ORDINANCE NO. 0-92-589
AN ORDINANCE PROVIDING FOR THE ANNEXATION
OF CERTAIN DESCRIBED REAL ESTATE TO
THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
WHEREAS, MCHENRY STATE BANK, AS TRUSTEE UNDER THE PROVISIONS
OF A TRUST AGREEMENT DATED MARCH 15, 1977, AND KNOWN AS TRUST NO.
1181, is the record owner of the real estate hereinafter described;
and
WHEREAS, no electors reside on said real estate; and
WHEREAS, said real estate is contiguous to the existing
corporate limits of the City of McHenry, Illinois, and is not
located within any other municipality; and the aforesaid record
owner desires annexation of said real estate and has petitioned the
Corporate Authorities of the City of McHenry, Illinois, in writing
and under oath, for annexation of said real estate; and
WHEREAS, the land to be annexed is a part of the McHenry
Public Library District and the McHenry Township Fire Protection
District, and the City not providing either library or fire
protection service, no notice therefore being given to the Trustees
of each district; and
WHEREAS, the Corporate Authorities for and on behalf of the
City of McHenry, McHenry County, Illinois, have heretofore approved
an Annexation Agreement bearing the date of February 5, 1992,
between itself and McHENRY STATE BANK, AS TRUSTEE UNDER TRUST NO.
1181, record title owner to said real estate hereinafter described,

which provides in part for the annexation of said real estate to
the existing corporate limits of the City of McHenry, McHenry
County, Illinois, for the classification of said real estate under
the provisions of the City of McHenry Zoning Ordinance, and for
approval of the Preliminary Plat of Subdivision for said real
estate with variations under the provisions of the City of McHenry
Subdivision Control Ordinance; and
WHEREAS, upon proper notice, public hearings were held
pursuant to the State statute and the appropriate provisions of the
Zoning Ordinance and of the Subdivision Control Ordinance of the
city of McHenry relative to the request for annexation, zoning and
preliminary platting.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MCHENRY, MCHENRY COUNTY, ILLINOIS, as follows:
SECTION 1: The following described real estate be and the
same is hereby annexed to and made a part of the corporate limits
of the City of McHenry, Illinois, including any and all portions of
adjacent streets, roads, or highways as required by law:
Beginning at the Northwest corner of the
Northwest Quarter of the Northwest Quarter of
Section 11, Township 44 North, Range 8, East
of the Third Principal Meridian, in McHenry
County, Illinois; thence East along the North
line thereof 1316.35 feet to a point marking
the Northeast corner of said Quarter Quarter
Section; thence South along the East line
thereof 596.55 feet to a point; thence West
parallel with the aforesaid North line, a
distance of 1316.35 feet, more or less, to a
point on the section line between Sections 10
and 11, Township and Range aforesaid; thence
continuing West along the same course, a
distance of 292.86 feet, more or less, a total
distance on this course of 1609.21 feet, to a

point in the center line of State Route 31;
thence Northeasterly, on a straight line, at
an angle of 63 degrees, 01 minutes, turned
counterclockwise from the last described
course, a distance of 670.56 feet to the place
of beginning. All lying and being in a part
of the Northeast Quarter of the Northeast
Quarter of Section 10 and in the Northwest
Quarter of the Northwest Quarter of Section
11, Township 44 North, Range 8 East of the
Third Principal Meridian, in McHenry County,
Illinois.
That a Plat of Survey of said real estate is attached hereto
as Exhibit "A".
SECTION 2: The City Clerk is hereby directed to cause the
plat of survey to be recorded with a certified copy of this
Ordinance, in the Office of the Recorder of Deeds, McHenry County,
Illinois. Following the recordation of this Ordinance and said
plat of survey of the real estate above described and annexed, a
copy thereof shall be filed in the Office of the Clerk of McHenry
County, Illinois.
SECTION 3: This Ordinance shall be in full force and
effect from and after its passage and approval according to law.
