ORDINANCE NO. 0-93-628
AN ORDINANCE VARYING THE ZONING
ORDINANCE OF THE CITY OF MCHENRY
WHEREAS, a Petition was filed by the Petitioners, Bruce T.
Bartos and Donna Bartos, requesting a variance regarding the
property set forth on Exhibit "A" and
WHEREAS, the Petitioners requested a variance of the zoning
ordinance of the City of McHenry, in regard to Table 4, Residential
District Requirements providing for a front yard setback variance
and,
WHEREAS, a public hearing was held before the Zoning Board of
Appeals on May 3, 1993, at which time the Zoning Board of Appeals
did hear evidence in the matter of the Variance Petition; and
WHEREAS, the Mayor and the City Council of the City of McHenry
hereby expressly find that all of the following conditions apply to
the aforesaid variance, special circumstances not found elsewhere,
and which are peculiar to this property exist, that these
circumstances relate to this property only, that these
circumstances are not a result of any action of the applicants,
that the strict application of the ordinance would result in an
unnecessary hardship to the applicants, that the granting of the
variance is necessary for the applicants to preserve and enjoy a
substantial property right enjoyed by others within the same zoning
classification, that the granting of the variance is necessary to
allow the applicants the reasonable use of applicant's property,
that the granting of the variance will not alter the local
character, that the variance is consistent with the zoning
ordinance and the comprehensive plan, and that the variance
requested is the minimum required to provide the applicants the
reasonable use and enjoyment of applicant's property.
NOW THEREFORE BE IT ORDAINED by the City Council of the City
of McHenry as follows:
ONE. That the above recitals are hereby adopted as if set
forth fully herein.
TWO. That the requested variance is hereby granted to the
premises providing for a building line consisting of a straight
line connecting the East and West lines of said lot at points
thereon located thirty (30) feet from the Northeast and Northwest
corners of said lot.

Lot 26 in Winding Creek Unit No. 1, being a Subdivision of part of
the Northwest Quarter of Section 3 and part of the Northeast
Quarter of Section 4, 'Township 44 North, Range 8 East of the Third
Principal Meridian, and part of the Southeast Quarter of Section
33, Township 45 North, Range 8 East of the Third Principal
Meridian, according to the plat thereof recorded July 23, 1979 as
Document No. 774302 in McHenry County, Illinois.
