Gilpin, City C erk ' y ,•'' i of the City of McHenry, Illinois oJD/ i 92-46-0514 92R 039018 r 0-92-602 AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS WHEREAS, a written Petition, signed by all of the legal owners and all of the electors of record of all land within the territory hereinafter described, has been filed with the City Clerk of the City of McHenry, McHenry County, Illinois, requesting that said territory be annexed to the City of McHenry; and WHEREAS, the said territory is not within the corporate limits of any municipality but is contiguous to the City of McHenry; and WHEREAS, said territory is not part of any public library district; and WHEREAS, legal notices regarding the intention of the City to annex said territory have been sent to all public bodies required to receive such notice by State statute; and WHEREAS, McHENRY STATE BANK, as Trustee under the provisions of a Trust Agreement dated July 4, 1990, and known as Trust No. 12302, DAVID L. BACKHAUS, KATHERINE M. BACKHAUS, McHENRY STATE BANK, as Trustee under the provisions of a Trust Agreement dated July 4, 1990, and known as Trust No. 12303, DONALD E. BACKHAUS, JOANNE C. BACKHAUS, McHENRY STATE BANK, as Trustee under the provisions of a Trust Agreement dated July 4, 1990, and known as Trust No. 4991, FREMONT BACKHAUS and IRENE BRACKMANN, have entered into a valid and binding Annexation Agreement relating to said territory; and 92-46-0515 -92R 039018 WHEREAS, all Petitions, documents and other necessary legal requirements are in full compliance with the requirements of said Annexation Agreement and with the Statutes of the State of Illinois, specifically Chapter 24, Section 7-1-8, Illinois Revised Statutes (1989); and WHEREAS, it is in the best interests of the City of McHenry that said territory be annexed thereto. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS, as follows: SECTION I: That the following described territory, including any and all portions of adjacent streets, roads and highways: The North Half of the South 720 feet, as measured at right angles, of the West 907.5 feet of the West Half of the Southwest Quarter of Section 33, Township 45 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois. The South Half of the South 720 feet, as measured at right angles, of the West 907.5 feet of the West Half of the Southwest Quarter of Section 33, Township 45 North, Range 8 East of the Third Principal Meridian, in McHenry County, Illinois. That part of the Northeast Quarter of Section 4, Township 44 North, Range 8 East of the Third Principal Meridian, described as follows: Beginning at a point in the center line of Crystal Lake Road, said point being 1098 feet Southwesterly as measured along the center line of Crystal Lake Road, of the intersection of said center line and the North line of Section 3, Township 44 North, Range 8 East of the Third Principal Meridian; thence South 89 degrees 28 minutes 54 seconds West (bearing assumed), a distance of 725.00 feet; thence South 00 degrees 27 minutes 58 seconds East, a distance of 155.91 feet; thence Southeasterly along a curve to the right having a radius of 600.00 feet ( chord bearing is South 71 degrees 55 minutes 21 seconds East), an arc distance of 323.53 feet; thence South 56 degrees 28 minutes 31 2 92-46-0516 92R 039018 seconds West, a distance of 205.51 feet to the center line of said Crystal Lake Road; thence North 33 degrees 31 minutes 27 seconds East, along said center line a distance of 450.00 feet to the point of beginning, in McHenry County, Illinois. SECTION II: That the City Clerk of the City of McHenry is hereby directed to record in the Office of the Recorder of Deeds of McHenry County, Illinois, being the County in which the aforesaid annexed territory is situated, a certified copy of this Ordinance together with an accurate map of the territory hereby annexed, said map being attached hereto and made a part hereof and labeled Exhibit "I". SECTION III: That this ordinance shall be in full force and effect from the after its passage and approval, and when a certified copy thereof, together with an accurate map is recorded in the Office of the Recorder of Deeds of McHenry County, Illlinois, and filed in the Office of the County Clerk of McHenry 4 92-46-0518 92R 03r9018 County, Illinois; and thereupon said territory shall be subject: to the jurisdiction of the City of McHenry.
