An Ordinance Reclassifying Certain Property
Owned by the Blake Family Limited Partnership
in the City of XcHenry
WHEREAS, THE CITY OF McHENRY has been requested by a petition
signed by the Blake Family Limited Partnership to reclassify' 15
acres located within the corporate limits of the City of McHenry,
Illinois as C-5 Highway Commercial District; and
WHEREAS, A PUBLIC HEARING was held by the McHenry Zoning Board
of Appeals, after due notice in the manner provided by law; and
WHEREAS, THE ZONING BOARD OF APPEALS, after deliberation, has
made a report and recommended the granting of said zoning; and
WHEREAS, THE CITY COUNCIL has considered the findings of fact,
based upon the evidence presented at the public hearing, presented
to the Zoning Board of Appeals by the petitioners.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the CITY
OF McHENRY, McHenry County, Illinois, as follows:
SECTION 1: The petition for reclassification of the following
property from C-3 Community Commercial District to C-5 Highway
Commercial District is hereby granted:
That part of Lot 3 in County Clerkfs Plat of the South-
west Quarter of Section 23, Township 45 North, Range 8
East of the Third Principal Meridian, according to the
Plat thereof recorded May 6, 1902, as Document 114082 in
Book 2 of Plats, page 34, in McHenry County, Illinois,
described as follows: Commencing at the Southeast corner
of said Lot 3; thence South 88 degrees 52' 35" West along
the South line of said Lot 3, a distance of 36.2 feet to
the point of beginning; thence continuing South 88
degrees, 52" 35" West a distance of 1,240.69 feet to the
most Southwesterly corner of said Lot 3, thence North 2
degrees 27' 53" East along the North line of said Lot 3
330.00 feet; thence South 88 degrees 52' 35" West along
the North line of Lot 4 a distance of 49.5 feet; thence
North 0 degrees 03' 08" West along the most Westerly line
of Lot 3 a distance of 205.53 feet; thence North 89
degrees 5511 07" East, 1,275.02 feet; thence South 0
degrees 04" 53" East, 511.73 feet to the point of
beginning. All containing 15.000 acres, more or less, in
McHenry County, Illinois.

SECTION 2: That all requirements set forth in the Zoning
Ordinance of the City of McHenry, as would be required by any owner
of property zoned in the same manner as the property described
above, shall be complied with.
SECTION 3: The findings and recommendations of the Zoning
Board of Appeals on the question of granting the rezoning for the
subject property are hereby accepted.
SECTION 4: This ordinance shall be in full force and effect
immediately after its passage and approval.
SECTION 5: If any section, paragraph, subdivision, clause,
sentence or provision of this Ordinance shall be adjudged by any
Court of competent jurisdiction to be invalid, such judgment shall
not affect, impair, invalidate or nullify the remainder thereof,
which remainder shall remain and continue in full force and effect.
SECTION 6: All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 7: This Ordinance shall be in full force and effect
upon its passage, approval and publication in pamphlet form (which
publication is hereby authorized) as provided by law.
