AN ORDINANCE GRANTING A USE VARIANCE TO PERMIT THE USE OF NO MORE THAN THREE DWELLING UNITS IN AN EXISTING SINGLE FAMILY RESIDENCE WHEREAS, a written Application on behalf of HOME OF THE SPARROW, contract purchaser, has been filed with the City Clerk of the City of McHenry, Illinois, requesting the granting of a use variance under the provisions of the Zoning Ordinance of the City of McHenry, and such Ordinance as amended, concerning the following described premises: The North Half of the following described tract of land: All that portion of Lot 2 in Block 1 of the Original Plat of the Village of West McHenry, which lies Westerly of a line drawn from a point on the Southerly line of the Waukegan Road, 2 1/4 rods Westerly from the Northeasterly corner of Lot 3 in Block 1, to a point on the Northerly line of Main Street, 1 rod Easterly from the Southwesterly corner of said Lot 2. ALSO Lot 3 in said Block 1 (excepting therefrom all that portion thereof which lies Easterly of a line drawn from a point on the Southerly line of the Waukegan Road, 2 1/4 rods Westerly from the Northeasterly corner of said Lot 3, to a point on the Northerly line of Main Street, 1 rod Easterly from the Southeasterly corner of said Lot 31; said Block 1 being located in and being a part of the Southwest Quarter of Section 26 and the Northwest Quarter of Section 35 in Township 45 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois, commonly known as 3701 West Waukegan Road, McHenry, Illinois. WHEREAS, said Applicant is requesting a use variance to permit the occupancy and use of no more than three dwelling units on the above -described premises, to be occupied solely by single women with or without their children; and WHEREAS, a hearing was had before the City of McHenry Zoning Board of Appeals on 25 January, 15 February and 22 March 1993, at which times the Zoning Board of Appeals did take evidence and view exhibits presented thereat by the Applicant, and WHEREAS, based on the evidence heard, the Zoning Board of Appeals, upon an affirmative vote of 5 of its members, recommended to the Mayor and City Council that the requested zoning use variance be granted, NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of McHenry, Illinois, as follows: That a use variance is hereby granted to permit the use of the above -described RA-1 premises for no more than three dwelling units, to be occupied solgly by single women with or without their children, in the residence legally described above and located 'at 3701 West Waukegan Road, McHenry, Illinois. BE IT FURTHER ORDAINED that this Ordinance shall be in full force and effect from and after passage, approval and publication as provided by law. Passed this 7th day of April, 1993.
