HomeMy WebLinkAboutOrdinances - O-92-609 - 10/07/1992 - GRANT CUP FOR GOLF LEARNING CENTER IN MCH CORPORATCD(-F LEAP_rI l N G C Ew-TzR- ORDINANCE NO. 0-92-609 AN ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS: WHEREAS, an application for the issuance of a conditional use permit under the Zoning Ordinance of the -City of McHenry, Illinois, for the construction and operation of a golf range and golf learning center on the premises described in Section 2 hereof was duly filed and regularly heard by the Zoning Board of Appeals, pursuant to proper notice first having been given; and WHEREAS, the subject property is zoned I-1, Industrial District under the terms and provisions of an annexation agreement, and the Zoning Board of Appeals did expressly find that the use of the subject property for a golf range and golf learning center will be compatible with the existing uses in the area, and with the permitted uses in the zoning district in the following ways: a. Traffic: Any adverse impact of types or volumes of traffic flow not otherwise typical in the zoning district has been minimized. b. Environmental Nuisance: Any adverse effects of noise, glare, odor, dust, waste disposal, blockage of light or air, or other adverse environmental effects of a type or degree not characteristic of Permitted Uses in the zoning district, have been appropriately controlled. c. Neighborhood Character: The proposed use will fit harmoniously with the existing natural or man-made character of its surroundings, and with Permitted Uses in the zoning district. The use will not have undue deleterious effect on the environmental quality, property values, or neighborhood character already existing in the area or normally associated with Permitted Uses in the district. d. Public Services and Facilities: The proposed use will not require existing community facilities or services to a degree disproportionate to that normally expected of Permitted Uses in the district, nor generate disproportionate demand for new services or facilities, in such a way as to place undue burdens upon existing development in the area. e. Public Safety and Health: The proposed use will not be detrimental to the safety or health of the employees, patrons, or visitors associated with the use nor of the general public in the vicinity. and did recommend to the City Council that said conditional use be granted. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MCHENRY, ILLINOIS as follows: SECTION 1: That the City Council hereby expressly makes the following findings with regard to the aforesaid application for conditional use: a. SECTION 2: That a conditional Use Permit is hereby granted to Mike Warner to construct and to operate golf learning center consisting of an outdoor golf driving range having not more than 55 driving tees, lighting for night use, putting green, teaching area, small indoor facility for private golf lessons, indoor facilities for storage, snack shop (vending machines) and an equipment sales accessory use, on the following described premises: Part of the North Half of Section 10, Township 44 North,Range 8 East of the Third Principal Meridian described as follows: Beginning at the northwest corner of Lot 3 in McHenry Corporate Center Unit One, according to the plat thereof, recorded October 6, 1989 as Document NO. 89R033780 in McHenry County, Illinois; thence North 89 degrees 48 minutes 02 seconds West 770.22 feet along the north line of said McHenry Corporate Center Unit One; thence North 12 degrees 19 minutes 46 seconds West, 959.66 feet; thence South 89 degrees 48 minutes 02 seconds East, 720.69 feet to the beginning of a non -tangent curve, concave easterly and having a radius of 683.00 feet; thence southerly along said curve with a chord bearing of South 07 degrees 17 minutes 49 seconds East, for an arc distance of 393.75 feet to a point of tangency; thence South 23 degrees 48 minutes 45 seconds East, 452.00 feet to the beginning of a curve, concave westerly and having a radius of 280.00 feet; thence southerly 142.36 feet along said curve to the point of beginning in McHenry County, Illinois. That the conditional use permit is granted subject to the following conditions, to -wit: a. The hours of operation shall be restricted to the hours between 8:00 o'clock in the morning and 10:00 o'clock in the evening. b. That the driving range lights shall be deflected away from all residential areas and shall be extinguished no later than 11:00 o'clock P.M. C. That a buffer/landscape plan adjoining the Medela premises shall be submitted to the City Council for its approval and shall be implemented before golf driving range activities are commenced on the subject premises. 3 d. That the premises shall be developed substantially in conformance with theā€¢Site Plan and Building Plans which are attached hereto as Exhibits A and B respectively. _ e. That the above -described premises, which are a part of a larger unsubdivided tract, shall be subdivided into one or more lots or parcels in accordance with the provisions of the Subdivision Control Ordinance of the City prior to the issuance of an occupancy permit. SECTION 3. All ordinances, or parts thereof, in conflict with the terms and provisions hereof, be and the same are hereby repealed to the extent of such conflict. SECTION 4. That all maps, plans, journals and other records including the Zoning District Map of the City of McHenry, be and the same are hereby amended to reflect the granting of the Conditional Use Permit to the above described real estate. SECTION 5. This ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form, as provided by law. PASSED THIS 7th DAY OF October 1992.
