OF A CONDITIONAL USE UNDER THE ZONING )
ORDINANCE OF THE CITY OF MCHENRY, )
MCHENRY COUNTY, ILLINOIS. )
WHEREAS, Petitioners, AMERICAN NATIONAL BANK AND TRUST COMPANY -
OF CHICAGO, AS TRUSTEE UNDER TRUST AGREEMENT NO. 1010-30-00, KEVIN
MUNDT and FRANK MUNDT, did apply for a Conditional Use to operate
a family entertainment center; and
WHEREAS, the City Council of the City of McHenry did grant
said Conditional Use with provisions contained therein as set forth
in Ordinance No. 0-90-527; and
WHEREAS, Petitioners have requested expansion and enlargement
of the existing Conditional Use to operate a family entertainment
center; and
WHEREAS, Paragraph XIV G of the City of McHenry Zoning
Ordinance does allow for the expansion and enlargement of a
Conditional Use by making application for an Additional Use Permit
before the City Council which may grant such application without
any hearing or action by the Zoning Board of Appeals; and
WHEREAS, as a result of the presentation of evidence and
testimony by Petitioners before the City Council, the City Council
does find that it is in the best interest of the City that an
Additional Conditional Use Permit be granted without hearing or
action by the Zoning Board of Appeals.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City
of McHenry, McHenry County, Illinois that the Conditional Use
Permit granted by Ordinance No. 0-90-527 is hereby expanded and
enlarged and that an Additional Conditional Use Permit shall issue
to Petitioners in conformance with the floor plan submitted by
Petitioners, prepared by Direct Design Ltd. containing a revised
date of September 14, 1992, a copy of which is attached hereto and
marked as Exhibit "A".
This Ordinance shall be in full force and effect from and
after its passage as provided by law.

OF MCHENRY, MCHENRY COUNTY, ILLINOIS, THIS 30th DAY OF SEPTEMBER,
1992.
