HomeMy WebLinkAboutOrdinances - O-93-642 - 11/03/1993 - GRANT VARIANCE TARGET IN MCCULLOM PLACEORDINANCE NO. 0-93-642 An Ordinance Granting a Zoning Variation for Lot 1, Known as the Target Property in McCullom Place, McHenry WHEREAS, THE CITY OF McHENRY has been requested by a petition signed by Dayton Hudson Corporation, a Minnesota corporation ("Target") to grant a variation from the City of McHenry Zoning Ordinance to reduce the required interior side yard between a building and a property line from 10 feet to zero feet for certain property located within the City; and WHEREAS, A PUBLIC HEARING was held by the McHenry Zoning Board of Appeals, after due notice in the manner provided by law; and WHEREAS, THE ZONING BOARD OF APPEALS, after deliberation, has made a report and recommended the granting of said zoning varia- tion; and WHEREAS, THE CITY COUNCIL has considered the findings of fact, based upon the evidence presented at the public hearing, presented to the Zoning Board of Appeals by the petitioners. NOW, THEREFORE, BE IT ORDAINED by the City Council of the CITY OF McHENRY, McHenry County, Illinois, as follows: SECTION 1: That a variation from the City of McHenry Zoning Ordinance, Table 6 (C3 Zoning District), shall be granted to reduce the required interior side yard from 10 feet to zero feet along the following described line: That part of the Northeast Quarter of Section 26, Township 45 north, Range 8 east of the Third Principal Meridian, in McHenry County, Illinois, described as follows: commencing at the northwest corner of Dr. C.H. Feger's Addition to the Village of McHenry being a subdivision recorded October 17, 1895 as Document Number 16171; thence north 00 degrees 11 minutes 19 seconds west, a distance of 107.65 feet; thence south 89 degrees 56 minutes 11 seconds west, a distance of 103.16 feet to the point of beginning; then south 89 degrees 56 minutes 11 seconds west, a distance of 130.00 feet. SECTION 2: That all requirements set forth in the Zoning Ordinance of the City of McHenry, as would be required by any owner of property zoned in the same manner as the property described above, shall be complied with. Target Zoning Variation Ordinance, Page 1 SECTION 3: The findings and recommendations of the Zoning Board of Appeals on the question of granting the rezoning for the subject property are hereby accepted. SECTION 4: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
