AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE CITY OF MCHENRY, ILLINOIS
WHEREAS, a written Petition signed by Charles J. Miller, Sole
Beneficiary of McHenry State Bank Trust No. 4773, has been filed with
the City Clerk of the City of McHenry, Illinois, requesting an amendment
to the Zoning Ordinance of the City of McHenry, removing the premises
described below from the RS-4 High Density Single Family Residential
District, in which they now lie, and placing them in District C,4
Downtown Commercial; and
WHEREAS, the premises for which the change in zoning classification
is more properly described as follows to wit:
PARCEL 1: Lot 9 in Block 26 of the Original Plat of the Town (now
City) of McHenry an the West Side of Fox River, being a part of the
Southeast Quarter of Section 26, Township 45 North, Range 8 East
of the Third Principal Meridian, according to the Plat thereof of July
26, 1840, in Book B of Deeds, page 160, in McHenry County, Illinois.
PARCEL 2: Part of the Southeast Fractional Quarter of Section 26,
Township 45 North, Range 8 East of the Third Principal Meridian,
also being a part of Lot 28 of the County Clerk's Plat of said
Section, described as follows, to wit: Commenc`in at the most Southerly
corner of Block 25 of the Original Plat of McHenry, on the Westerly
side of Fox River; thence Southwesterly on a line which is a
continuation of the Easterly line of said Block 25, a distance of
25 feet; thence Easterly on a line parallel with the Southerly line
of Block 26 of Original Plat of McHenry, a distance of 273.59 feet
to an iron stake for a place of begging; thence Northerly on a
line parallel with the Westerly line of Riverside Drive (extended
Southerly), 25 feet to an iron stake; thence Easterly on the
Southerly line of said Block 26, a distance of 55 feet to the most
Southerly corner of Block 26; thence Southerly along the Westerly
Line of said Riverside Drive (extended Southerly), 157 feet to an
iron stake; thence Westerly parallel with the Southerly line of
said Block 26, a distance of 55 feet to an iron stake; thence
Northerly on a straight line, 132 feet to the place of beginning;
ALSO a parcel of land lying Southerly from and adjoining the above
described tract of land, described as follows, to wit: Beginning at the
most Westerly corner of said above described tract; thence
Southeasterly along the Southerly line thereof, 55 feet; thence
Southerly on. a continuation of the Easterly line of said above
described tract 4 feet more or less to the waters edge of the
dredged charnel; thence Westerly along the waters edge of said
dredged channel to an intersection with the Westerly line of said
above described property extended Southerly; thence Northerly 8
feet, more or less to the place of beginning, in McHenry County,
Illinois.
WHEREAS V a hearing was held before the City of McHenry Zoning
Board of Appeals on August 2, 1993, at which time the Zoning Board of
Appeals did take evidence and view exhibits presented thereat by the
Petitioner: and
WHEREAS, based on evidence heard, the Zoning Board of Appeals found
that the ordinances of the City of McHenry and the laws of the State of
Illinois have been followed in connection with this Petition and that
the Zoning Board denied the petition for reclassification to District C-
4 Downtown Commercial; and
WHEREAS, the City Council finds that, in fact, it would serve the
best interest of the City if the sought for zoning reclassification to
District C-4 Downtown Commercial were granted, in that, all of the
following conditions apply to the subject property:
1) Compatible With Use of Zoning of Environs
The proposed use(s) or the uses permitted under the proposed
zoning classification are compatible with existing uses or
existing zoning of property in the environs.
2) Supported by Trend of Development
The trend of development in the general area since the original
zoning of the affected property was established supports the
proposed use or zoning classification.
3) Consistent With Comprehensive Plan Objectives
The proposed use or zoning classification is in harmony with
the objective of the Comprehensive Plan; of the City as viewed
in light of any changed conditions since the adoption of the
Plan.
4) Furthers Public Interest
The proposed use or zoning classification promotes the public
interest and not solely the interest of the applicant.
NOW MMMRE, be it ordained by the City Council of the City of
McHenry, Illinois, as follows: That the above described premises hereby
be reclassified from the RS-4 High Density Single Family Residential
District, in which they now lie, to District C-4 Downtown Commercial.

This ordinance is in full force and effect from the date hereof and
shall be published in pamphlet form by and under the authority
heretofore given to the City Council of the City of McHenry, Illinois
and this ordumice shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.
