ORDINANCE NO. 0-92-594
AN ORDINANCE FOR A CONDITIONAL USE
UNDER THE ZONING ORDINANCE
OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS
WHEREAS, your Petitioner, MCHENRY STATE BANK AS
TRUSTEE OF A TRUST AGREEMENT DATED NOVEMBER 27, 1990 AND KNOWN
AS TRUST 12352, 3510 Elm Street, McHenry, Illinois 60050,
MCHENRY CORPORATE CENTER, INC., an Illinois Corporation and
CENTER POINT BUILDING CORPORATION, an Illinois Corporation,
4500 Prime Parkway, McHenry, Illinois (herein collectively
referred to as the "Owners of Record") and SERVICEMASTER
COMPANY LIMITED PARTNERSHIP, d/b/a GREENTREE CHILD CARE, One
ServiceMaster Way, Downers Grove, Illinois is the Lessee of:
the following described real estate located within the City of
McHenry, McHenry County (hereinafter sometimes referred to as
the "Subject Property"):
Lots 4, 5 and 6 in McHenry Corporate Center Unit 1, being
a part of the Northeast Quarter and part of the Northwest
Quarter of Section 10, Township 44 north, Range 8 East of
the Third Principal Meridian, according to the Plat
thereof recorded October 6, 1989 as Document No.
89R33780, in McHenry County, Illinois.
WHEREAS, an office building containing the Lessee's day
care operation is presently located on lots 4 and 5 aforesaid,
known as 4500 Prime Parkway which is at the Northwest corner
of the intersection of Corporate Drive and Prime Parkway, and
across the street and to the West of Automotive Brake Realty,

Inc. and Lessee uses a 10,000 foot section of vacant Lot 6
adjacent to the aforesaid office building; and
WHEREAS, the Subject Property is presently classified
- Industrial District under the provisions of an Annexation
Agreement dated July 19, 1989 with the City of McHenry Zoning
Ordinance; and
WHEREAS, the Petitioner has requested that such
Conditional Use Permit be issued for Child Care Center to
permit a day care center operation; and
WHEREAS, a Notice of Public Hearing before the Zoning
Board of Appeals of the City of McHenry, Illinois was
published in the Northwest Herald, a newspaper of general
circulation, within the time provided by law; and
WHEREAS, a hearing on said Petition was held, pursuant to
proper notice, before the Zoning Board of Appeals of the City
of McHenry in the manner and in the form as prescribed by
Ordinance and Statute; and
WHEREAS, as result of said hearing, the taking of
evidence and the viewing of exhibits advanced thereat, the
Zoning Board of Appeals of the City of McHenry have made their
recommendations and have submitted their required findings of
fact on the requested Conditional Use to the Mayor and City
Council.
NOW, THEREFORE, BE IT ORDAINED by the Corporate
Authorities of the City of McHenry, McHenry County, Illinois,
as follows:
Section One: The above recitals are hereby incorporated
herein by reference.
Section Two: The Corporate Authorities of the City of
McHenry have considered the findings of fact as submitted by
the Zoning Board of Appeals of the City of McHenry and hereby
finds that Petitioner has satisfied the criteria and required
findings of fact set forth in the Statutes of the State of
Illinois, as well as those set forth in the City of McHenry
Zoning Ordinance for the requested conditional use for the
operation of a day care facility on the Subject Property.
Section Three: The Subject Property as described herein
is hereby granted a Conditional Use Permit by the City of
McHenry to allow the Petitioner to operate a day care center
on the subject property described herein.
Section Four: All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section Five: This Ordinance shall be known as Ordinance
No. and shall be in full force and effect from and after
its passage and approval, as is provided by law.
