right of the prolongation of the last described course at the last described point a distance of 347.02 feet to a point which is 290.00 feet Southwesterly of Station 615+65 on the r� S� 0025$8 95-04-11oc centerline of A.A. Route 201, as measured normal thereto; thence Northwesterly along a line which makes an angle of 13 Degrees, 39 Minutes, 59 Seconds to the left of the prolongation of the last described course at the last described point a distance of 286.92 feet to a point which is 180.00 feet Southwesterly of Station 613+00 on the centerline of A. A. Route 201, as measured normal thereto; thence Northwesterly along a line which makes an angle of 20 Degrees, 54 Minutes, 01 Seconds to the left of the prolongation of the last described course at the last described point a distance of 319.27 feet to a point on the North line of the Southwest Quarter of Section 23 which is 170.85 feet Southwesterly of Station 609+80.86 on the centerline of F. A. Route 201, as measured normal thereto; thence Easterly along the said North line which makes an angle of 149 Degrees, 44 Minutes, 26 Seconds to the right of the prolongation of the last described course at the last described point a distance of 980.11 feet to the point -of beginning. ALSO Part B (Small piece SE of and adjacent to Cacciatore property abutting West side of IL. Route 31 - Ed and Ethel Blake) That part of Lot 3 of County Clerk's Plat of the Southwest Quarter of Section 23, Township 45 North, Range 8 East of the Third Principal Meridian, according to the Plat thereof recorded May 6, 1902 as Document 14082, in Book 2 of Plats, page 34 in McHenry County, Illinois, described as follows: Commencing at the Northeast corner of the East Half of the Southwest Quarter of Section 23; thence Southerly along the East line of the Southwest Quarter of Section 23, said East line being the centerline of the public highway known as F. A. Route 53 (IL. Route 31), a distance of 1,954.30 feet to point of beginning, said point being the point of intersection of the said East line with the Easterly extension of the South line of that part of said Lot 3 conveyed by Document 556595; thence continuing South along the said East line of said Southwest Quarter of Section 23 a distance of 83.86 feet to a point; thence Westerly along a line which makes an angle of 90 Degrees, 00 Minutes, 00 Seconds to the right of the prolongation of the last described course at the last described point a distance of 40.00 feet to a point, thence Northwesterly along a line which makes an angle of 81 Degrees, 28 Minutes, 09 Seconds to the right of the prolongation of the last described course at the last described point a distance of 84.80 feet to a point on the aforesaid South line of that part of said Lot 3 conveyed by Document 556595; thence East along the said South line a distance of 52.58 feet to the point of beginning. Said property, depicted on an accurate map which is appended and made a part of this Ordinance, is parallel and contiguous to the City of McHenry corporate limits. SECTION 2: That the Clerk of the City of McHenry is hereby directed to record in the Office of the Recorder and to file in the Office of the County Clerk of McHenry County, Illinois, within 30 days of the effective date of this Ordinance a certified copy of this Ordinance, together with an accurate map of the property hereby annexed, said map being attached hereto, made a part hereof and identified as Exhibit "A". -2- 95-04-1187 SECTION 3: This Ordinance shall be in full force and effect immediately after its passage and approval. SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
