HomeMy WebLinkAboutOrdinances - O-93-641 - 11/03/1993 - GRANT ZONING HILLSIDE DEVELOPMENT N/K/A PEBBLE CREORDINANCE NO. 0-93-641 An Ordinance Zoning Certain Territory Known as Hillside Development in the City of McHenry WHEREAS, THE CITY OF McHENRY has been requested by a petition signed by McHenry State Bank, not individually but as Trustee under Trust Agreement dated August 25, 1992, and known as Trust No. 12725, Gerstad Builders, Inc., and Donald Gerstad to annex and zone 60.52± acres located on the east and west side of Green Street, approximately 1,000 feet south of Bull Valley Road; and WHEREAS, A PUBLIC HEARING was held by the McHenry Zoning Board of Appeals, after due notice in the manner provided by law; and WHEREAS, THE ZONING BOARD OF APPEALS, after deliberation, has made a report and recommended the granting of said zoning; and WHEREAS, THE CITY COUNCIL has considered the findings of fact, based upon the evidence presented at the public hearing, presented to the Zoning Board of Appeals by the petitioners. NOW, THEREFORE, BE IT ORDAINED by the City Council of the CITY OF McHENRY, McHenry County, Illinois, as follows: SECTION 1: As outlined in the annexation agreement between the City and Petitioners previously approved by the City Council, the petition for zoning to RS-2 Medium Density Single Family Residential District for the following parcel shall be granted: Parcel 1: The Southeast Quarter of the Southwest Quarter and the South 247.45 feet of the Northeast Quarter of the Southwest Quarter of Section 2, Township 44 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois (47 acres lying west of Green Street). SECTION 2: As outlined in said annexation agreement between the City and Petitioners, the petition for zoning to Estate District for the following parcel shall be granted: Parcel 2: The Southwest Quarter of the Southeast Quarter (except that part falling within McHenry Shores Unit No. 5, according to the Plat thereof recorded September 20, 1960 as Document No. 375179; also except the North 165 feet; also except that part falling within Document No. 383576) in Section 2, Township 44 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois (13 acres lying east of Green Street). Hillside Zoning Ordinance, Page 1 SECTION 3: That all requirements set forth in the Zoning Ordinance of the City of McHenry, as would be required by any owner of property zoned in the same manner as the property described above, shall be complied with. SECTION 4: The findings and recommendations of the Zoning Board of Appeals on the question of granting the rezoning for the subject property are hereby accepted. SECTION 5: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 6: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 7: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.
