ORDINANCE NO. 0-91-578
PROVIDING FOR THE ANNEXATION OF 'CERTAIN
DESCRIBED REAL ESTATE TO THE EXISTING CORPORATE LIMITS
OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS
AND AMENDING THE ZONING ORDINANCE OF THE CITY OF MCHENRY,
MCHENRY COUNTY, ILLINOIS TO ZONE THE REAL ESTATE ANNEXED
WHEREAS, John B. Hoffstetter and Elaine L. Hoffstetter,
Phillip Hoffstetter, Jeffrey W. Hoffstetter, individually and
as general partners of Hoffstetter Properties, an Illinois
general partnership (Hoffstetter Properties) and McHenry State
Bank as Trustee of Trusts Nos. 4213 and 4432 ("Owners"), are
the record owner of the real estate hereinafter described; and
WHEREAS, Church of Holy Apostles (the Church) has
entered into a Purchase Agreement with the Owners of said real
estate; and
WHEREAS, said real estate is contiguous to the existing
corporate limits of the City of McHenry, McHenry County,
Illinois and the Owners abovenamed desire annexation of said
real estate and have petitioned the City Council of the City of
McHenry, Illinois, for annexation of said real estate; and
WHEREAS, the Corporate Authorities for and on behalf of
the City of McHenry, McHenry County, Illinois, have heretofore
approved an Annexation Agreement bearing the date of the 15th
day of July, 1991, between itself and Hoffstetter Properties,
the Church and McHenry State Bank as Trustee of Trusts Nos.
4213 and 4432, which provides in part for the annexation of
said real estate to the existing corporate limits of the City
of McHenry, McHenry County, Illinois and for the
reclassification of the following described property to "E" -
Estate District; and the issuance of a Conditional Use Permit
for a church in order to permit the construction and operation
of a church, rectory, school, attendant services and
administrative offices on the subject property and a variation
of the one principal building per zoning lot regulation in
order to allow the uses specified above; and

WHEREAS, notice of public hearing before the City
Council was published in the Northwest Herald, a newspaper of
general circulation in the City of McHenry, within the time
provided by law; and
WHEREAS, the City Council has held a public hearing on
said request for annexation.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF W

THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS A FOLLOWS; W

SECTION I. The following described real estate be and
the same is hereby annexed to and made part of the corporate
limits of the City of McHenry, McHenry County, Illinois
including and and all portion of adjacent streets roads or
highways as required by law:
The Northeast Quarter of the Southeast Quarter (except the
East 494.49 feet thereof) of Section 4, lying South of the
Centerline of Bull Valley Road, as dedicated by dedication
recorded November 30, 1972 as Document No. 607443, all in
Township 44 North, Range 8 East of the Third Principal
Meridian, McHenry County, Illinois.
SECTION II. The City Clerk is hereby directed to
prepare an accurate map of the real estate described and
annexed and when satisfied as to the accuracy of said map,
record the map and a certified copy of this Ordinance in the
Office of the Recorder of Deeds, McHenry County, Illinois.
Following the recordation of this Ordinance and the map of the
real estate above described and annexed, a copy thereof shall
be filed in the Office of the Clerk of McHenry County, Illinois.
SECTION III. The real estate hereinabove annexed in
Section I be and the same is hereby classified as "E" - Estate,
and a Conditional Use Permit is hereby issued in order to
permit the construction and operation of a church, rectory,,
school, attendant services and administrative offices on the
subject property and a variation of the one principal building
per zoning lot regulation in order to allow the uses specified
above.

SECTION IV. All maps, plats, journals and other
records, including the official city map of the corporate
boundaries, official land use map of the Comprehensive Plan,
and the zoning district map of the City of McHenry be and the
same are hereby amended to reflect the annexation and the
zoning of the real estate as described in Section I and III
hereinabove.
SECTION VI: This Ordinance shall be known as Ordinance
No. 0-91-578 and shall be in full force and effect from and after
its passage and approval according to law.
