ORDINANCE NO. 0-91-585
AN ORDINANCE AUTHORIZING THE SALE BY PUBLIC AUCTION OF
PERSONAL PROPERTY OWNED BY THE CITY OF MCHENRY
WHEREAS, in the opinion of at least three -fourths of the corporate
authorities of the City of McHenry, it is no longer necessary or useful to
or for the best interests of the City of McHenry to retain ownership of the
personal property hereinafter described; and
WHEREAS, it has been determined by the Mayor and City Council of the
City of McHenry to sell said personal property at public auction for cash.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
McHENRY as follows:
SECTION 1: Pursuant to Section 11-76-4 of Illinois Revised Statutes,
Chapter 24, t e Mayor and City Council of the City of McHenry find that the
following described personal property, to wit:

Miscellaneous Office Equipment and Furniture
now owned by the City of McHenry is no longer necessary or useful to the
City, and the best interests of the City would be best served by its sale.
SECTION 2: Pursuant to said Section 11-76-4, the City Administrator is
hereby authorized and directed to sell the aforementioned personal property
now owned by the City of McHenry for cash at public auction or by sealed bid
to the highest bidder. The City Administrator is authorized to set the date
for public auction and establish the format for the sealed bid documents.
SECTION 3: The City Administrator is hereby authorized to advertise
the sae of tie aforementioned personal property in a newspaper published
within the community before the date of said public auction and to advertise
in the Illinois Municipal Review for the sealed bid items.
SECTION 4: The City Administrator is hereby authorized and directed to
enter into an agreement for the sale of said personal property with an
auctioneer. The City Administrator may also establish minimum acceptable
bid prices for any item of personal property sold.
SECTION 5: No bid which is less than the minimum value that may be set
forth shall be accepted, unless a lower amount is authorized by the City
Administrator or his representative at the auction.
SECTION 6: Upon payment of the full auction or accepted sealed bid
price, the City Administrator is hereby authorized and directed to convey
and transfer title to the aforesaid personal property to the successful
bidder.
SECTION 7: This ordinance shall be in full force and effect from and
after its passage of at least three -fourths of the corporate authorities,
and approval in the manner provided by law.
