HomeMy WebLinkAboutOrdinances - O-93-637 - 10/06/1993 - GRANT RECLASS DON AND DEBBIE KATES 1402 N GREEN STORDINANCE NO. 0-93-637 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF MCHENRY, ILLINOIS, BY GRANTING A RECLASSIFICATION THEREON BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: Whereas a written Petition signed by Donald and Debbie Kates has been filed with the City Clerk of the City of McHenry, Illinois requesting the granting of a reclassification under the provisions of the Zoning Ordinance as amended, concerning the following described premises: The southerly 6 feet of lot 10 and all of lot 11, in block 14 of the original plat of McHenry, on the west side of the Fox River, in the southeast quarter of section 26, according to the plat thereof recorded in the recorder's office of McHenry County, Illinois, in book "B" of plats, on page 160, lying and being in the city of McHenry, in the county of McHenry, in the state of Illinois, commonly known as 1402 N. Green St. Whereas, a hearing was held before the City of McHenry Zoning Board of Appeals on September 20, 1993, as which time the Zoning Board of Appeals did take evidence and view exhibits presented thereat by the petitioners, and; Whereas based on evidence heard, the Zoning Board of Appeals found that there was no overriding reason for not granting the requested zoning reclassification; reclassification from C4 to RS4. Whereas, based on the Zoning Board of Appeals found, and the City Council concurs in that finding, that it would serve the interests of the City if the subject property were reclassified from C4 to RS4, in that: A. The majority of the properties in the vicinity are classified RS4 making the proposed use of this property compatible to it's environs. B. This property was originally zoned for residential purposes, then reclassified for commercial purposes and is now proposing a residential classification once again. The trend of development in the general area since the original zoning continues to be residential. C. The proposed zoning classification conforms to the approved comprehensive plan in this area if the city of McHenry. D. The proposed zoning classification promotes public interest since it will classify this property from commercial to one of residential use once again. The majority of the existing homes in the area are classified RS4. Now, therefore, be it ordained by the City Council of the City of McHenry, Illinois, as follows: That a reclassification from C4 to RS4 is given to the property being legally described above, that is: The southerly 6 feet of lot 10 and all of lot 11, in block 14 of the original plat of McHenry, on the west side of the Fox River, in the southeast quarter of section 26, according to the plat thereof recorded in the recorder's office of McHenry County, Illinois, in book "B" of plats, on page 160, lying and being in the city of McHenry, in the state of Illinois. This ordinance shall be published in pamphlet form by and under the authority of the corporate authorities of the City of McHenry, Illinois. This ordinance shall be in full force and effect from and after it's passage, approval and publication in pamphlet form, as provided by law. Passed this 6th_ day of October , 1993.
