HomeMy WebLinkAboutOrdinances - O-94-671 - 10/19/1994 - AUTHORIZE ANNEX OF FOX RIVER PROPERTYORDINANCE NO. 0-94- 671 An Ordinance Authorizing Annexation of Portions of the Fox River WHEREAS, the territory described below is contiguous to the City of McHenry, McHenry County, Illinois; WHEREAS, passage of this ordinance is authorized pursuant to 65 ILCS 7-1-13; WHEREAS, the territory described below contains less than 60 acres and is wholly bounded by the City of McHenry and the Fox River; and WHEREAS, the territory described below was the subject of Resolution No. RS-94-15 passed by the City of McHenry on August 31, 1994 annexing said property to the City of McHenry, pursuant to 65 ILCS 5/7-1-2(f). NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of McHenry, McHenry County, Illinois, as follows: SECTION 1: The City of McHenry hereby annexes the following described real estate: That portion of the Fox River located in the southeast quarter of Section 26, the southwest quarter of Section 25, the northeast quarter of Section 35 and the northwest quarter of Section 36, all in Township 45 North, Range 8 East of the Third Principal Meridian described as follows: Beginning at the intersection of the Westerly Bank of the Fox River and the northerly line of lot 6, block 1 of Snyder's Subdivision, being a subdivision of part of the southeast quarter of Section 26, thence southerly along the westerly bank of the Fox River (being also the corporate line of the City of McHenry) to the intersection of said westerly bank and the southerly line of lot 42 (also being the southeast corner of lot 42) in Owen, Stenger and Allen's 1st Addition Subdivision, being a subdivision in the northwest quarter of Section 36, thence easterly across the Fox River to the intersection of said easterly bank and the southerly line of lot 31 of Sunnyside Subdivision, being a subdivision of part of the northwest quarter of Section 36, thence northerly and westerly along the east bank of the Fox River to the intersection of said easterly bank and the northerly line of lot 7, block 5 of Hunterville Park Subdivision, being a subdivision of part of the southwest quarter of Section Fox River Property, Page 1 Rec©�-b cD I l- 4 -Q 4 '�--q q P--,o 6 3 0.37 25, thence westerly to the point of beginning, being situated in McHenry Township, McHenry County, Illinois. SECTION 2: The Clerk of the City of McHenry shall file with the McHenry County Recorder of Deeds a copy of this ordinance with an accurate map of the annexed territory. SECTION 3: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
